This book was released on 2017-10-17 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Review of American Colonial Legislation by the King in Council The power exercised by the English Privy Council, of annulling the enactments of the royal colonies, afforded the home government an important instrument of administra tive control. It constituted a necessary check upon the only branch of the colonial governments which was responsive to popular sentiment, and gave the English executive a final word in regard to the minutest details of local administra tion in the dominions. Its importance both to the mother country and to the colonies, together with the fact that no detailed study of its operation has heretofore appeared, constitute the justification for this work. Book To Save the People from Themselves

Download or read book To Save the People from Themselves written by Robert J. Steinfeld and published by Cambridge University Press. This book was released on 2021-09-30 with total page 451 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this expansive history, Robert J. Steinfeld offers a thorough re-interpretation of the origins of American judicial review and the central role it quickly came to play in the American constitutional system. Beginning with Privy Council review of American colonial legislation, the book goes on to provide detailed descriptions of the character of the first American constitutions, showing that they drew heavily on traditional Anglo/American constitutional assumptions, which treated legislatures as the primary interpreters of constitutions. Steinfeld then expertly analyses the central role lawyers and judges played in transforming these assumptions, creating the practice and doctrine of American judicial review in a half dozen state cases during the 1780s. The book concludes by showing that the ideas formulated during those years shaped critical decisions taken by the Constitutional Convention of 1787, which turned the novel practice into a permanent, if still deeply controversial, feature of the American constitutional system.

Download or read book The History and Growth of Judicial Review Volume 1 written by Steven G. Calabresi and published by Oxford University Press. This book was released on 2021 with total page 457 pages. Available in PDF, EPUB and Kindle. Book excerpt: "This book examines the origins and growth of judicial review in the key G-20 constitutional democracies, which include: the United States; the United Kingdom; France; Germany; Japan; Italy; India; Canada; Australia; South Korea; Brazil; South Africa; Indonesia; Mexico; and the European Union. The book considers five different theories, which help to explain the origins of judicial review, and it identifies which theories apply best in the various countries discussed. It considers not on what gives rise to judicial review originally, but also what causes of judicial review lead it to become more powerful and prominent over times. The positive account of what causes the origins and growth of judicial review in so many very different countries over such a long period of time has normative implications"--

Book Corwin on the Constitution

Download or read book Corwin on the Constitution written by Edward S. Corwin and published by Cornell University Press. This book was released on 2019-06-30 with total page 408 pages. Available in PDF, EPUB and Kindle. Book excerpt: Edward S. Corwin (1878–1963), universally acknowledged to be the most important commentator on the U.S. Constitution in the twentieth century, died before he could write the single definitive work he had planned. Richard Loss has devoted himself to the task of editing a three-volume collection (of which this is the second) of Corwin's major essays on the Constitution. The seventeen essays in Volume II focus on Article III (the judicial article) of the Constitution. They were, in Corwin's judgment, among his most important works. Thus this volume is a sequel both to Volume I, which treated Articles I and II of the Constitution, and to Presidential Power and the Constitution, in which Loss gathered most of Corwin's essays on the presidency. The editor has organized the essays under the headings "The Origins of Judicial Review," "The Development of Judicial Supremacy," "The Exercise of Judicial Review," and "Appraisals of Judicial Review." Each essay is reprinted in its entirety, including footnotes.

Book excerpt: Presents 80 documents selected to reflect Eric Voegelin's theory that in Western civilization basic political symbolizations tend to be variants of the original symbolization of Judeo-Christian religious tradition. These documents demonstrate the continuity of symbols preceding the writing of the Constitution and all contain a number of basic symbols such as: a constitution as higher law, popular sovereignty, legislative supremacy, the deliberative process, and a virtuous people.
