Book excerpt: Excerpt from The Letters of Algernon Sydney: In Defence of Civil Liberty and Against the Encroachments of Military Despotism; Written by an Eminent Citizen of Virginia, and First Published in the Richmond Enquirer in 1818-19; To Which Are Added, in an Appendix, the Remarks of Mr. Ritchie as Referred A large portion of the reading public in Virginia, will well recollect the strong sensation excited in the winter of 1818-19, by the appearance of the following letters under the signature of "Algernon Sydney." The uncommon perspicuity and elegance which distinguish them as literary compositions, no less than the ardent love of liberty which breathes through every line, attracted towards them an unusual degree of popular favour; and although confined to the fleeting columns of a newspaper, they were every where eagerly sought after, and in some instances carefully preserved as models of fine writing and sound patriotism. The Publisher believes that he cannot render a more acceptable service, than to present these invaluable letters to the public in a less perishable form, and in doing this, it is proper for him to say, that he has been so fortunate as to prevail upon their distinguished author to revise and correct some inaccuracies which were found in the original publication. It is also just to remark, that so far and no further, has that gentleman aided or participated in the present edition. It issues from the press on the sole responsibility and by the exclusive agency of the publisher. It may be asked why send forth these letters at this late period, when the occasion which originally produced them has passed away, and the individual whose conduct they so eloquently arraigned, has not only been tried at the bar of public opinion and acquitted, but has actually received the highest reward in the gift of the American people. To this it may be replied in the first place, that Truth is eternal and unchangeable, and though for a time it may be despised, - trodden down and vanquished, it is contrary to the Divine Justice to suppose it can ever be finally annihilated. In doing so, he achieved both a great victory and the notoriety of being the first American general to ever suspend civil liberties in America. Andrew Jackson and the Politics of Martial Law tells the history of Jackson's use of martial law and how the controversy surrounding it followed him throughout his life. The work engages the age-old controversy over if, when, and who should be able to subvert the Constitution during times of national emergency. It also engages the continuing historical controversy over Jackson's political prowess and the importance of the rise of party politics during the early republic. As such, the book contributes to both the scholarship on Jackson and the legal and constitutional history of the intersection between the military and civilian spheres. To fully understand the history of martial law and the subsequent evolution of a theory of emergency powers, Matthew Warshauer asserts, one must also understand the political history surrounding the discussion of civil liberties and how Jackson's stature as a political figure and his expertise as a politician influenced such debates. Warshauer further explains that Abraham Lincoln cited Jackson's use of the military and suspension of civil liberties as justification for similar decisions during the Civil War. During both Jackson's and Lincoln's use of martial law, critics declared that such an action stood in opposition to both the Constitution and the nation's cherished republican principles of protecting liberty from dangerous power, especially that of the military. Supporters of martial law insisted that saving the nation became the preeminent cause when the republic was endangered. At the heart of such arguments lurked the partisan maneuvering of opposing political parties. Andrew Jackson and the Politics of Martial Law is a powerful examination of the history of martial law, its first use in the United States, and the consequent development of emergency powers for both military commanders and presidents. Matthew Warshauer is associate professor of history at Central Connecticut State University. He is the author of the forthcoming Andrew Jackson: First Men, America's Presidents. Book excerpt: Returning to Kentucky in the spring of 1829 after four years as secretary of state in the administration of John Quincy Adams, Henry Clay quickly regained the political dominance at home that would carry him to the U.S. Senate in 1831. Assuming leadership of the anti-Jackson forces, Senator Clay in 1832 mounted a spirited campaign for the presidency, advocating recharter of the national bank, high protective tariffs, and internal improvements, and alleging the administrative incompetence of Jackson and his cronies. Clay's defeat by the popular military hero was probably foreordained, but he emerged with sufficient national prestige to play the leading role in mediation of the nullification crisis of December 1832-March 1833. The battle over the constitutionality of the protective tariff, during which the words secession, invasion, and civil war were freely used, pitted Jackson and the power of the federal government against the states' rights politicians of South Carolina. Clay's masterful legislative compromise of 1833 defused a tense situation and brought him national applause as savior of the Union. Continuing his efforts to form a political coalition strong enough to defeat the Jacksonians, Clay was successful in a Senate resolution to censure the president for unconstitutional exercise of power in removing government deposits from the Bank of the United States. But as the election of 1836 drew near it became evident that the emerging coalition could not defeat Democrat Martin Van Buren, Jackson's hand- picked candidate; as the Reign of Jackson drew to a close, Clay could only view the national scene with dismay.
