Book excerpt: Excerpt from The Organization of City School Systems: An Address Delivered Before the Council of School Superintendents of the State of New York at Albany, October 14, 1912 The purpose of this paper is to express in general terms the conclusions reached after an experience of twenty years in dealing with many phases of the subject and also to express what is commonly acknowledged by expert authority in school administration to be the fundamental principles on which all laws which are to govern the public schools of a city should be enacted. Until a permanent policy shall be established in relation to the organization of the machinery for the operation of the public schools in the several cities of the State and upon fundamental principles consonant with the general policy of the State upon public education, and until these prin ciples are well understood by teachers, superintendents and officers who bear official relation to the schools, and until such fundamental principles are generally recognized by municipal authorities, political parties and influential citizens, this subject is one which should receive the consideration not only of organizations of school workers like yours in session' here tonight but of all citizens who have a patriotic interest in the welfare of the State. The first law authorizing the establishment of public schools in this State was enacted in 1795. The permanent basis of a State system of public education was enacted in 1812, or just one hundred years ago. In these early statutes the principle was written that all tax-supported schools and schools receiving State aid should be under State supervision, that the schools constituted a State system and that public officers should be chosen in the several localities to represent the State and to carry into effect the State's policy in relation to public education. This principle became fundamental to all educational enterprises in which the State is interested. It is founded upon the sound doctrine that the welfare of the State depends upon a general dissemination of education in all sections and for the benefit of all citizens and that, where the funds of the State go, the authority, supervision and control of the State must follow. The study is concerned with an analysis of the practices of boards of education in cities of various sizes, together with an attempt to evaluate such practices. It is an attempt to discover what functions boards of education themselves perform, as a body or through their committees, what functions are delegated to executives, and how these functions are delegated. Questions which the study seeks to answer in part at least are: What are the duties that lay boards perform? What is the nature of matters receiving the attention of boards? What kind of data do they require as a basis for determining school policies? What functions are delegated to committees? What functions are delegated to executive officers? What is the form of administrative organization provided? To what extent do boards recognize professional leadership in administrative matters and in initiating school policies? Constructively the study seeks to discover the duties that are important for a lay board to perform as opposed to those that are trivial or that are professional and administrative. It seeks to discover those functions that should be delegated to the professional chief executive and his assistants and the scope of authority that should be given them. And, finally it seeks to discover how, with such functions delegated to professional executive officers, a lay board may exercise efficient control of the responsibilities imposed upon them by the state. 2. This power was first given while Mr. Yates was in Office. Although numerous decisions were made by the latter, copies were not pre served in his office. His practice was to send them to be recorded by the commissioners of common schools of the towns, or the trustees of the districts, in which the cases arose. Abstracts of some of them were appended to a new edition of the School Laws which he was directed to publish in the year 1822; and a reference to a few of them will be found in this volume, as well as to the exposition by Mr. Hawley of the early laws relat ing to the common schools. In 1826, Azariah C. Flagg was appointed Secretary of State, and from the commencement of his administration of the com mon s'chool department down to the present time, a continuous record of decisions has been preserved. He shall appoint a deputy; and, in case of a vacancy in the office of superintendent, the deputy may perform all the duties of the office until the day after the day hereinbefore fixed for an election by the senate and assembly. In case the office of both superintendent and deputy shall be vacant, the governor shall appoint some person to fill the office, until the superintendent shall be elected and assume it. 3. The superintendent's office shall continue to be in the state hall, and maintained at the expense of the state. 4. His salary shall be five thousand dollars a year, payable quarterly, by the treasurer, on the warrant of the comptroller. 5. He may appoint as many clerks as he may deem necessary, but the compensation of such clerks shall not exceed in the aggregate the sum of nine thousand dollars in any one year, and shall be payable monthly by the treasurer, on the warrant of the comptroller, and the certificate of the superintendent. 6. The seal of the superintendent, of which a description and impression are now on file in the office of the secretary of state, shall continue to be his official seal, and when necessary may be renewed from time to time. Copies of all papers deposited or filed in the superintendent's office, and of all acts, orders and decisions made by him, and of the drafts or machine copies of his official letters, may be authenticated under the said seal, and when so authenticated, shall be evidence equally with and in like manner as the originals. 7. The superintendent shall be ex-officio a trustee of Cornell University and of the New York State Asylum for Idiots, and a Regent of the University of the State of New York.
