The paper concludes that if the US Environmental Protection Agency (EPA) determines that regulation of utility HAPs is warranted under Title III, savings can be realized from flexible compliance treatment.

While struggling to remain competitive and in compliance with environmental regulations, industry faces increasing requirements and potential liabilities due to emissions of hazardous air pollutants. Many states began establishing regulations governing the emissions of hazardous air pollutants after the 1984 accidental release of methyl isocyanate in Bhopal, India. After thirteen years of extended debate, the US Congress passed significant amendments to the Clean Air Act in 1990. These various regulations require industrial facilities to evaluate, control, monitor, permit and assess risk for a variety of listed chemicals considered hazardous air pollutants. Title III of the 1990 Clean Air Act Amendments provides for the permitting and control of sources emitting as little as ten tons per year of one of 189 federally listed hazardous air pollutants. In addition, sources emitting lesser quantities of 100 of these 189 hazardous air pollutants have to develop risk management plans to prevent accidental releases. This requirement is very similar to the Occupational Safety and Health Administration regulation for protecting workers from accidental releases. Approximately ten other federal regulations also deal with emissions of hazardous pollutants. In addition, state regulations address up to 460 hazardous air pollutants. Deadlines for establishing compliance with the federal requirements are currently being implemented for some industry categories and are scheduled to be completed by 2003.To effectively respond to this myriad of hazardous air pollutant regulations and maintain a viable business, owners and operators of industrial facilities need to understand: the pollutants that are regulated as hazardous, applicable state and federal requirements, sources of hazardous air pollutants, the quantification of hazardous air pollutant emissions, potential risks and liabilities, and the best means to establish a compliance program.This book provides a review of the regulatory requirements affecting sources of hazardous air pollutants, the methods for inventorying and measuring emissions, methods for evaluating potential risks and liabilities due to hazardous air pollutant emissions, and approaches available to reduce emissions and establish a hazardous air pollutant compliance program.

Book excerpt: The 1990 Clean Air Act Amendments (CAA) required the EPA to take specific actions to reduce emissions and risks from air toxics. Air toxics (also known as hazardous air pollutants or HAPs) are pollutants known to cause or suspected of causing cancer as well as respiratory, neurological, reproductive and other serious health effects. Air toxics are emitted by mobile sources (e.g., cars, trucks and construction equipment); large or major sources (e.g., factories and power plants); smaller, or area, sources (e.g., gas stations and dry cleaners); and background sources (e.g., longrange transport of pollution and natural emissions sources such as wildfires). Examples of air toxics include benzene, found in gasoline; perchloroethylene, emitted from some dry cleaning facilities; and methylene chloride, used as a solvent by several industries. Congress expressed under CAA section 112(k) that emissions of air toxics, individually or in the aggregate, may present significant risks to public health in urban areas and directed the U.S. Environmental Protection Agency (EPA) to develop a strategy to reduce these risks. Considering the large number of persons exposed and the risks of carcinogenic and other adverse health impacts from HAPs, the EPA believed that to reduce public health risks in urban areas, aggregated exposures from all sources had to be addressed. Therefore, it developed the Integrated Urban Air Toxics Strategy in 1999, using all available authorities, for reducing cumulative public health risks in urban areas posed by the aggregated exposures from all sources, including major stationary sources, smaller area stationary sources and mobile sources. The EPA also recognized that national regulations alone would not be enough to address all of the issues, particularly those affecting urban areas.

Sources of air toxics include large industrial facilities, smaller facilities such as dry cleaners, and cars and trucks. The 1990 Clean Air Act Amendments required EPA to regulate 190 pollutants from these sources through a multifaceted regulatory program. While EPA issues federal standards, state and local agencies generally administer these standards, and some develop their own rules to complement the federal standards. In this context, GAO was asked to assess (1) EPA's progress and challenges in implementing the air toxics program, (2) available information on the program's costs and benefits, and (3) practices of state and local air toxics programs.

It defines the major energy sector sources of these HAPs that would be affected by the regulations. Attention is focused on regulations that would cover coke oven emissions; chromium emission from industrial cooling towers and the electroplating process; HAP emissions from tank vessels, asbestos-related activities, organic solvent use, and ethylene oxide sterilization; and emissions of air toxics from municipal waste combustors. The possible implications of Title III regulations for the coal, natural gas, petroleum, uranium, and electric utility industries are examined. The report discusses five major databases of HAP emissions: (1) TRI (EPA's Toxic Release Inventory); (2) PISCES (Power Plant Integrated Systems: Chemical Emissions Studies developed by the Electric Power Research Institute); (3) 1985 Emissions Inventory on volatile organic compounds (used for the National Acid Precipitation Assessment Program); (4) Particulate Matter Species Manual (EPA); and (5) Toxics Emission Inventory (National Aeronautics and Space Administration). It also offers information on emission control technologies for municipal waste combustors.
