Materials for the work were chiefly furnished by the investigations of other writers, who, in pursuit of different objects, had already travelled over some portions of the same ground. Since, however, the authority of the Old Testament has been called in question, even by those whose profession bound them to defend it, to trace its influence upon the principles of jurisprudence as a moral science, presented itself as a subject of interest. It was one, at least, that not unnaturally would claim the attention of a person engaged in the practice of the law. Upon this inquiry, therefore, the author employed such leisure as he could spare from his professional pursuits. Book excerpt: Excerpt from An Examination of the Mosaic Laws of Servitude It is obviously important that in all discussions involving emphatic words, having a direct bearing on the issue in question, the ideas intended to be represented by those words should be distinctly stated and clearly comprehended. In the following examination, the word slave will be frequently used, not incidentally nor figuratively, but as expressing a definite idea, and one necessarily connected with the very purpose of the investigation. Hence, unless the idea represented by a Save, and by Slaver, as his legal condition, be understood by the reader, the examination must prove to him vague, confused, and unsatisfactory. These words are often used in a figurative rhetorical sense, as a man is said to be the slave of sin, of passion, of his party, or of his business; and we often hear of political, military, and ecclesiastical Slavery. In such cases, a comparison more or less close is intended to be made with a species of servitude to which these words are legally and technically applied. As we shall use these words only in their strict legal sense, it is necessary that this sense should be unequivocally understood by the reader. For this purpose, it will be sufficient to cite two legal definitions of the word slave, taken from American statutes, viz.: "Slaves shall be deemed chattels personal in the hands of their owners and possessors, and their executors, administrators, and assigns, to all intents, constructions, and purposes, whatever." - 2 Brevard's Digest, 229, S. Carolina. "A slave is one who is in the power of a master to whom he belongs. The master may sell him, dispose of his person, his industry, and his labor. On the contrary, the code made ample pro vision for all these stipulating, however, that such offices must be held as under the Supreme Ruler, and filled by persons obedient to the laws, and ministers of God. As this special feature has been fully treated of by other writers, it need here only be remarked that the Mosaic legislation by no means - as it has been falsely asserted - contemplated a hierarchy. In fact, not only was the tribe of Levi so circumscribed in position that it was utterly impossible for it to arrogate to itself power over the other tribes, but from the time of Moses to that of the Maccabees only one priest, Samuel, is found ruling the Israelites. In conclusion, attention should be directed to a few distino tive features of the Theocracy, and to its special agencies, as illustrated by the history of Israel.
