Book excerpt: This inquiry was prompted by the finding that in the 2006-07 session schools were the subject of around 100 different statutory instruments made by the Department for Children, Schools and Families (DCSF). Evidence from schools' representatives has convinced the Committee that the Department need to overhaul their approach, and actively to manage the planning and production of secondary legislation and guidance. Too many regulations are currently introduced piecemeal, throughout the school year. The Committee concludes that DCSF should bring schools-related instruments into force on a single date - 1 September is recommended - and give schools at least a term's notice to prepare to implement them. The Government should, moreover, adopt a less heavy-handed approach in its relationship with schools, and shift its focus away from the regulation of processes through statutory instruments towards establishing accountability for the delivery of key outcomes. This approach would leave greater room for the professionalism of practitioners to deliver the objectives of improving education. The Committee has also found that DCSF rarely reviews the effect of the regulations that it imposes. As a consequence, the Department does not know whether a statutory instrument has achieved its policy objective. The Committee calls on the Department to review the implementation of all significant regulations.

Book excerpt: Following on from the Leitch Review of Skills (ISBN 9780118404860) published in December 2006, this Green Paper sets out the Government's proposals to raise the level of the UK skills base in order to meet the needs of the UK economy and to promote social justice and social inclusion. It sets out proposals for consultation to raise the compulsory participation age for all young people in education or training until their 18th birthday, either at school or college, in work-based learning or in accredited training schemes, leading to accredited qualifications. It is proposed that this participation should be full-time for young people not in employment for a significant part of the week and part-time for those working more than 20 hours a week. This requirement would be phased in, introduced initially in 2013 for those aged 17 years old, with a later extension to require participation until 18 years old. It is judged that 2013 would be the earliest time by which a national entitlement to the new qualifications could be introduced, applicable to pupils who start Year 7 in September 2008, creating a clear expectation of continued participation for those young people right from the start of their secondary schooling. These proposals would apply to all 16 and 17 year olds resident in England.

Second, it amends legislation about the provision of adult education and training, and support for young people. Third, the Act changes the regulatory framework for inspection of independent educational institutions, non-maintained special schools and providers of initial teacher training. Fourth, the Act makes changes to the legislative competence of the National Assembly for Wales in the field of education and training. The Act also includes a number of miscellaneous provisions in relation to admissions, behaviour, National Curriculum assessment arrangements, considering the views of children, the Qualifications and Curriculum Authority (QCA) and schools forums. The Act is organised into five Parts with two Schedules. Schedule 1 deals with minor and consequential amendments and Schedule 2 covers repeals and revocations.
