Book A History of Regulating Working Families

Download or read book A History of Regulating Working Families written by Nicole Busby and published by Bloomsbury Publishing. This book was released on 2020-08-06 with total page 244 pages. Available in PDF, EPUB and Kindle. Book excerpt: Families in market economies have long been confronted by the demands of participating in paid work and providing care. Across Europe the social, economic and political environment within which families do so has been subject to substantial change in the post-World War II era and governments have come under increasing pressure to engage with this important area of public policy. In the UK, as elsewhere, the tensions which lie at the heart of the paid work/unpaid care conflict remain unresolved posing substantial difficulties for all of law's subjects both as carers and as the recipients of care. What seems like a relatively simple goal – to enable families to better balance care-giving and paid employment – has been subject to and shaped by shifting priorities over time leading to a variety of often conflicting policy approaches. This book critiques how working families in the UK have been subject to regulation. It has two aims: · To chart the development of the UK's law and policy framework by focusing on the post-war era and the growth and decline of the welfare state, considering a longer historical trajectory where appropriate. · To suggest an alternative policy approach based on Martha Fineman's vulnerability theory in which the vulnerable subject replaces the liberal subject as the focus of legal intervention. This reorientation enables a more inclusive and cohesive policy approach and has great potential to contribute to the reconciliation of the unresolved conflict between paid work and care-giving.

Book excerpt: Following the proclamation of the European Pillar of Social Rights on 17 November 2017, the European Commission adopted a proposal for a Directive to support work-life balance for working parents and carers, which strengthens and expands family-related leave measures as well as acknowledges the value of unpaid work that carers, predominantly women, shoulder in caring for dependents. The proposed Directive builds on existing EU legal provisions in the field of work-family reconciliation, and in particular the Pregnant Workers Directive 92/85/EEC, the Gender Equality Directive (Recast Directive) 2006/54/EC, the Self-Employed Directive 2010/41/EU and the Parental Leave Directive 2010/18/EU, as well as Treaty provisions such as Articles 2 and 3(3) TEU, Articles 153(1)(i), 153(2)(b) and 157 TFEU and the EU Charter of Fundamental Rights. The measures envisaged extend existing rights and introduce new forms of protection. They include a right to take at least four months of non-transferable paid leave for parents of children (up to a certain age, at least twelve), compensated at least at sick-pay level. The proposed Directive creates an individual right to paid paternity leave of at least 10 days. It also establishes the right to request flexible working arrangements for parents with children up to a given age (at least twelve). In addition, the proposed Directive introduces, for the first time, a right to at least five days of carers' leave per year for dependent or seriously ill relatives. It also includes the right to take time off work in case of force majeure for all workers (not only parents or care-givers) for urgent family reasons, as currently provided in the Parental Leave Directive. Under the proposed Directive the dismissal, discrimination or unfavourable treatment of workers on the ground that they have applied for, or have taken, leave guaranteed by the Directive, or on the ground that they have exercised the rights to request flexible working arrangements is to be prohibited. Against this background, this thematic report considers enforcement issues in relation to discrimination, unfavourable treatment and dismissal in the context of the various types of family-related leave, including pregnancy/maternity leave, parental/adoption leave and paternity leave, as well as carers' leave and other family-related leave. It also considers issues of compensation, reparation and sanctions, as well as the role of national equality bodies. The objective is to obtain an overview of enforcement in practice of relevant existing EU law. The study covers the 28 Member States and three EEA countries: Iceland, Liechtenstein and Norway. It is based on answers provided by the national experts of the European network of legal experts in gender equality to a questionnaire (attached in Annex 1 of the report) assessing the situation in these countries. The information provided in this report is valid as at 29 August 2018.

This book presents the first encompassing and in-depth empirical study of the effects of 'voluntaristic' and (partly) 'soft' EU policies in all 15 member states. The authors examine 90 case studies across a range of EU Directives and shed light on burning contemporary issues in political science, integration theory, and social policy. They reveal that there are major implementation failures and that, to date, the European Commission has not been able adequately to perform its control function.

