In his book "Progress in International Organization," Hudson sought to demonstrate that what he perceived as an emerging international infrastructure, and as moves toward the rule of law in international affairs, were sure signs of human progress towards peace and cooperation. "Progress in International Law" critically engages with that claim as a normative matter and, at the same time, presents the evidence by which a judgment about our own progress towards peace and cooperation might be judged.

Book excerpt: Historic preservation, whether of landscapes or buildings, was an important development of the nineteenth century in many countries. There is however surprisingly little understanding about how it took place, and research into it is narrowly focused. For example, generally landscape preservation from this time is examined separately from buildings; preservation is seen in terms of national narratives, or considered within the contexts of area studies, and it is usually seen from a specific disciplinary perspective. All of these later categorizations did not apply at the time and consequently, a very partial view is achieved. In order to begin unlocking a very complex phenomenon that has helped to define our own age, this dynamic collection of essays brings together an international and transdisciplinary line-up of academics and practitioners to reconsider preservation's origins in the second half of the nineteenth and early part of the twentieth century. With a focus on Britain and the British Empire, and including case studies from the United States, Canada, Sweden, France, Germany, Sri Lanka, 'The Holy Land', and Turkey, this book places preservation in imperial, international, and national contexts, demonstrating that there was far more interaction between different countries in this arena than may be supposed and revealing remarkable but hitherto hidden overlaps and intersections. It examines three main themes: the influence of religion; the political and sub-diplomatic aspects of preservation; and the professionalization of preservation practice. Internationalizing trends already existed through the churches, the universities, and the diplomatic services, as well as familial ties that had an important impact on preservation's epistemic communities and its targets. Other internationalizing factors include an interest in national histories and the histories of architecture and art, particularly when known through illustration; a growing interest in biography especially of 'founding fathers' or famous literary figures; and tourism. Although the focus is on architectural preservation, this book demonstrates that, in this formative period, the preservation of buildings and landscapes needs to be considered together - as it often was at the time - and in context. The conclusion reached is that the preservation movement has to be understood in imperial and international contexts, rather than in simply national or regional ones.

Book excerpt: Excerpt from The Progress of International Law and Arbitration: An Inaugural Lecture Delivered Before the University of Oxford in the Hall of All Souls College on October 21, 1911 The Chair of International Law and Diplomacy, from which I have the honour to address you for the first time to-day, takes its name from Archbishop Chichele, the founder of this College, from whose benefactions it has been endowed. Chichele was himself both a lawyer and a diplomatist. In his earlier days he practised as an advocate; and later, when he had risen to high position, he was called on to take a leading part in the foreign affairs of his country. He was more than once appointed Commissioner to negotiate a Treaty of peace; he was accredited Ambassador to France; he was sent on a special mission to Gregory XII and was the British representative at the Council of Pisa in 1409. In his time there was but little usage to regulate the intercourse or the hostilities of Nations, but one cannot doubt that had he lived in a later age, he would have taken the most active interest in the development of International Law, and that the purpose to which his benefactions have been put in the establishment of this Chair is one which would have elicited his warmest approval. The first holder was Mountague Bernard, appointed in 1859. He was equipped for the discharge of his duties by an exceptional learning not only in law but also in the history of diplomacy, of which his published lectures remain a standing proof. The collective security system of the Charter of the United Nations has shown its weaknesses and law has been unable to disarm force. Conversely, however, force cannot prevent this unprecedented extension of law, to the extent that no State can lastingly override it. In spite of appearances, it is no longer possible today to ignore the superposition of regional, national and global standards, nor the over-abundance of both national and international institutions and judges, with expanded jurisdiction. The new realities are causing law to evolve into complex and highly unstable interactive systems that are perhaps more symptomatic of profound change than of the defeat of law: we are faced with a change in the very conception of the legal order.
