Excerpt: ...notes to be a legal tender in payment of all debts, public and private, within the United States, except duties on imports and interest, &c.; but it cannot be said that the debt claimed by the plaintiffs is a debt due and payable either as a public or private debt within the, United States, and to no other class of debts than those referred to in the Act can it be applicable. A debt due and payable in Nova Scotia, in law, -can only be liquidated by the moneys mentioned in the Currency Act of the Province. Dollars and cents of the United States currency, if not referable solely to the dollar and cent current in that country when the contract was made, must refer to a dollar and cent current for all purposes; but, as I have said, the paper issue under the Act of Congress is not for all purposes, but limited in its operation, and if the plaintiffs were now held to the tender made by the defendants, and had moneys to pay in the United States for either of the excepted purposes of the Act, the moneys received 1864. from the defendants would not be available for that NON BCOTIA purpose; that consequence, then, cannot, in my C0-f;HY opinion, be a just and reasonable solution of the.1'.; i, f:, 1'H contract. C""""-If I had any doubt respecting this case, as to the justice of my views with reference to the defendants being liable to the plaintiffs in the current money of the United States when the contract was entered into, or what is. equivalent to that currency, the case of Pilkington v. Commissioners for Claims, 2 Knapp R. 17 to 21, would remove the doubt. That case is fully referred to in Story on the Conflict of Laws, sec. 313 a, and from that work I now quote: "The French " Government, ...

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Nova Scotia Reports, Vol. 40: Containing Reports of Cases Determined in the Supreme Court of Nova Scotia, (and Hitherto Unreported, ) With a Table of the Names of Cases Argued, a Table of the Cases Cited, Notes of Additional Unreported Decisions, and a Digest of the Principal Matters Considerations of space have made it necessary to publish some of the decisions in the form of notes at the foot of a full report of a kindred, although not precisely similar, case. Wherever the trial of an action took place outside of Halifax, the place of trial has been stated in the headnote, except at page 346, where Pictou should have been stated as the place of trial. A number of the judgments published in this volume were delivered by the late Mr. Justice J. N. Ritchie, and the editor cannot refrain from expressing his admira tion for the terse and luminous form in which the judgments of that eminent judge were always expressed. Notwithstanding the errors and omissions, it is hoped that this volume will be found useful by the profession. Excerpt: ...stipulates for a share in the net profits of a concern, and has a right to an account of the net profits, as a partner, he is liable although the partnership is limited to a single transaction or adventure. 1b., 4-H. 'If three enter an agreement, by the terms of which one is to do certain things, and the other two certain other things, each at their own expense, and each is to be entitled to an equal share of the profits arising out of the subject matter of the contract, this does not constitute them all partners, and make them all liable for expenses incurred by either in the performance of their part of the contract.' Heckert v. Fegeley, 6 Watts and Serg., 139, cited p. %58, 9 C. B. 'If several persons make advances for a common object, and agree to share the gross returns in proportion to their advances, this does not create such a community of interest in profits or loss as to make such persons partners. Thus in Gibson v. Lupton, 9 Bing, 287, where two persons joined in the purchase of wheat, with the intention of paying for it, and dividing it equally, it was held that they were not partners.' Lindley on Partnership, vol. 1, 24. it will be readily noted that the profits, (assuming them to be such), for division, if any, under the agreement herein are defined to be the division of the ore taken from the tunnels, and can only, I think, be interpreted to be a division of 'gross returns.' I am of the opinion that the above legal principles applied to the facts established by the evidence herein, justify me in holding that the defendant, McKay, is not a partner in the adventure in question, and should not be held liable for the claim sued for herein. I dismiss the action against the said defendant, ...

Excerpt: ...the bill will be reduced accordingly from $118.61 to 9543.6I, and, even then, in view of items improperly allowed but which did not come before me, it is quite $520.00 beyond what it ought in fairness to be. I mention this to show that I do not approve cf the principle adopted in the taxation of allowing for work below, and to prevent, as far as my opinion may have weight, its being taken as a precedent; and also to meet, indirectly, at least, a request of defendant's counsel that, if I disallowed the counsel fee, I ought to allow, in lieu of it, a sum for attendance at Chambers. Holding that the bill is excessive even as reduced, I would not, even if I thought I could, add one cent to it. An order will pass reducing the bill to the amount named. The defendant will pay the costs of this application aud motion, and there will be a set-off. The defendant's solicitors caused the whole trouble, and in all fairness should bear the costs of this motion as between themselves and their client. H. rllcllis/r, K. C., in support of appeal. The appeal is taken under R. S. N. S. (1900), c. 161, s. 50. The offence is within the legislative competency of the local legislature, and is, therefore, not a criminal matter. This court has jurisdiction to set aside a bad order in any case. We were entitled to counsel fee. R. S. N. S. (1900). vol. 2, p. 840. This is an appeal to the Supreme Court, although it was heard at Chambers. We also suomit that it was a special case. R. S. N. S. (1900), c. 161, s. 55. We should, at least, have been allowed $7.50 for our attendance at Chambers. We should, at least, have been allowed the limit fora Chambers brief. (1892), 1 Q. B. 396. T. R. Robertson, contra.
