Lawmakers should be wary of policies that could be struck down in court as unconstitutional, considering recent decisions that have ruled in favor of a least restrictive alternative and away from broad, government-imposed censorship. Numerous tools and methods, both technical and non-technical, which can be used to control what media content children are exposed to in the home, include private ratings systems, V-chips, personal video recorders, controls provided by cable and satellite providers, and formal or informal household media consumption rules. Concerned parents and others can work with third parties to gather information and even work within the media marketplace to influence what fare is shown on broadcast and cable television, by making use of ratings and reviews provided by independent organizations and the many educational efforts aimed at teaching adults about parental controls available for all types of media, including television, movies and games. But if, for whatever reason, some parents are not taking advantage of these tools and options, their inaction should not be used to justify government regulation of programming as a surrogate for household/parental choice.

Book excerpt: As the Supreme Court has recognized, social media sites like Facebook and Twitter have become important venues for users to exercise free speech rights protected under the First Amendment. Commentators and legislators, however, have questioned whether these social media platforms are living up to their reputation as digital public forums. Some have expressed concern that these sites are not doing enough to counter violent or false speech. At the same time, many argue that the platforms are unfairly banning and restricting access to potentially valuable speech. Currently, federal law does not offer much recourse for social media users who seek to challenge a social media provider's decision about whether and how to present a user's content. Lawsuits predicated on these sites' decisions to host or remove content have been largely unsuccessful, facing at least two significant barriers under existing federal law. First, while individuals have sometimes alleged that these companies violated their free speech rights by discriminating against users' content, courts have held that the First Amendment, which provides protection against state action, is not implicated by the actions of these private companies. Second, courts have concluded that many non-constitutional claims are barred by Section 230 of the Communications Decency Act, 47 U.S.C. § 230, which provides immunity to providers of interactive computer services, including social media providers, both for certain decisions to host content created by others and for actions taken "voluntarily" and "in good faith" to restrict access to "objectionable" material. Some have argued that Congress should step in to regulate social media sites. Government action regulating internet content would constitute state action that may implicate the First Amendment. In particular, social media providers may argue that government regulations impermissibly infringe on the providers' own constitutional free speech rights. Legal commentators have argued that when social media platforms decide whether and how to post users' content, these publication decisions are themselves protected under the First Amendment. There are few court decisions evaluating whether a social media site, by virtue of publishing, organizing, or even editing protected speech, is itself exercising free speech rights. Consequently, commentators have largely analyzed the question of whether the First Amendment protects a social media site's publication decisions by analogy to other types of First Amendment cases. There are at least three possible frameworks for analyzing governmental restrictions on social media sites' ability to moderate user content. Which of these three frameworks applies will depend largely on the particular action being regulated. Under existing law, social media platforms may be more likely to receive First Amendment protection when they exercise more editorial discretion in presenting user-generated content, rather than if they neutrally transmit all such content. In addition, certain types of speech receive less protection under the First Amendment. Courts may be more likely to uphold regulations targeting certain disfavored categories of speech such as obscenity or speech inciting violence. Finally, if a law targets a social media site's conduct rather than speech, it may not trigger the protections of the First Amendment at all.

In Violence as Obscenity, Kevin W. Saunders boldly calls into question the assumption that violent material is protected by the First Amendment. Citing a recognized exception to the First Amendment that allows for the regulation of obscene material, he seeks to expand the definition of obscenity to include explicit and offensive depictions of violence. Saunders examines the public debate on media violence, the arguments of professional and public interest groups urging governmental action, and the media and the ACLU's desire for self-regulation. Citing research that links violence in the media to actual violence, Saunders argues that a present danger to public safety may be reduced by invoking the existing law on obscenity. Reviewing the justifications of that law, he finds that not only is the legal history relied on by the Supreme Court inadequate to distinguish violence from sex, but also many of the justifications apply more forcefully to instances of violence than to sexually explicit material that has been ruled obscene. Saunders also examines the actions that Congress, states, and municipalities have taken to regulate media violence as well as the legal limitations imposed on such regulations by the First Amendment protections given to speech and the press. In discussing the current operation of the obscenity exception and confronting the issue of censorship, he advocates adapting to the regulation of violent material the doctrine of variable obscenity, which applies a different standard for material aimed at youth, and the doctrine of indecency, which allows for federal regulation of broadcast material. TV violence has repeatedly been identified as a significant causal agent in relation to the prevalence of crime and violence in society. Critics have accused the medium of presenting excessive quantities of violence, to the point where it is virtually impossible for viewers to avoid it. This book presents the findings of the largest British study of violence on TV ever undertaken, funded by the broadcasting industry. The study was carried out at the same time as similar industry-sponsored research was being conducted in the United States, and one chapter compares findings from Britain and the U.S.A. The book concludes that it is misleading to accuse all broadcasters of presenting excessive quantities of violence in their schedules. This does not deny that problematic portrayals were found. But the most gory, horrific and graphic scenes of violence were generally contained within broadcasts available on a subscription basis or in programs shown at times when few children were expected to be watching. This factual analysis proves that broadcasters were meeting their obligations under their national regulatory codes of practice.

This leads to unpredictable escalations and violence can no longer be contained adequately by the relevant control regimes, such as police, state surveillance institutions, national repression apparatuses and international law. However, before investigating this hypothesis from an internationally and historically comparative perspective, the terms and "tools" for this undertaking have to be rendered more precisely. Since both "control" and "violence" are all but clear-cut terms but rather highly debatable and contested concepts that may take multiple connotations. The main question is whether an increase in certain forms of violence can be explained by the failure or, in turn, "overeffectiveness" of certain control mechanisms. It is asked, for instance, which contribution religion can make to limit violence and, in turn, which destructive potential religion might have in its fundamentalist form. Moreover, the concept of individual self-control as well as social institutions and strategies of collective disengagement and de-radicalization are investigated with regard to their potential for controlling violence. The Control of Violence in Modern Society concludes with a re-examination of the hypothesis of a loss of control by specifying in what cases and under which circumstances we can speak of a loss of control over violence.
