Book excerpt: Adopting a microhistory approach, Fair and Unfair Trials in the British Isles, 1800-1940 provides an in-depth examination of the evolution of the modern justice system. Drawing upon criminal cases and trials from England, Scotland, and Ireland, the book examines the errors, procedural systems, and the ways in which adverse influences of social and cultural forces impacted upon individual instances of justice. The book investigates several case studies of both justice and injustice which prompted the development of forensic toxicology, the implementation of state propaganda and an increased interest in press sensationalism. One such case study considers the trial of William Sheen, who was prosecuted and later acquitted of the murder of his infant child at the Old Baily in 1827, an extraordinary miscarriage of justice that prompted outrage amongst the general public. Other case studies include trials for treason, theft, obscenity and blasphemy. Nash and Kilday root each of these cases within their relevant historical, cultural, and political contexts, highlighting changing attitudes to popular culture, public criticism, protest and activism as significant factors in the transformation of the criminal trial and the British judicial system as a whole. As the 1800s have been relatively neglected in previous research, and as the study is based on a new cross-genre corpus focusing on this period (CONCE = A Corpus of Nineteenth-Century English), the volume adds significantly to our knowledge of the historical development of the progressive. The use of two separate measures enables an accurate account of the frequency development of the progressive, which is also related to multi-feature/multi-dimensional analyses. Other topics covered include the complexity of progressive verb phrases and the distribution of the construction across linguistic parameters such as clause type. Special attention is paid to progressives that express something beyond purely aspectual meaning. The results show that the progressive became more fully integrated into English grammar over the 19th century, but also that linguistic and extralinguistic parameters affected this integration process; for instance, the construction was more common in women’s than in men’s private letters. Owing to the wide methodological scope of the study, it is of interest to linguists specializing in corpus linguistics, language variation and change, verbal syntax, the progressive, or the linguistic expression of aspect, either in synchrony or diachrony.

Increasingly, professional acts of interpretation were seen as necessary to achieve a just verdict, thereby silencing the prisoner and affecting the testimony given by eye witnesses at criminal trials. Jan-Melissa Schramm examines the profound impact of the changing nature of evidence in law and theology on literary narrative in the nineteenth century. Already a locus of theological conflict, the idea of testimony became a fiercely contested motif of Victorian debate about the ethics of literary and legal representation. She argues that authors of fiction created a style of literary advocacy which both imitated, and reacted against, the example of their storytelling counterparts at the Bar.

Nonetheless, statutes creating criminal offences regularly depart from the presumption of innocence by requiring defendants to prove specific matters in order to avoid conviction. Legislatures and courts seek to justify this departure by asserting that the reversal of the burden of proof is necessary to meet the community interest in prosecuting serious crime and maintaining workable criminal sanctions. This book investigates the supposed justifications for limitation of the presumption of innocence. It does so through a comprehensive analysis of the history, rationale and scope of the presumption of innocence. It is argued that the values underlying the presumption of innocence are of such fundamental importance to individual liberty that they cannot be sacrificed on the altar of community interest. In particular, it is argued that a test of 'proportionality', which seeks to weigh individual rights against the community interest, is inappropriate in the context of the presumption of innocence and that courts ought instead to focus on whether an impugned measure threatens the values which the presumption is designed to protect. The book undertakes a complete and systematic review of the United Kingdom and Strasbourg authority on the presumption of innocence. It also draws upon extensive references to comparative material, both judicial and academic, from the United States, Canada and South Africa.
