Book Political Participation of Minorities

Download or read book Political Participation of Minorities written by Marc Weller and published by . This book was released on 2010 with total page 921 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Commentary provides the reader with a review of international standards and practice relating to the political participation of minorities. Political participation has been increasingly recognized as a foundational issue in the debate about minority rights. It is argued that minorities are more likely to feel co-ownership in the state if they have the opportunity to participate freely and effectively in all aspects of its governance, and that sustained and meaningful engagement will guard against the sense of alienation and exclusion among minorities that often emerges in ethnically divided societies. Taking as its starting point the two most important standard-setting documents in the field - the Lund Recommendations on the Effective Participation of National Minorities in Public Life, developed by the Organization for Security and Cooperation in Europe, and the Council of Europe's Thematic Commentary on the Issue of Political Participation of Minorities - the Commentary locates the international legal entitlement to political participation within the wider context of the right to democratic governance. It also considers effective participation in relation to the right to full and effective equality, as well as the legal entrenchment of these provisions and implementation mechanisms. Individual chapters then consider each of the principal mechanisms aimed at enhancing political participation, ranging from procedures covering minority representation in political institutions to consultative mechanisms and autonomy solutions. The Commentary draws on a team of experts, all of whom are recognized authorities in this specialized area of minority issues.

Book Minorities Minority Rights and Internal Self Determination

Download or read book Minorities Minority Rights and Internal Self Determination written by Ulrike Barten and published by Springer. This book was released on 2014-09-23 with total page 299 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book questions the classic idea of self-determination – the right to self-determination is a right of peoples, not of minorities – by examining the content of the right to self-determination and the content of minority rights. Self-determination has four dimensions: the political, the economic, the social and the cultural dimensions. Minorities have minority rights that touch on most aspects of life as a member of a minority. If there is an overlap between minority rights and the different dimensions of self-determination, the concept that the right to self-determination is only applicable to peoples loses credibility. No global and general conclusion is envisaged; there are restrictions in place. The work is limited to the European framework and is further restricted to classic minorities. The argument is based on a legitimacy and justice approach. The analysis in this book shows that some minority rights overlap with the different dimensions of internal self-determination. In short, classic minorities in Europe have a right to internal self-determination.

Download or read book Unity in Diversity written by Christophe van der Beken and published by LIT Verlag Münster. This book was released on 2012 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book argues that the development of federalism in Ethiopia fits in with a global trend towards increased attention to ethnic minority rights and to federalism as a mechanism for ethnic conflict prevention and management. The Ethiopian federation is designed as a framework within which the Ethiopian ethnic groups can protect their rights and within which they are stimulated to develop a cooperative relationship. To put it differently, the constitutional objective of the federal structure is the creation of 'unity in diversity.' The book evaluates the capacity of Ethiopian federalism to achieve this objective by investigating the relevant historical, political, and legal aspects. Book International Conflict and Security Law

Download or read book International Conflict and Security Law written by Richard Burchill and published by Cambridge University Press. This book was released on 2005-06-23 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Hilaire McCoubrey wrote extensively in the area of armed conflict law, and on the issues of collective security law and the law relating to arms control. Although he died at the early age of 46 in 2000 he had contributed significantly to the separate study of these areas, but also to the idea of studying the issues as a whole subject. The collection covers difficult and controversial issues in the area of conflict and security law. The contributors, drawn both from academe and practice, provide expert analysis of many aspects of the law governing armed conflict and collective security. As well as providing a fitting tribute to the main aspects of Hilaire's contribution to knowledge, the volume provides a coherent reconsideration and development of key aspects of conflict and security law at a time when that law is being applied, breached, debated or reformed on almost a daily basis.

Book Negotiating Norms

  • Author : Ricarda Rösch
  • Publisher : Springer Nature

Download or read book Negotiating Norms written by Ricarda Rösch and published by Springer Nature. This book was released on 2023-12-12 with total page 402 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book explores the right to free, prior and informed consent (FPIC) – a highly controversial right. It is mainly discussed in the context of large-scale business projects on Indigenous territories but also with respect to the creation of protected areas and communities’ traditional resource rights. From a legal anthropological perspective, it attempts to disentangle the various coexisting understandings of FPIC and provide an explanation for the multiplicity of FPIC norms or – to put it in other words – its fragmentation. It examines the right- or stakeholders of FPIC, the scope of the consent requirement, the respect for self-determined decision-making, and the right to FPIC of women in different sociolegal fields. Moreover, it explores the impact of power relations, strategic alliances, and discourses within these fields and shows that the emerging FPIC norms are the result of norm negotiation processes. The fields that are examined include transnational law – more specifically, human rights, environmental, and development law -, the Liberian post-conflict forest and land legislation, and Liberian community forests as fields in which FPIC is operationalized. Liberia is quite unique in this respect. It is not only one of the few countries in Africa recognizing FPIC but has also begun implementing it. The book shows that based on the logic of a sociolegal field, legal identities are discursively created and determine the meaning of FPIC. Moreover, different actors can resort to different legalities shaping the emerging FPIC norm.