Book The Palgrave Handbook of Family Policy

Available in PDF, EPUB and Kindle. Book excerpt: "This engaging collection gathers theoretical and empirical insights from leading family policy experts. The authors - representing diverse countries, disciplines, and methods - bring to life the volume's innovative conceptual framework, which is organized around policy institutions, both public and private. The volume closes with a call for new lines of research that should inform family policy scholars for years to come."--Janet Gornick, Professor of Political Science and Sociology, and Director of the Stone Center on Socio-Economic Inequality, The Graduate Center, City University of New York, USA "Featuring exciting contributors from a range of often-siloed scholarly disciplines, countries and cultures, this Handbook offers nuanced insights into how interacting societal inequality factors influence family policy enactment to reinforce or improve inequality outcomes across gender, class, and nations. It is ambitious, broad-reaching, and succeeds in providing a strategic view within and across nations to inspire thoughtful evidence-based policy implications to improve societies in the future."--Ellen Ernst Kossek, Basil S. Turner Professor of Management, Purdue University, USA This open access handbook provides a multilevel view on family policies, combining insights on family policy outcomes at different levels of policymaking: supra-national organizations, national states, sub-national or regional levels, and finally smaller organizations and employers. At each of these levels, a multidisciplinary group of expert scholars assess policies and their implementation, such as child income support, childcare services, parental leave, and leave to provide care to frail and elderly family members. The chapters evaluate their impact in improving children's development and equal opportunities, promoting gender equality, regulating fertility, productivity and economic inequality, and take an intersectional perspective related to gender, class, and family diversity. The editors conclude by presenting a new research agenda based on five major challenges pertaining to the levels of policy implementation (in particular globalization and decentralization), austerity and marketization, inequality, changing family relations, and welfare states adapting to women's empowered roles

Book Family reunification for refugee and migrant children

Download or read book Family reunification for refugee and migrant children written by Florence Boreil and published by Council of Europe. This book was released on with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: A practical guide to assist legislators and legal practitioners in facilitating the reunification of refugee and migrant children with their families As a result of the sharp increase in the refugee and migrant population in recent years, many children and their families have experienced family separation. Member states are bound by various obligations related to family reunification, and the practical reunification of refugee and migrant children with their family members has proved complex. This handbook is a practical guide both to key legal standards and to promising practices in the field of family reunification and restoring family links. This publication is conceived as a point of reference for capacity-building material, technical assistance, co-operation projects and new practices for and with relevant authorities and institutions. It focuses on the reunification of families with children in the context of international migration, and in particular on reunification possibilities for unaccompanied and separated refugee and migrant children. It presents an overview of legal principles of human rights, children’s rights, refugee law and EU law relevant to family reunification and then discusses key features of family reunification procedures, with promising examples of law and practice and relevant applicable standards. The handbook contributes to achieving the objectives of the Action Plan on Protecting Refugee and Migrant Children in Europe (2017-2019).

Second, the volume provides a more analytical reading, embedding the key developments of the year 2014 in the most recent academic discourses. Third, the forward-looking perspective of the book aims to provide stakeholders and policymakers with specific tools that allow them to discern new opportunities to influence policymaking. In this 2015 edition of Social policy in the European Union: state of play, the authors tackle the topics of the state of EU politics after the parliamentary elections, the socialisation of the European Semester, methods of political protest, the Juncker investment plan, the EU’s contradictory education investment, the EU’s contested influence on national healthcare reforms, and the neoliberal Trojan Horse of the Transatlantic Trade and Investment Partnership (TTIP).

Book Collective Agreements

Download or read book Collective Agreements written by Susan Hayter and published by . This book was released on 2018 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Collective bargaining involves a process of negotiation between one or more unions and an employer or employers' organisation(s). The outcome is a collective agreement that defines terms of employment - typically wages, working hours and in-work benefits. The agreement affords labour protection: minimum wages, regular earnings; limits on working hours and predictable work schedules; safe working environments; parental leave and sick leave; and a fair share in the benefits of increased productivity. The International Labour Organization (ILO) Collective Agreements Recommendation 1951 (No. 91) considers, where appropriate and having regard to national practice, that measures should be taken to extend the application of all or some provisions of a collective agreement to all employers and workers included wthin the domain of the agreement. The extension of a collective agreement generalises the terms and conditions of employment, agreed between organised firms and workers, represented through their association(s) and union(s), to the non-organised firms within a sector, occupation or territory. The collection of chapters in this volume are about the extension of collective agreements as an act of public policy.

Book Care Work and Care Jobs for the Future of Decent Work

Download or read book Care Work and Care Jobs for the Future of Decent Work written by Laura Addati and published by . This book was released on 2018 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The report analyses the ways in which unpaid care work is recognised and organised, the extent and quality of care jobs and their impact on the well-being of individuals and society. A key focus of this report is the persistent gender inequalities in households and the labour market, which are inextricably linked with care work. These gender inequalities must be overcome to make care work decent and to ensure a future of decent work for both women and men. The report contains a wealth of original data drawn from over 90 countries and details transformative policy measures in five main areas: care, macroeconomics, labour, social protection and migration. It also presents projections on the potential for decent care job creation offered by remedying current care work deficits and meeting the related targets of the Sustainable Development Goals.
