Under favorable circumstances, we can be motivated to act justly by the belief that we must live up to what justice requires, irrespective of whether we benefit from doing so. But our will to act justly is subject to conditions. We find it difficult to exercise the virtue of justice when others regularly fail to. Even if we appear to have overcome the difficulty, our reluctance often betrays itself in certain moral emotions. In this book, Jiwei Ci explores the dual nature of justice, in an attempt to make unitary sense of key features of justice reflected in its close relation to resentment, punishment, and forgiveness. Rather than pursue a search for normative principles, he probes the human psychology of justice to understand what motivates moral agents who seek to behave justly, and why their desire to be just is as precarious as it is uplifting. Book excerpt: It is not possible to read Heidegger's text without the image of his arm raised in the Nazi salute haunting it. The image compels us to examine Heidegger's philosophy in terms of its susceptibility to Nazi ideology. Heidegger's philosophy was inscribed at the end of the history of philosophy, a time when Nazism was on the rise and on its way to the renewal of German destiny. In paragraph six of Being and Time Heidegger outlined his agenda for the renewal of philosophy. The renewal necessitated the destruction of the errant history of ontology in order to retrieve the pure primordial experiences. The parallels between the forms of two agendas are coincidental. However, my work shows where they overlapped. I explore the consequence of this overlap by soliciting the 'first' text of philosophy, The Anaximander Fragment, that speaks about justice and injustice. Justice is also at issue in the text of Jacques Derrida. Derrida's primary resource is paragraph six of Heidegger's Being and Time, a fact that caused some of his readers to assimilate him to Heidegger. Derrida has tried to distance himself from Heidegger and in a late text he has offered us the prescriptive phrase, "Deconstruction is justice," to guide our reading of his text. The phrase invites us to examine Derrida's work in light of its saying. This is what I try to do. I show that a separation cannot be accomplished without a price, because whether an author intends it or not, justice is something ghostly and it keeps its own account. Heidegger's arm and Derrida's hand caught in the trap of paragraph six tell another story, different from the stories the authors tell. The limbs tell the story about the ghosts of justice.

Book excerpt: Maintaining the importance of socio-economic issues in devising transitional justice mechanisms, this book examines the widespread practice of land grabbing in Afghanistan. On 3 September 2003, 100 armed police officers bulldozed around 30 homes in the Sherpur neighborhood of Kabul, Afghanistan, evicting over 250 people. Historically, the land was part of the property of the Ministry of Defense, of which a zone was allocated to the ministry’s employees who had built homes and had lived there for nearly 30 years. After the demolition, however, the land was distributed among 300 high-ranking government officials, including ministers, deputy ministers, governors and other powerful warlords. Land grabbing in Afghanistan has become a widespread practice across the country. Based on over 50 semi-structured interviews with key informants and group discussions with war victims and local experts in Kabul, the current book examines the relevance of transitional justice discourse and practice in response to this situation. Following a critical criminological concern with social harm, the book maintains that it is not enough to consider a country’s political history of violent conflict and the violation of civil and political rights alone. Rather, to decide on appropriate transitional justice mechanisms, it is crucial to consider a country’s socio-economic background, and above all the socio-economic harm inflicted on people during periods of violent conflict. This original and detailed account of the socio-economic challenges faced by transitional justice mechanisms will be of interest to those studying and working in this area in law, politics, development studies and criminology.
