It does not pur port to be an exhaustive or elaborate discussion, as such a plan would involve several volumes, instead of one. It is, however, intended to be a means of ready reference to the law on those questions of ordinary routine which the author's experience as a specialist in federal practice has taught him most frequently arise. It is believed that the need exists for a work of this character, notwithstanding the several excellent text-books covering the general subject which go into much greater de tail. The work is designed, also, for use in law schools, where the need of such a treatise seems to be specially apparent. The author has taken great pains to adapt it to this need. In order to render it more available for this purpose, he has inserted in the appendix a table of illustrative cases, which he hopes will be found useful by those teachers who prefer the case system. It has seemed to the author much better and simpler in the discussion of the subject to commence with the inferior courts and follow up through the courts of last resort, though that is not the usual scheme adopted by other text-books on the sub ject. While this plan involves some duplication and cross referencing in case of subjects of which the different federal courts have concurrent jurisdiction, its advantage in enabling the student to trace a case from its inception to its final con elusion is so great as to have convinced the author that it is the best method of treating the subject. Book excerpt: Excerpt from The Law and Procedure of United States Courts The purpose of this book is to give a brief and concise statement of the Organization, Jurisdiction, and Practice of the various courts of our national government. It is not intended to be a complete work in every detail; but rather an elementary work for students in law schools, students in law offices and for young lawyers who have not received systematic instruction on this subject. The object of the chapter on the history of the United States is to remind the student of the circumstances as they existed at the time our government was formed - to recall the principal events in our historical development - so that the constitutional provisions may be interpreted in their true light. In stating the jurisdiction of the courts, I inserted a number of decisions of the Supreme Court. This seemed the best thing to do as the decisions reviewed the various statutes touching the points under consideration; explained what provisions were repealed; the reasons for such repeals; and besides, they give us the law as it exists at the present time under the latest acts of Congress. In conclusion, I wish to state that a knowledge of this branch of the law is more necessary than ever before. The steady increase of litigation, arising from the rapid growth and reaching out of the business of the country, and the bringing of certain questions within Federal control, demands a thorough preparation on this subject. With this in view, I hope this little volume will enable beginners to learn more, work with greater advantage, and be better able to investigate the legal problems that may come to them in their practice. Book excerpt: Excerpt from The Federal Courts: Their Organization, Jurisdiction and Procedure, Lectures Before the Richmond Law School, Richmond College, Virginia The convention which framed the Constitution of the United States could not have completed its purpose, the formation of a more perfect union, without providing for a separate Federal judiciary. The instrument which they framed was a compact between sovereign States, who, parting with many of the attributes of sovereignty, bestowed these upon the government then established. Necessarily, in the course of time, questions would arise between these States and the general government, questions between the departments of the general government, questions also between the States themselves, which could not be submitted for solution to the judicial department of any one State. These questions could only be solved in tribunals created by the general government, whose decisions could bind all the States. To the government created by the Constitution was entrusted the control and management of all relations with foreign governments. It had the sole power of making treaties, of declaring war, of concluding peace. These treaties binding upon all the States could not be construed by one State alone. Ambassadors accredited to the United States present their credentials to and could be recognized by the general government alone. Whilst residing near the government they would be under its protection and could seek redress for wrongs complained of at its hands, and would be responsible only to it for their action. It was bound to furnish tribunals which would consider cases affecting ambassadors, other public ministers and consuls. The Congress was invested with exclusive power to regulate commerce with foreign nations among the several States and with the Indian tribes.
