By reconstructing the main phases of textual transmission, from the first authorial dissemination of the speeches to the medieval manuscripts, and by re-examining the abundant evidence on Ciceronian scholarship from the first to the sixth century CE, Cicero and Roman Education traces the history of the exegetical tradition on Cicero's oratory and re-assesses the 'didactic' function of the speeches, whose preservation was largely determined by pedagogical factors.

This paragon was no mere rabble-rouser or mouther of words: he was man of wide culture who had been trained in the finer arts of rhetoric, through which he aimed to give his speeches a moral dimension as well as the power to persuade. Book excerpt: This is the first book in English to take Cicero's forensic speeches seriously as acts of advocacy, i.e. as designed to ensure that the person he represents is acquitted or that the person he is prosecuting is found guilty. It seeks to set the speeches within the context of the court system of the Late Roman Republic and to explore in detail the strategies available to Roman advocates to win the votes of jurors. The volume comprises a substantial introduction, fourteen chapters by prominent Ciceronian scholars in Britain, North America, and Germany, and a final chapter by a current British Appeal Court judge who comments on Cicero's techniques from the point of view of a modern advocate. The introduction deals with issues concerning the general nature of advocacy, the Roman court system as compared with other ancient and modern systems, the Roman "profession" of advocacy and its etiquette, the place of advocacy in Cicero's career, the ancient theory of rhetoric and argument as applied to courtroom advocacy, and the relationship between the published texts of the speeches as we have them and the speeches actually delivered in court. The first eight chapters discuss general themes: legal procedure in Cicero's time, Cicero's Italian clients, Cicero's methods of setting out or alluding to the facts of a case, his use of legal arguments, arguments from character, invective, self-reference, and emotional appeal, the last of these especially in the concluding sections of his speeches. Chapters 9-14 examine a range of particular speeches as case studies--In Verrem II.1 (from Cicero's only major extant prosecution case), Pro Archia, De Domo Sua, Pro Caecina, Pro Cluentio, Pro Ligario. These speeches cover the period of the height of Cicero's career, from 70 BC, when Cicero became acknowledged as the leading Roman advocate, to 49 BC when Caesar's dictatorship required Cicero to adapt his well-tried forensic techniques to drastically new circumstances, and they contain arguments on a wide range of subject-matter, including provincial maladministration, usurpation of citizenship rights, violent dispossession, the religious law relating to the consecration of property, poisoning, bribery, and political offences. Other speeches, including all the better-known ones, are used as illustrative examples in the introduction and in the more general chapters. An appendix lists all Cicero's known appearances as an advocate.

Through a sentence-by-sentence stylistic analysis of the exordia of a selection of Cicero's judicial speeches, this book explores how Cicero uses a variety of rhetorical strategies to fulfill the aims of the exordium as he himself defined them. The speeches selected for study include the Pro Quinctio, Pro Roscio Amerino, and Pro Rege Deiotaro, and cover the span of Cicero's career. The focus of the analysis is on Cicero's "accretive" style--not a rhetorical device in the formal sense, but a conscious, stylistic effort whose effect is rhetorical. Because Cicero also wrote important treatises on oratory and rhetoric, this book measures how closely Cicero followed his own guidelines laid down for the exordium, and how and under what circumstances he deviated or departed from them.

Book excerpt: Orations was written by Marcus Tullius Cicero in the latter part of the year 46 B.C. It is his last work on rhetoric, three years before his death. Describing rhetoric, Cicero addresses previous comments on the five canons of rhetoric: Inventio, Dispositio, Elocutio, Memoria, and Pronuntiatio. In this text, Cicero attempts to describe the perfect orator, in response to Marcus Junius Brutus' request. Orations is the continuation of a debate between Brutus and Cicero, which originated in his text Brutus, written earlier in the same year. The oldest partial text of Orations was recovered in the monastery of Mont Saint-Michel and now is located in the library at Avranches. Thirty-seven existing manuscripts have been discovered from this text. Another complete text was discovered in 1421, near Milan in the town of Lodi. These two texts vary considerably between the two manuscripts and modern translators rely on both. In 46. B.C, when Cicero wrote Orations, many young Roman men revolted against the stylistic paradigms put forward by Cicero, and from most Roman traditions in general. Cicero writes in a defensive posture to this hostile audience.
