Book excerpt: The Information Commissioner's responsibilities look set to expand dramatically as a result of EU Data Protection laws and the possible implementation of recommendations about his role made in the Leveson Report. This could result in a funding shortfall of £42.8 million that may have to be paid for by the taxpayer. The removal of the notification fee payable to him by data controllers and other funding cuts could compromise his work unless Government finds a solution. The Information Commissioner has handled more casework and significantly cutting the backlog of freedom of information appeals at the same time as reducing his budget. The funding for freedom of information work was cut by 23% from £5.5 million in 2011-12 to £4.25 million in 2012-13. This report reiterates the Committee's recommendation that the penalties for data protection offences must be increased to provide a more effective deterrent and asks why the Government has not adopted recommendations that custodial sentences should be made available for breaches of section 55 of the Data Protection Act. There are also concerns that a significant number of public sector bodies that handle sensitive private data have refused free audits from the Information Commissioner that could identify security problems in the way they are handling data. The MPs call for compulsory audits to be extended to NHS Trusts and local councils. The Committee also reiterates its view that the Information Commissioner should be granted greater independence from the executive by being made directly responsible to, and funded by, Parliament

Book excerpt: The post of Information Commissioner is one of those identified as eligible for pre-appointment hearings by the Justice Committee. The current Commissioner, Richard Thomas, is due to step down in June 2009 after five years in post, and the preferred candidate to succeed him is Christopher Graham, Director General of the Advertising Standards Authority. The Committee was invited by the Ministry of Justice to report on Mr Graham's suitability for the role, which is to be extended by provisions in the Coroners and Justice Bill going through Parliament. Mr Graham's background clearly provides him with a range of experience indicative of his suitability to be a candidate for the role of Information Commissioner, including familiarity with the regulatory landscape, the development of codes of practice, the potential for judicial review, customer service, assessing compliance, running a large organisation and managing change. In view of the overall challenge facing a new Information Commissioner - an increase of an order of magnitude on what Mr Graham has previously dealt with - the Committee welcomed the opportunity to question him on his view of the priorities and potential approach. The Committee believes the Government should ensure the Commissioner has sufficient resources for its work. The Committee endorses Mr Graham's suitability for appointment as Information Commissioner and his preliminary view of the priorities of the role and its supporting organisation. It looks forward to a continuing dialogue on progress both in protecting people's personal information effectively and sensitively, and in securing implementation of the letter, and the spirit, of the Freedom of Information Act.

Book excerpt: This report examines the EU's response to international terrorism after the Madrid bombings in March 2004, including the European Council declaration and the European Commission's proposals on data exchange and intelligence sharing between law enforcement authorities; data protection issues; EU institutional structures designed to combat terrorism; the international dimension, including the role of Interpol, data transfer and passports; terrorist financing and access to financial databases. Conclusions reached by the Committee include that the EU's role in combating terrorism should remain a co-ordinating one in support of the Member States, which must retain primary responsibility, and the EU should engage with international agencies, particularly Interpol. Given the range of interests involved, effective co-ordination, and the work of the EU Counter-terrorism Co-ordinator, are crucial, and the present proliferation of EU groups and agencies needs to be reduced and streamlined. A uniform data protection regime within the EU would not only provide better data protection but would also facilitate the exchange of information.

These policies have been implemented alongside the creation of working prisons and resettlement prisons, designed to improve the effectiveness of the prison estate in increasing employability and reducing re-offending, as well as the tightening of operational policies on earned privileges and temporary release in order to improve their public credibility. They have also come at a time when the total prison population has returned to very high levels. The Committee expresses concern that despite the Government's efforts to supply sufficient prison places to meet demand, the proportion of prisons that are overcrowded is growing, and the proportion of prisoners held in crowded conditions remains at almost a quarter, with consequent effects on the ability to maintain constructive regimes. The Committee welcomes the reduction which has taken place in the cost of a prison place, although the Committee notes that it remains high, and is unlikely to fall significantly while the pressures on estate capacity remain at current levels

Book excerpt: Since the reforms came into effect, there has been a significant underspend in the civil legal aid budget because the MoJ failed to ensure that those who are eligible for legal aid are able to access it. This has been partly been due to a lack of public information, including information about the Civil Legal Advice telephone gateway for debt advice, and the Committee recommends that the MoJ take prompt steps to redress this. The Committee also concludes that the exceptional cases funding scheme has not worked as Parliament intended. It was supposed to act as a safety net, protecting access to justice for the most vulnerable. The Committee expects the MoJ to react rapidly to ensure that the scheme fulfils Parliament's intention that the most vulnerable people are able to access legal assistance. The Government's reforms have led to an increase in the number and a change in the profile of litigants in person: increasingly these are people who have no choice but to represent themselves, and who may thus have difficulty in doing so effectively: although many tribunals are accustomed to dealing with unrepresented litigants the courts have to expend more resources in order to assist them. The MoJ has not been able to demonstrate that it has achieved value for money for the taxpayer. Although significant savings have been achieved, efforts to target legal aid at those who most need it have focused on intervention aimed at the point after a crisis has already developed, rather than on prevention.
