It takes into account the impact of institutional arrangements such as the electoral law and the candidate selection process, the ideological and programmatic profiles of political parties, the career paths of MEPs, affiliation to political groups in the EP, group switching, as well as the significance of Euroscepticism and national divisions transferred to the European level. It is not a typical case study, as the regularities discovered through the in-depth analysis of the Polish national delegation are compared with those characteristic of other national delegations in the EP. The book fills a gap in studies devoted to the EP, in which the importance of national delegations has not so far been the subject of thorough analyses.

First, European decision-makers (both in Brussels and across EU capitals) should take a broader view of their existential interests at stake and devote greater time and resources to serving them within the wider cause of the liberal order. Second, Europe needs to help reinvigorate the West by restoring a sense of solidarity through fairer distribution of benefits and burdens. Third, it should develop separate strategies for parts of the world, such as Russia and China, where liberal values are not likely to be attainable in the foreseeable future yet order is still necessary. Fourth, Europe needs to clarify its core interests elsewhere and help stabilize the Middle East and Africa. With this book, the author seeks to lay the essential building blocks for developing a European strategy, which is a complex process involving multiple decision-makers and institutions.

Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. Book excerpt: Why Noncompliance traces the history of noncompliance within the European Union (EU), focusing on which states continuously do or do not follow EU Law, why, and how that affects the governance in the EU and beyond. In exploring the EU's long and varied history of noncompliance, Tanja A. Börzel takes a close look at the diverse groups of noncompliant states throughout the EU's existence. Why do states that are vocally critical of the EU have a better record of compliance than those that support the EU? Why has noncompliance been declining since the 1990s, even though the EU was adding member-states and numerous laws? Börzel debunks conventional wisdoms in EU compliance research, showing that noncompliance in the EU is not caused by the new Central and Eastern European member states, nor by the Eurosceptic member states. So why do these states take the brunt of Europe's misplaced ire? Why Noncompliance introduces politicization as an explanatory factor that has been long overlooked in the literature and scholarship surrounding the European Union. Börzel argues that political controversy combined with voting power and administrative capacity, explains why noncompliance with EU law has been declining since the completion of the Single Market, cannot be blamed on the EU's Central and Easter European member states, and is concentrated in areas where EU seeks to protect citizen rights.
