Book A Practical Guide to Ending Commercial Leases in Scotland

Download or read book A Practical Guide to Ending Commercial Leases in Scotland written by Amir M Ismail and published by Law Brief Publishing. This book was released on 2021-02-23 with total page 96 pages. Available in PDF, EPUB and Kindle. Book excerpt: The termination of a commercial Lease is something that needs to be approached with great caution and attention-to-detail. A failure to take account of essential/current law and practice could result in a significant claim against the solicitor(s) involved in the transaction, and the consequences for the Landlord or Tenant will be significant. A Practical Guide to Terminating Commercial Leases in Scotland is designed to be a concise, yet definitive, guide for solicitors and students alike. It encompasses a summary of relevant statutes and case law throughout, and covers both voluntary termination and involuntary termination alike. The book covers: Constitution of a Lease - the essential elements required by Scots Law in order to create a Lease; Break Options - including a detailed analysis of essential cases on service, correct recipients, notice periods, conditionality, apportionment of rent, and errors of content; Irritancy - including a detailed analysis of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1985, and leading cases thereto, on both monetary and non-monetary breaches; Automatic termination (including separate chapters on both confusio and rei interitus); Voluntary termination (Renunciation); and Termination at Natural Expiry and the impact of tacit relocation (including statutory protection and a detailed analysis of the leading cases in this often complex and detailed area of law).

Book Report on Irritancy in Leases of Land

Download or read book Report on Irritancy in Leases of Land written by Scottish Law Commission and published by . This book was released on 2003 with total page 91 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law of irritancy relates to a landlord's entitlement to terminate a lease for land prematurely, usually due to a breach of lease obligations by a tenant, but also if the tenant suffers a change in financial status, such as insolvency, liquidation or receivership. If this happens, the tenant loses the rights under the contract and usually has no grounds for compensation. The report seeks to assess whether the current law strikes the right balance between providing adequate protection to tenants and retaining an effective remedy for breach of contract. The Commission finds that irritancy is a useful remedy which should be retained as it makes Scots property law attractive to investors. However, it recommends that the current law as regulated by the Law Reform (Miscellaneous Provisions) (Scotland) Act 1985 be replaced by a new comprehensive scheme of statutory regulation, covering all leases of land. The right to terminate a lease would require the service of a termination notice on the tenant, rather than taking effect automatically on the occurrence of a breach or other triggering event. The proposals deal with remediable breaches, insolvency events and other cases. The Commission proposes the abolition of any existing rights of relief from the effects of irritancy, with all tenancy protections against termination contained in the statutory scheme.

Book Essays in Conveyancing and Property Law in Honour of Professor Robert Rennie

Download or read book Essays in Conveyancing and Property Law in Honour of Professor Robert Rennie written by Frankie McCarthy and published by Open Book Publishers. This book was released on 2015-05-11 with total page 422 pages. Available in PDF, EPUB and Kindle. Book excerpt: Professor Robert Rennie has been one of the most influential voices in Scots private law over the past thirty years. Highly respected as both an academic and a practitioner, his contribution to the development of property law and practice has been substantial and unique. This volume celebrates his retirement from the Chair of Conveyancing at the University of Glasgow in 2014 with a selection of essays written by his peers and colleagues from the judiciary, academia and legal practice. Each chapter covers a topic of particular interest to Professor Rennie during his career, from the historical development of property law rules through to the latest developments in conveyancing practice and the evolution of the rules of professional negligence. Although primarily Scottish in focus, the contributions will have much of interest to lawyers in any jurisdiction struggling with similar practical problems, particularly those with similar legal roots including the Netherlands and South Africa. As a whole, the collection is highly recommended to students, practitioners and academics.
