These are weak government, inequality, absence of citizen participation, corruption and an ineffective legal system. Fundamental reforms in Colombia should begin by directly strengthening the moral legitimacy of the government, holistically enhancing socioeconomic development, and meticulously reforming the legal system, thus reestablishing the rule of law. The rule of law, in turn, is critical to the achievement of the ultimate purposes of Plan Colombia--peace, prosperity, and the strengthening of the state. Systemic reform requires well-conceived, long-term, and careful implementation. Unless thinking and actions are reoriented to deal with these realities, the alternative is social calamity, criminal anarchy, and civil war.

Fascell North-South Center has been to elucidate as broadly as possible the many facets of the Colombian dilemma, the worst security problem which the Western Hemisphere faces today. This monograph concerns the challenge to reform Colombian judicial institutions. Plan Colombia carries with it, by the reckoning of President Andres Pastrana's government, a $7.5 billion price tag. The United States has committed $1.3 billion to the effort, largely in military aid, antinarcotics programs, and the equipment and training that go with them. Europe is supposed to provide $1 billion in humanitarian aid, social programs, and other nonmilitary assistance, but its money has not been forthcoming. Meanwhile, the United States does, through the United States Agency for International Development, offer a $122 million package for judicial reform and, in fact, has carried out programs of judicial reform in the past.

The European Union and the United States have identified Latin American cocaine trafficking as a security threat, but their policy responses to it have differed. This book examines the ways in which the EU and the US have conceptualized this threat. Furthermore, it explores the impact of cocaine trafficking on four state functions - economic, political, public order and diplomatic - in order to explain why it has become 'securitized'. The book articulates a typology for assessing the threats of CPS and for implementing appropriate strategies to achieve sustainable peace effectively and efficiently. The international case studies address interventions undertaken either to support the implementation of a peace agreement (i.e., a peace operation) or to stabilize a country entangled in an internal conflict in the context of a power-sharing agreement among key protagonists (i.e., a stability operation). In each of these cases, at least one of the parties to the agreement was a criminalized power structure that was a leading spoiler. The final chapter identifies strategies that are most effective for each type of CPS, including the ways and means (or tools) required for effective conflict transformation. A companion volume, Combating Criminalized Power Structures: A Toolkit, provides practitioners with the means of coping with the challenges posed by CPS.

As a threshold matter, policy, strategy, and military asset management in contemporary conflict in virtually any unstable part of the world must deal with the problem of governance in [beta]lawless areas.[gamma] Unless a central government such as that in Colombia can exert legitimate control and governance in the 60+ percent of the municipalities not under its control, there can be no effective judicial system and rule of law; no effective legal crop substitution programs; no effective democratic processes; and, only very little military or police action to bring law and order into unknown and difficult terrain. Indeed, control of the national territory is a strategic paradigm for 21st century conflict. The state is under assault by a powerful combination of state weaknesses, [beta]lawless areas, [gamma] and insurgent and criminal terrorism. All these contributors to instability and violence have a powerful effect on local, regional, national, and international security. Colombia and other states experiencing conflicts that range from criminal anarchy to virtual civil war must understand that putting treasure and blood into a conflict situation without first establishing the strategic foundations of success only result in ad hoc, piece-meal, disjointed, and ineffective reactions to truly inconsequential problems.
