Book A Treatise on the Law of Mines and Minerals Classic Reprint

Download or read book A Treatise on the Law of Mines and Minerals Classic Reprint written by William Bainbridge and published by Forgotten Books. This book was released on 2017-11-16 with total page 1138 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Mines and Minerals Since the publication, in the year 1867, of the Third Edition of the Author's Treatise, mining industry has, upon the whole, and notwithstanding occasional variations, enormously increased e and the law, also, of mines and minerals, from having been more frequently before the Courts and from other causes, has received a corresponding development. The principles of that law are now more definitely settled, and its details are much more accurately ascertained or ascertainable, than they or either of them were at the time the Author wrote. In the present or Fourth Edition, the Editor has endeavoured, while founding upon the old edition, to express these more definite principles, and to arrange these more accurately ascertainable details of mining law in a form at once convenient and logical, embodying them in the Author's Treatise in their appropriate places, and generally carrying forward that Treatise to the stage at which mining law has now arrived. For the better attainment of the objects above ex pressed, the Editor, although averse to taking liberties with either the method or the matter of his Author, has found himself compelled to take, and has also taken in fact, very considerable liberties with both. He has greatly altered the method; and he has greatly altered the matter also. Firstly, as regards alterations of method, - the Editor has made the following alterations, viz. Book excerpt: Excerpt from The Law of Mines, Quarries, and Minerals The latter case is also the latest authority for the statement, that, in order to exclude the right of support, the intention must be shown, either by express words, or by necessary implication. Aspden v. Seddon (which came before the Court of Appeal in 1875) is one of the few cases (if not the only case) in which the defence of necessary implication has succeeded; and it is perhaps doubtful, whether, in the face of the rule of construction next mentioned, that case is still an authority. The public spirit of litigants may be trusted in the future (as in the past) to endeavour to find examples of what is necessary implication, and to succeed in finding examples of what is not. Book A Manual of American Mining Law Classic Reprint

Download or read book A Manual of American Mining Law Classic Reprint written by Alfred Herbert Ricketts and published by Forgotten Books. This book was released on 2017-10-19 with total page 560 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Manual of American Mining Law This latest work on American mining law, by Mr. Ricketts, brings everything on the subject up to date, as to State and Federal legislation, the decisions of the courts, and the rulings of the Departments. On reading the advance sheets one is at once struck by the conciseness in which the facts are presented. There has been no attempt whatever toward elaboration or argument. The author gives what he considers the proper construction of the law and in each case cites the authorities. There is there fore nothing to confuse the layman, while at the same time the book is of great value for reference to those of the legal profession. Under each general heading are numbered and titled paragraphs, exceedingly brief but showing the authority and its source. No arrangement could well be handier for reference to the prospector, miner, mine manager or lawyer. It is to be noted that both the first book on American mining law and the latest one on the same subject are by Californian authors, practicing attorneys in the city of San Francisco, where both books were published. Book Accidents in Mines

Book excerpt: Excerpt from Accidents in Mines: Their Causes and Prevention I have endeavoured, by collecting all the informa tion into one volume, to bring before the public, as seen by those who are engaged professionally as mining engineers, the subject of the number of lives lost in working coal, and the sources of accident which might be prevented. It may be fairly asked (1) whether the principles of Davy's lamp hold good when the atmospheric pressure is as great as it is in the deep coal mines; and (2) what effect the vibrating waves of sound may have on the flame within the lamp when the Mp is surrounded by an explosive mixture of gas. Book Handbook on American Mining Law Classic Reprint

Download or read book Handbook on American Mining Law Classic Reprint written by George P. Costigan and published by Forgotten Books. This book was released on 2017-12-02 with total page 816 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook on American Mining Law The title American Mining Law has been chosen because of its simplicity and because the law chiefly dealt with, while it affects only a comparatively small part of the United States and its possessions, is so national in its character as deservedly to be spoken of by all writers on the subject as American Mining Law. In the notes the cases which for one reason or another are sug gested as best for students to consult are printed in large type. As is true of other Hornbooks, an exhaustive citation of cases has not been attempted, but the endeavor has been to give a comprehensive, well proportioned, and up-to-date treatment of the subject. Book Mining Mineral and Geological Law Classic Reprint

Download or read book Mining Mineral and Geological Law Classic Reprint written by Charles Harmonas Shamel and published by . This book was released on 2015-07-11 with total page 662 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Mining, Mineral and Geological Law The aim and scope of this book and the importance of a knowledge of mining law to the mining engineer and mine owner in the United States are explained in the introductory chapter, but a few words may be added here concerning existing books that might be used for such purposes. The excellent works of Lindley and Snyder, each in two large volumes, on account of their elaborateness and style of treatment, are not well adapted for the use of others than practicing lawyers, although indispensable to them. The small manuals of mining law and forms are usually too brief to give any adequate space for such statement and explanation of the principles of our complicated system of mining law as will enable it to be understood in any appreciable degree by those for whom they are intended. Moreover, owing to the extensive changes in and additions to the State statutes by the various legislatures in 1907, and the revision of the very important Land Office Rules and Regulations made in the same year, they are no longer safe guides in these respects. Consequently it would seem that a book containing in one volume a brief history of the development and a condensed but systematic exposition of the principles and rules of law that govern mining rights in the United States, together with a compilation of the National and State statutes and the Land Office Rules and Regulations relating thereto, revised to date, ought to be useful to the mining profession, and that the present is a particularly opportune time for its appearance. In the complex and intricate questions that have arisen out of the application of the extralateral provision of the law, a bare statement of the rule, worked out by the courts to govern rights in the various situations that arise in mining operations, would be inadequate to give a comprehension of the law. Book Mining Law for the Prospector Miner and Engineer Classic Reprint

Download or read book Mining Law for the Prospector Miner and Engineer Classic Reprint written by H. W. Macfarren and published by Forgotten Books. This book was released on 2017-10-11 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Mining Law for the Prospector, Miner, and Engineer In adding another work on mining law to those already before the public, it is necessary to give a reason. The' present standard works on the subject are the production of mining attorneys, and while the value of their works is unquestioned, they are, perforce, more valuable and suitable for practising attorneys and in connection with mining l'itigations than for miners and as a guide in the field. This work has been prepared for the miner by a miner - using the word miner as a generic term to include all who may be interested in the subject of mineral rights and titles in contradistinction to mining attorneys though it is believed that the work will not be without elementary interest and value to the law profession. The purpose in view is to give a simple and easily grasped, though comprehensive idea of the mining law, showing its fabric and structure, that the reader and student may obtain the basic principles and facts upon which to take up either the more advanced study of mining law or use it intelligently and satisfactorily as a prospector, surveyor, claim owner, or property manager. It represents the experience and observation of the writer in the mining profession and as a mineral examiner of the Field Service of the General Land Office, in which capacity he has been in daily contact, in both office and field, with miners, mineral claimants, and the subject of mining rights and titles. Book excerpt: Excerpt from Digest of the Law of Mines and Minerals and of All Controversies Incident to the Subject-Matter of Mining In its arrangement each syllabus has a separate heading, and the general plan is based upon the idea that a digest, as a work of reference, should contain every possible aid to the speedy finding of the proposition sought. The index is so arranged as to contain under each title a reference to those syllabi which might have been collated under that title, but which, owing to their relation to other headings, have necessarily been dis tributed under such other headings.
