The germ Of all that has been attempted in other parts Of the British Empire in the direction Of either conciliation or arbitration is to be found in the New Zealand Act Of 1894. Two years before the wages boards Of the Australian state Of Victoria were created, and seven years before any other part Of Australia had adopted arbitration, the New Zealand system with its Councils Of Conciliation and its Courts Of Arbitration was in full working order. It is interesting to note this primacy in time, because the larger industrial development and the more complex problems Of the Commonwealth Of Australia have caused the results Of arbitration there to receive greater attention. At first sight, this leadership Of New Zealand In legisla tion for the settlement Of industrial disputes Is surprising. The country is young and industrially little developed. Its population is small and the proportion engaged in industry quite meager. In 1894, when the arbitration system was introduced, the country contained less than white persons, and at the latest estimate its white population was only a little over Its factory population in 1894 was less than and in 1916 it did not exceed The number of trade unionists recorded in 1900 was a figure that by 1917 had reached While the latter number is not inconsiderable, the nature Of the industries in which the trade unionists are found reduces its significance. There is no large body Of miners or Of men employed in the metal trades. The largest unions are among transport workers, while builders come next in order. The Dominion, in short, has noconsiderable manufactures, no large industrial centers, and no powerful body Of organized unionists. Its acceptance Of conciliation and arbitration was, therefore, the endorsement Of a principle rather than the adoption Of a policy forced by expediency. It is true that there had been a number Of strikes and much unem ployment in the preceding period, which had injured the employers and disheartened and impoverished the work ers. These disputes had made the relief Of unemployment a pressing problem, and that task was the first imposed upon the newly created Department Of Labor. But in the conception Of the first Minister for Labor, the Hon. W. Pember Reeves, it was more important to find some better method for the settlement Of industrial disputes. It was this spirit that prevailed in the inauguration Of the arbitration system Of New Zealand. As with the people Of Australia, the system was fundamentally the legislative expression Of a social ideal. Book excerpt: Excerpt from Labour Laws of New Zealand The manufacturing population in New Zealand differs from that in some other of the Australasian Colonies by its wide dispersion. The capital city has hitherto been unable to draw to itself the industrial ability of the other provincial centres; and not only do Auckland, Christchurch, and Dunedin vie with Wellington as centres of population, but also as nuclei of commercial activity. In the second-class towns, such as Nelson, Napier, Invercargill, &c., many important works are being carried on, while even in the villages and rural districts the progress of new settlement necessitates the manufacture of articles which in older communities are produced in specialised localities. Men scattered widely at the numerous occupations of colonial country life, shearing, harvesting, bush-felling, road making, or sailing coastal vessels, &c., require legal protection against the dangers and disabilities to which their callingsexpose them. This general dispersion of industry necessitates not only a wide system of supervision, but legislative measures of a peculiar character, at once sufficiently elastic to comprehend many varieties of function, and yet rigid to crush any apparent abuse. The most important of these laws in its general significance is that dealing with compulsory arbitration in labour disputes. The Industrial Conciliation and Arbitration Act, 1894 (with its amending Act of exists for the purpose of encouraging industrial association, and to facilitate the settlement of trade difficulties. Societies consisting of five or more employers, or of seven or more workers, 'may be registered and become subject to the jurisdiction of the Board and Court appointed by the Act. Any such society may bring a disputed case before the Board of Conciliation appointed for that district, and, if the Board fails to efi'ect a settlement, the dispute may be referred to the Court of Arbitration, whose award may be enforced in the same manner as an award of the Supreme Court. Answers to the Labour Question explores how the liberal state responded to workers’ demands that employers recognize trade unions as their legitimate representatives in their struggle for compensation and control over the workplace. Gary Mucciaroni examines five Anglophone nations – Australia, Canada, Great Britain, New Zealand, and the United States – whose differences are often overlooked in the literature on political economy, which lumps them together as liberal, “market-led” economies. Despite their many shared characteristics and common historical origins, these nations’ responses to the labour question diverged dramatically. Mucciaroni identifies the factors that explain why these nations developed such different industrial relations regimes and how the paths each nation took to the adoption of its regime reflected a different logic of institutional change. Drawing on newspaper accounts, parliamentary debates, and personal memoirs, among other sources, Answers to the Labour Question aims to understand the variety of state responses to industrial unrest and institutional change beyond the domain of industrial relations.
