Book excerpt: By the end of British rule in Palestine on 14 May 1948, Palestinian nationality had become well established in accordance with both domestic law and international law. Accordingly, the legal origin of Palestinian nationality lies in this nearly thirty-year period as the status of Palestinians has never been settled since. Hence, any legal consideration on the future status of individuals who once held Palestinian nationality should start from the point at which the British rule over Palestine was terminated. This work provides a legal basis for future settlement of the status of Palestinians of all categories that emerged in some sixty years following the end of the Palestine Mandate: Israeli citizens, inhabitants of the occupied territory, and Palestinian refugees. In conclusion, nationality as regulated by Britain in Palestine represents an international status that cannot be legally altered except in accordance with international law.

Book excerpt: Challenging the claim that Palestine's peasant economy progressed during the 1920s and 1930s, Amos Nadan skillfully integrates a wide variety of sources to demonstrate that the period was actually one of deterioration on both the macro (per capita) and micro levels. The economy would have most likely continued its downward spiral during the 1940s had it not been for the temporary prosperity that resulted from World War II. Nadan argues that this deterioration continued despite the British authorities' channeling of funds from the Jewish sector and the wealthier Arab sectors into projects for the Arab rural economy. The British were hoping that Palestine's peasants would not rebel if their economic conditions improved. These programs were, on the whole, defective because the British chose programs based on an assumption that the peasants were too ignorant to manage their farms wisely, instead of working with the peasants and their own institutions.

Book excerpt: In this complete military history of Britain's pacification of the Arab revolt in Palestine, Matthew Hughes shows how the British Army was so devastatingly effective against colonial rebellion. The Army had a long tradition of pacification to draw upon to support operations, underpinned by the creation of an emergency colonial state in Palestine. After conquering Palestine in 1917, the British established a civil Government that ruled by proclamation and, without any local legislature, the colonial authorities codified in law norms of collective punishment that the Army used in 1936. The Army used 'lawfare', emergency legislation enabled by the colonial state, to grind out the rebellion. Soldiers with support from the RAF launched kinetic operations to search and destroy rebel bands, alongside which the villagers on whom the rebels depended were subjected to curfews, fines, detention, punitive searches, demolitions and reprisals. Rebels were disorganised and unable to withstand the power of such pacification measures.

The Occupation of Justice presents a comprehensive discussion of the Court's decisions in exercising this review. This revised and expanded edition includes updated material and analysis, as well as new chapters. Inter alia, it addresses the Court's approach to its jurisdiction to consider petitions from residents of the Occupied Territories; justiciability of sensitive political issues; application and interpretation of the international law of belligerent occupation in general, and the Fourth Geneva Convention in particular; the relevance of international human rights law and Israeli constitutional law; the rights of Gaza residents after the withdrawal of Israeli forces and settlements from the area; Israeli settlements and settlers; construction of the separation barrier in the West Bank; security measures, including internment, interrogation practices, and punitive house demolitions; and judicial review of hostilities. The study examines the inherent tension involved in judicial review over the actions of authorities in a territory in which the inhabitants are not part of the political community the Court belongs to. It argues that this tension is aggravated in the context of the West Bank by the glaring disparity between the norms of belligerent occupation and the Israeli government's policies. The study shows that while the Court's review has enabled many individuals to receive a remedy, it has largely served to legitimise government policies and practices in the Occupied Territories.
