Book Contemporary Issues of the Law of the Sea

Download or read book Contemporary Issues of the Law of the Sea written by Aleksandr Antonovich Kovalev and published by Eleven International Publishing. This book was released on 2004 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Originally published in Russian, this book is the first major Russian treatise on the international law of the sea in the post-Soviet era. The book covers the legal status and legal regime of the sea expanses and follows their classification in the 1982 United Nations Convention. In addition, a separate section is devoted to the legal status of the Caspian Sea. The author analyzes in-depth the international legal norms regulating the preservation of the marine environment and concludes that a system of international cooperation is essential both in the sphere of navigation and economic exploitation of oceanic resources. Extensive attention is given to Russian practice. As Russia plays a central and influential role in world maritime policy, a book that specifically deals with Russian approaches in this field cannot fail to be of importance to anyone interested in the law of the sea.

Book The Law of Maritime Boundary Delimitation

Download or read book The Law of Maritime Boundary Delimitation written by Alex G. Oude Elferink and published by BRILL. This book was released on 2021-09-27 with total page 480 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume presents an analysis of the maritime boundary delimitations of the Russian Federation. The focus of this analysis is the relationship between state practice and the rules of public international law applicable to the delimitation of maritime zones between neighboring states. A first part establishes the contents of the law in this field. The main part of the work concerns an analysis of the position of the Russian Federation on the rules of maritime delimitation law and the practice of this state in relation to the delimitation of specific maritime boundaries with neighboring states. The case study of the Russian Federation illustrates the significance of international law for the delimitation of maritime boundaries, while at the same time indicating the limits of the influence of the law on state behavior.

Download or read book The Legal Regime of Straits written by Hugo Caminos and published by Cambridge University Press. This book was released on 2014-12-22 with total page 531 pages. Available in PDF, EPUB and Kindle. Book excerpt: The right of transit passage in straits and the analogous right of archipelagic sealanes passage in archipelagic states, negotiated in the 1970s and embodied in the 1982 UNCLOS, sought to approximate the freedom of navigation and overflight while expressly recognising the sovereignty or jurisdiction of the coastal state over the waters concerned. However, the allocation of rights and duties of the coastal state and third states is open to interpretation. Recent developments in state practice, such as Australia's requirement of compulsory pilotage in the Torres Strait, the bridge across the Great Belt and the proposals for a bridge across the Strait of Messina, the enhanced environmental standards applicable in the Strait of Bonifacio and Canada's claims over the Arctic Route, make it necessary to reassess the whole common law of straits. The Legal Regime of Straits examines the complex relationship between the coastal state and the international community.

Book Territorial Waters in the Arctic

Download or read book Territorial Waters in the Arctic written by S. M. Olenicoff and published by . This book was released on 1972 with total page 72 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Soviet Union maintains that its territorial waters, including those in the Arctic, extend 12 n mi from its coastline. It has also declared a 'sector claim' which Soviet jurists have unofficially interpreted to mean that the USSR also claims the airspace above the sector as well as the ice islands, the ice pack, and the waters between the Arctic Basin islands and between the islands and the mainland. These claims may become troublesome with the advent of surface-effect vehicles and submarine transports that will permit regular Arctic navigation. (Author Modified Abstract).

Book The Right of Innocent Passage and the Evolution of the International Law of the Sea

Download or read book The Right of Innocent Passage and the Evolution of the International Law of the Sea written by Francis Ngantcha and published by Burns & Oates. This book was released on 1990 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a contribution to the debate about the Law of the Sea, published to coincide with the signing of a new Convention. Despite comprehensive international rules on navigation contained in the 1982 Law of the Sea Convention, the right of innocent passage for all ships is still controversial in many respects - particularly the definition of non-innocent passsage, the recognition of the possibility of declarations, the innocent passage of warships or other special sea vessels.

  • Author : Mitchell P. Strohl
  • Publisher : Springer Science & Business Media

Download or read book The International Law of Bays written by Mitchell P. Strohl and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 436 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of this book is to describe the problems posed in the formulation of international rules for bays at the present time, to investigate the history of the several interests that have influenced the development of such rules, to trace the efforts that have been made to codify the rules, and to suggest a further refinement of the rules. This book seeks to combine the fruits of the writer's experience as a navigator with those of his studies in international law, geography, history and economics. Although, after study and thought upon the subject, there is likely to arise an initial desire to write a work that is truly definitive, one must resign himself to something of lesser scope. That being so, there is, if anything, an increased demand upon the writer to exercise careful judgment in his research, and in his exposition of the subject. This writer can only hope that he has discharged this responsi bility to the degree that his efforts will have clarified some issues and that what he has set on paper may be of some assistance to others. This writer has attempted to be as objective as possible in his inter pretations, and he has made no attempt to defend the policy of any State. In so doing, he is weil aware of the fact that for broader policy reasons, some of the views expressed herein cannot be officiaily accept ed as bases for action.
