But many nations, and among them England and the United States, have enacted statutes termed Neutrality Acts, or Foreign Enlistment Laws, for the purpose of compelling their respective subjects to conform to the laws of nations, and to forbear from interfering in wars between them, under various pains and penalties. These enactments, however, are merely municipal laws, which foreign nations have no power to en force, nor to punish the infraction of; and the breach of which, in ordinary cases, they have no right to complain of, unless it: involve one of the laws of nations, and then only to that extent and on that exclusive ground or unless the fail ure, on the part of the neutral, to enforce obedience to them, indicate a substantial departure from that impartiality which is of the essence of neutrality. President Washington on April 22, 1793, held that whosoever of the citizens of the United States shall render himself liable to punishment or forfeiture under the law of nations by committing, aiding or abetting hostilities against any of the said powers, or by carrying to any of them those articles which are deemed contraband by the modern usage of nations, will not receive the protection of the United States against such punishment or forfeiture.
