Book Constitutional Change in the Commonwealth

Download or read book Constitutional Change in the Commonwealth written by Leslie Zines and published by Cambridge University Press. This book was released on 1991-06-28 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a contribution to comparative constitutional law and deals with important changes in the United Kingdom, Canada, Australia and New Zealand, the original members of the present Commonwealth of Nations. It is based on lectures delivered at the University of Cambridge. The first lecture discusses the development in recent years of the constitutional autonomy of Canada, Australia and New Zealand, and its effect on the constitutions of those countries and on the concept of the 'crown'. The second lecture is concerned with methods to entrench, constitutionally, individual and democratic rights. The final lecture contrasts judicial attitudes to the interpretation of the constitutions of Canada and Australia. The conclusion is reached that although the EEC is not a federation, there is a structural similarity between the distribution of governmental power within the Community and its members, and the federal issues that arise in Canada, Australia and other federations.

Book Colonial and Post colonial Constitutionalism in the Commonwealth

Download or read book Colonial and Post colonial Constitutionalism in the Commonwealth written by Hakeem O. Yusuf and published by Routledge. This book was released on 2013-12-17 with total page 245 pages. Available in PDF, EPUB and Kindle. Book excerpt: The peace, order and good government (POGG) clause is found in the constitutions of almost all Commonwealth countries. Since its introduction, the clause has played a significant role in colonial and post-colonial constitutionalism in Commonwealth jurisdictions. This book is the first full length analysis of the various dimensions of the peace, order and good government clause. It argues that the origins of the POGG clause mark it out as an anachronistic feature of British constitutionalism when seen against a modern setting of human rights, liberty and democratisation. The book traces the history, politics and applications of the clause through the colonial period in Commonwealth territories to date. It provides critical evaluation of the POGG clause in a cross-continental enquiry, examining statutory, political and constitutional deployment in Australia, Canada, India, Nigeria, South Africa and the United Kingdom. The evaluation demonstrates that the POGG clause has relevance in a number of significant aspects of legal and socio-political ordering across the Commonwealth featuring prominently in the federalism question, emergency powers and the review of administrative powers. It maintains that while the clause is not entirely devoid of positive value, the POGG clause has been used not only to further the objects of colonialism, but also authoritarianism and apartheid. This book calls for a rethink of the prevailing subjective approach to the interpretation of the clause. The book will be of interest to students and academics of public law, human rights law, and comparative politics.

Book The Constitutional Systems of the Commonwealth Caribbean

Download or read book The Constitutional Systems of the Commonwealth Caribbean written by Derek O'Brien and published by Bloomsbury Publishing. This book was released on 2014-12-01 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Commonwealth Caribbean comprises a group of countries (mainly islands) lying in an arc between Florida in the north and Venezuela in the south. Varying widely in terms of their size, population, ethnic composition and economic wealth, these countries are, nevertheless, linked by their shared experience of colonial rule under the British Empire and their decision, upon attaining independence, to adopt a constitutional system of government based on the so-called 'Westminster model'. Since independence these countries have, in the main, enjoyed a sustained period of relative political stability, which is in marked contrast to the experience of former British colonies in Africa and Asia. This book seeks to explore how much of this is due to their constitutional arrangements by examining the constitutional systems of these countries in their context and questioning how well the Westminster model of democracy has successfully adapted to its transplantation to the Commonwealth Caribbean. While taking due account of the region's colonial past and its imprint on postcolonial constitutionalism, the book also considers notable developments that have occurred since independence. These include the transformation of Guyana from a parliamentary democracy to a Cooperative Republic with an executive president; the creation of a Caribbean Single Market and Economy and its implications for national sovereignty; and the replacement of the Judicial Committee of the Privy Council by the Caribbean Court of Justice as the final court of appeal for a number of countries in the region. The book also addresses the resurgence of interest in constitutional reform across the region in the last two decades, which has culminated in demands for radical reforms of the Westminster model of government and the severance of all remaining links with colonial rule.
