Book excerpt: Excerpt from The Principles of the Law of Torts My purpose in noticing these defects, as they seem to me, in arrangement and description, is not to disparage works of great practical value and utility, and with which I am sensible that my own is not likely to be able to compete, but merely to excuse and account for the publication of my own work upon different lines of arrangement designed to bring out, if possible, more clearly and accurately the principles upon which the cases are decided. It will be seen that, in my View, the mental attitude, the instrumentality, the act, and the result ought to be treated of in orderly connection; a view which I have endeavoured to carry out in this work. Book Leading Cases Upon the Law of Torts Classic Reprint

Download or read book Leading Cases Upon the Law of Torts Classic Reprint written by George Chase and published by Forgotten Books. This book was released on 2018-02-04 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Leading Cases Upon the Law of Torts A word 'of caution may be addressed to law students in regard to the study of cases. A student should remember carefully that judicial decisions, though they may be leading cases and the most valuable that can be found, may nevertheless contain dicta, and that he must discriminate between dicta and the points actually decided. Moreover, statements of general principles, as set forth in the decisions, are sometimes made too broadly, because the judge has his mind concentrated upon the questions involved in the particular case he has to decide, and does not think of the possible limitations which the doctrine may need to adapt it to analogous cases of varied character. Still, these sources of error are less likely to be found in a col lection of leading cases. Containing the opinions of judges of eminence than in other instances. And, besides, the authors of the best text-books, in preparing their trea tises examine and compare the numerous and varied cases that bear upon the same points, and thus are able to set forth the principles of law in their true and accurate form, properly limited and classified. This is, again, another important reason for studying the text-books and illustrative cases together. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Principles of the Law of Damages Classic Reprint

Download or read book Principles of the Law of Damages Classic Reprint written by Hugh Evander Willis and published by Forgotten Books. This book was released on 2017-10-16 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of the Law of Damages The general purpose of this new book on the law of Damages is like the purpose of the book on the law of Contracts by the same author, to give a complete treatise on the subject in a small volume. All the fundamental principles of the law of Damages are summarized in rules, or propositions of'law. Explanations are given for these propositions of law, with reasons therefor, together with criticisms thereof, whenever in the judgment of the author the rules are the subject of criticism. In order to further elucidate the propositions, copious illustrations are given, showing the application of the same. Under such a plan it is hoped that anyone reading the book will obtain a thorough understanding of the law of Damages. For the convenience of the reader the propositions of law, explanations and illustrations, are printed in different type. The illustrations used are founded upon the cases selected by Professor Beale and by Professor Mechem for their case books on Damages and upon such other cases as the author has deemed it expedient to incorporate in the vdume. Book The Foundations of Legal Liability Vol 1

Download or read book The Foundations of Legal Liability Vol 1 written by Thomas Atkins Street and published by Forgotten Books. This book was released on 2016-09-14 with total page 536 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Foundations of Legal Liability, Vol. 1: A Presentation of the Theory and Development of the Common Law; Theory and Principles of Tort The present volume contains a new synthesis of the fundamental principles of tort along scientific and historical lines. The aim has been to discover and indicate the true path of legal evolution in this complicated field. As might be expected from the adoption of new methods of inquiry, and from the opening of new lines of thought, we have turned up many new ideas and have been able to present the old truths in new and more enlightening aspects. The discovery and establishment of what we have called the 'secondary trespass formation' represent, we make bold to believe, a considerable advance in legal knowledge. It gives insight into the nature of a class of torts which have hitherto proved somewhat intractable, and enables us to assign the conception of negligence to its proper place in legal theory. The reader will find that this subject of negligence has been much stirred. We have pointed out its complexity and have shown the reason for the difficulties which are here encountered. Above all, we have illustrated this branch of the law with a copiousness of concrete cases not attempted in connection with any other subject. For the convenience of those who may desire to discriminate we have had the illustrative matter printed in a smaller type than that which is used for the ordinary text. Download or read book Cases Illustrating the Principles of the Law of Torts written by Francis Reynolds Yonge Radcliffe and published by Forgotten Books. This book was released on 2015-06-16 with total page 655 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases Illustrating the Principles of the Law of Torts This book is an attempt to illustrate the principles underlying the main branches of the Law of Torts by a selection from the original authorities. With this object in view the headnotes of all the cases have been rewritten so as to state the principle established by each case rather than, the application of that principle to a particular set of facts. The notes are mainly explanatory or supplemental; but in two or three cases, as in the note to Asher v. WTiitloch; they are an attempt to present an accurate statement of the existing law on certain difficult points. Owing to the exigencies of space it has been necessary to omit portions of the cases as originally reported. This has been done for the most part by omitting or reducing long statements of facts, arguments of counsel where not necessary to explain the judgements, and concurring judgements where they did not seem to add anything to that reported. Where a judgement has dealt with more than one subject those portions which are not relevant to the principle under discussion have been omitted. Excisions from a judgement have been indicated by dots. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Torts HE author's aim has changed somewhat since the first edition of this work was published. The book was originally written for the beginner; it is now intended as well for the advanced student, whether in the Law School or at the Bar. Hence (1) the substitution of the more complete statement of General Doctrine at the beginning for the slight Introduction of the first edition, (2) an extension of the text generally, and (3) a larger working equipment of notes. Some rearrangement too of chapters, or parts of chapters, has been found necessary either by recent decisions or by further experience in teaching. This is particularly true of the chapters dealing with interferences with Contract, and the long chapter on Negligence. It is proper to repeat what was said in the Preface to the first edition, that The end in View is sought by presenting and considering three or four fundamental duties, in which are found the elements of the law of Torts. These are (1) the duty to refrain from fraud and malice, (2) certain absolute duties - duties, that is to say, independent of any real or nominal attitude of mind, and (3) the duty to refrain from negligence.'
