Sovereignty, International Law, and the Princely States of Colonial South Asia provides a compelling exploration of the history of sovereignty through an analysis of the jurisdictional politics involving a specific set of historical legal entities. Governed by local rulers, the princely states of colonial South Asia were subject to British paramountcy whilst remaining legally distinct from directly ruled British India. Their legal status and the extent of their rights remained the subject of feverish debates through the entirety of British colonial rule. This book traces the ways in which the language of sovereignty shaped the discourse surrounding the legal status of the princely states to illustrate how the doctrine of sovereignty came to structure political imagination in colonial South Asia and the framework of the modern Indian state. Opening with a survey of the place of the princely states in the colonial structures of South Asia, Sovereignty, International Law, and the Princely States of Colonial South Asia goes on to illustrate how international lawyers, British politicians, colonial officials, rulers and bureaucrats of princely states, and anti-colonial nationalists in British India used definitions of sovereignty to construct political orders in line with their interests and aspirations. By invoking the vernacular of sovereignty in contrasting ways to support their differing visions of imperial and world order, these actors also attempted to reconfigure the boundaries among the spheres of the national, the imperial, and the international. Throughout the eighteenth, nineteenth, and early twentieth centuries, debates and disputes over the princely states continually defined and redefined the concept of sovereignty and international legitimacy in South Asia. Using rich material from the colonial archives,Sovereignty, International Law, and the Princely States of Colonial South Asia conveys an understanding of the history of sovereignty and the construction of the modern Indian nation-state that is still relevant today. Yet those who have lived through this period are frequently very much at loss to recall the exact sequence of events and the manner in which Dominion autonomy has proceeded step by step to its present position. This book is an attempt to give the general reader a concise account of what Dominion status means, and how it has grown out of the political experience of the immediate past. To accomplish this, the book is arranged in two parts: first, a narrative of the development of Dominion status since 1900; and second, a very generous selection from the essential contemporary documents by means of which the reader may, if he so desires, study this development first-hand. Book excerpt: The second volume explains how the League of Nations mandates system fused two of the predominant and compelling global forces of the twentieth century: imperialism and Wilsonian internationalism. After the First World War, Britain and France administered most of Germany's former tropical African colonies as "mandates" under the supervision of the League as "a sacred trust of civilization." This system of international trusteeship changed British and French rule in Africa. In short, "mandates" were not "colonies." Mandates meant less militarism, more commercial equality, a greater emphasis on the interests of Africans, and an end to the extension of European national sovereignty over colonized peoples. Accountability to the League also required the British and French to reconsider traditional economic, strategic, and ideological assumptions about their empires. In the process, the "sacred trust" sowed the seeds of self-doubt about the very purpose and future of European imperialism. The mandates system continued to represent a genuine internationalisation and reformation of colonialism and had long-term economic, political, and cultural consequences for Africans and Europeans within the mandated territories. Despite the Depression, repeated Anglo-French foreign policy failures, growing humiliations for Geneva, and war in Africa and Europe, the principles and practices of international trusteeship proved persistent. Mandates demonstrated the relevance of international law, the importance of the League of Nations, and the impact of Wilsonian principles on international relations and European imperialism.

Book excerpt: Statehood in the early 21st century remains as much a central problem as it was in 1979 when the first edition of The Creation of States in International Law was published. As Rhodesia, Namibia, the South African Homelands and Taiwan then were subjects of acute concern, today governments, international organizations, and other institutions are seized of such matters as the membership of Cyprus in the European Union, application of the Geneva Conventions to Afghanistan, a final settlement for Kosovo, and, still, relations between China and Taiwan. All of these, and many other disputed situations, are inseparable from the nature of statehood and its application in practice. The remarkable increase in the number of States in the 20th century did not abate in the twenty five years following publication of James Crawford's landmark study, which was awarded the American Society of International Law Prize for Creative Scholarship in 1981. The independence of many small territories comprising the 'residue' of the European colonial empires alone accounts for a major increase in States since 1979; while the disintegration of Yugoslavia and the USSR in the early 1990s further augmented the ranks. With these developments, the practice of States and international organizations has developed by substantial measure in respect of self-determination, secession, succession, recognition, de-colonization, and several other fields. Addressing such questions as the unification of Germany, the status of Israel and Palestine, and the continuing pressure from non-State groups to attain statehood, even, in cases like Chechnya or Tibet, against the presumptive rights of existing States, James Crawford discusses the relation between statehood and recognition; the criteria for statehood, especially in view of evolving standards of democracy and human rights; and the application of such criteria in international organizations and between states. Also discussed are the mechanisms by which states have been created, including devolution and secession, international disposition by major powers or international organizations and the institutions established for Mandated, Trust, and Non-Self-Governing Territories. Combining a general argument as to the normative significance of statehood with analysis of numerous specific cases, this fully revised and expanded second edition gives a comprehensive account of the developments which have led to the birth of so many new states.
