The positions and mutual relations of the two engineers were accurately denned in the deed of contract made September 29, 1853, between the Grand Trunk Eailway Company of Canada, of the one part, and William Jackson, of Birkenhead, and Samuel Morton Peto, Thomas Brassey, and Edward Ladd Betts, all of London, in England, contractors, of the other part. ' The contractors, ' runs the language of the deed, ' will make, build, and construct the said tubular bridge over the said River St. Lawrence, at or near Montreal, according to the plans, sections, and specifications prepared and drawn by Eobert Stephenson, of London, aforesaid, Civil Engineer, M.P., and Alexander M'Kenzie Eoss, of Montreal, C.E.' The deed then requires: ' The Bridge when completed to be in perfect repair, and of the best and most substantial character, and to be approved of by the said Eobert Stephenson.' It further provides, ' that in case of the death, refusal, or inability to act of the said Alexander M'Kenzie Eoss, another engineer shall from time to time be appointed by the said Eobert Stephenson, in place of the said Alexander M'Kenzie Eoss, and who shall have all the powers of the said Alexander M'Kenzie Eoss. And in the event of the death, or refusal, or inability of the said Eobert Stephenson, then all things then remaining to be done by the said Eobert Stephenson shall be done by an eminent civil engineer, to be appointed by the president for the time being of the Institution of Civil Engineers in England, upon the requisition of the parties hereto, or either of them.'
