Today, the federal government possesses unparalleled authority over the atmosphere of the United States. Yet when the Wright Brothers inaugurated the air age on December 17, 1903, the sky was an unregulated frontier. As increasing numbers of aircraft threatened public safety in subsequent decades and World War I accentuated national security concerns about aviation, the need for government intervention became increasingly apparent. But where did authority over the airplane reside within America's federalist system? And what should US policy look like for a device that could readily travel over physical barriers and political borders? In Sovereign Skies, Sean Seyer provides a radically new understanding of the origins of American aviation policy in the first decades of the twentieth century. Drawing on the concept of mental models from cognitive science, regime theory from political science, and extensive archival sources, Seyer situates the development, spread, and institutionalization of a distinct American regulatory idea within its proper international context. He illustrates how a relatively small group of bureaucrats, military officers, industry leaders, and engineers drew upon previous regulatory schemes and international principles in their struggle to define government's relationship to the airplane. In so doing, he challenges the current domestic-centered narrative within the literature and delineates the central role of the airplane in the reinterpretation of federal power under the commerce clause. By placing the origins of aviation policy within a broader transnational context, Sovereign Skies highlights the influence of global regimes on US policy and demonstrates the need for continued engagement in world affairs. Filling a major gap in the historiography of aviation, it will be of interest to readers of aviation, diplomatic, and legal history, as well as regulatory policy and American political development.

Beginning just after the First World War, its entrepreneur, Clayton J. Brukner, developed a network of relationships within the aviation industry. This allowed his company to develop significant competitive advantages in the private flying market. Those advantages and the popular appeal of aviation helped Waco to become the largest manufacturer of civilian aircraft by 1929. The transformation of business-government relations during the New Deal demanded changes in Brukner's business strategy. The depression significantly cut sales of its popular biplanes, but Waco kept its Troy, Ohio, factory open and earned some profits during the downturn. Brukner's involvement with the trade associations in the 1930s revealed the critical role the government, the military in particular, played in the development of aviation. His flawed leadership in the changing context led to decisions that degraded the quality of its network signals and diminished Waco's effectiveness in crafting appropriate policies. As the international situation grew increasingly tense throughout the 1930s, Waco, like other manufacturers, turned to exports to enhance sales. Contracts with foreign governments partially offset the setback the depression had caused domestically. They did not, however, drive Brukner to evaluate sufficiently Waco's potential participation in the U.S. military market. Only after the Munich Crisis in September 1938, when President Franklin D. Roosevelt decided to call for increased military spending, did the Waco Aircraft Company position itself to receive defense contracts. It was almost three years, however, before the Army Air Forces directed the company to design and manufacture transport aircraft and cargo gliders. In the meantime Brukner had not developed the organizational capabilities needed to manage military contracts.

Book excerpt: Historians have traditionally emphasized the sharp differences between Herbert Hoover's vision of an associational state and the activism of Franklin D. Roosevelt's New Deal. This dissertation highlights an important area of continuity between the economic policies espoused by Hoover--during his tenures as Secretary of Commerce and President--and Roosevelt, focusing on federal efforts to promote the nascent aviation industry from the end of World War I until the passage of the Civil Aeronautics Act in 1938. These efforts were successful, and offer a unique arena in which to document the concrete gains wrought by Hoover's associationalist ideology and Roosevelt's New Deal. Moreover, both Hoover's corporatist policies and New Deal efforts to create aviation infrastructure--largely through the auspices of public works agencies like the Public Works Administration and Works Progress Administration--form a striking example of the government's ability to successfully foster the development of a new industry, even in the midst of the Great Depression. Significantly, both men's efforts represented an alternative to nationalization, the path taken by virtually every European nation during the era. This period thus offers the opportunity to examine how both presidents' aviation policies cohere with their larger visions of government's proper relationship to the economy, to compare and contrast associationalism and New Deal, and to elucidate aviation's role in promoting American economic development. During these years government actions expanded from having literally no engagement with commercial aviation to subsidizing airmail routes, creating a regulatory infrastructure to promote safe operations by licensing pilots, inspecting aircraft, approving manufacturing operations, and aggressively promoting flying to the American people.
