The purpose of the Game Laws in Brief is to give the provisions which relate to seasons for fish and game, the limitations as to size or number, transportation, non= resident requirements, and other restrictions, for the practical guidance of sportsmen and anglers as to shooting and fishing. Method. The sections are printed in abstract; but better to insure accuracy, the language is that of the original. Thus, the District of Columbia woodcock law is abstracted as indicated by italics: Woodcock. Sec.3. That no person shall kill or expose for sale, or have in his or her possession, either dead or alive any 7 voodcock, bct7vcen the st day of February and the st day of July under a penalty of five dollars for each bird so killed or in possession. Kill or catch, or other term used, takes the place of the more comprehensive formula of the statute catch, kill, injure or destroy, or pursue with such intent, etc. The laws are general in their application. Numerous local laws obtain in certain of the States. The date of enactment given is of the original statute, but the text is given here as amended to date named on last page facing back cover. If no close season is named for a species the law prescribes none. Penalties, prosecutions, duties of officers, jurisdiction of courts, etc, are omitted as outside the purpose of this work. General Provisions. Possession or sale or transportation is always unlawful in the season when it is unlawful to capture game or fish; except that after the open killing season closes some States allow from three days to one month for the sale of game. Netting game fish or catching or killing them by drugs, explosives, dams, or by any mode other than angling with hook and line, is forbidden. Birds other than game (except of prey) are protected at all times. Netting or snaring game birds, or killing by any mode other than shooting is forbidden. Nests and eggs of all birds (except of prey) are protected. Night shooting is generally prohibited. Wild pigeons are protected in a number of States. Federal laws regulate interstate commerce in, and importation of game; the preservation of game in Alaska, the Indian Territory, and the District of Columbia, and on Government reservations. State laws regulate the capture, shipment, and sale of game within State jurisdictions. Canadian laws, like those of the United States, may also be divided into General laws, comprising chie y regulations concerning the export of game; and Provincial laws, corresponding to State laws, which govern the capture, shipment, and sale of game. In some States certain counties have special statutes or are partially or entirely exempt from the operation of the general game laws. In the four States of Maryland, Virginia, North Carolina, and Tennessee, where local statutes are especially popular, there are probably more game laws for the three hundred or more counties than in all the rest of the United States. It should be noted, however, that these local laws are enacted by the States and not by the counties themselves. State legislatures are jealous of their rights in such matters, and, except in Mississippi, seldom delegate even the fixing of game seasons to county boards of supervisors. In many instances these laws do not conform to those of adjoining States or counties, and even in so fundamental a matter as the definition of game there is a noticeable lack of agreement. By imposing a property qualification on sportsmen, they effectively denied all but country gentlemen the right to take game or even to possess a gun. Those who challenged the gentry's monopoly were fined or imprisoned, usually after only a summary hearing by the local justice of the peace. In the early nineteenth century, it was claimed that one out of every four inmates in England's prisons was an offender against the game laws. Bitterly denounced at the time, they have continued to be condemned by historians as arbitrary, savage and unjust. This book is the first full scholarly examination of the English game laws. Based on material drawn from over two dozen archives - including judicial records, estate correspondence and personal diaries - it attempts to explain what the laws actually were, why they were passed, how they were enforced and why they were eventually repealed. The picture which emerges from this investigation challenges the conventional wisdom about the game laws in a number of important respects.
