The economic devastation left behind is well-known, but some allege that even more lasting harm was inflicted on America's rule of law tradition and government legitimacy by the ambitious attempts to limit the fallout. In probing these claims, Wallach offers a searching inquiry into the meaning of the rule of law during crises. The book provides a detailed analysis of the policies undertaken—from the rescue of Bear Stearns in March 2008 through the tumultuous events of September 2008, the passage of the TARP and its broad usage, the alphabet soup of emergency Federal Reserve programs, the bankruptcies of Chrysler and GM, and the extended public ownership of AIG, Fannie Mae, and Freddie Mac. Throughout, Wallach probes the legal bases of the government's actions and explores why concerns about the legitimacy of government actions were only sporadically grounded in concerns about legality—and sometimes ran directly against them. The public's sense that government officials operated through ad hoc responses that favored powerful interests has helped bring the legitimacy of American governmental institutions to historic lows. Wallach's book recommends constructive and sensible reforms policymakers should take to ensure accountability and legitimacy before the government faces another crisis.

Presenting important new findings, she offers the first empirical study to take up the question of representation from both sides of the constituent-representative relationship. The first half of the book examines whether black members of the U.S. House legislate and represent their constituents differently than white members do. Representation is broadly conceptualized to include not only legislators' roll call voting behavior and bill sponsorship, but also the symbolic acts in which they engage. The second half looks at the issue of representation from the perspective of ordinary African Americans based on a landmark national survey. Tate's findings are mixed. But, in the main, legislators' race does shape how they represent their constituents and how constituents evaluate them. African Americans view black representatives more positively than they do white representatives, even those who belong to their own political party. Black legislators, however, are just as likely as white representatives to sponsor and gain passage of bills in the House. Tate also concludes that black House members are more liberal as a group than are their black constituents, but that there is considerable divergence in the quality and type of representation they provide. The findings reported here will generate controversy in the fields of politics, law, and race, particularly as debate commences over renewing the Voting Rights Act, which is set to expire in 2007.

Book excerpt: When members are elected to the House of Representatives they have a certain freedom to decide how they will act as members and how they will build their reputations. Just as in the market place entrepreneurs build businesses, so in the House of Representatives members have the freedom to choose to build legislative programs that will enhance their reputations in the institution. And yet entrepreneurship is also costly to members. Gregory Wawro explains why members of the House engage in legislative entrepreneurship by examining what motivates them to acquire policy knowledge, draft legislation, build coalitions, and push their legislation in the House. He considers what incentives members have to perform what many have perceived to be the difficult and unrewarding tasks of legislating. This book shows how becoming a legislative entrepreneur relates to members' goals of reelection, enacting good public policy, and obtaining influence in the House. The analysis differs from previous studies of this behavior, which for the most part have employed case study methods and have relied on anecdotal evidence to support their arguments. Wawro analyzes legislative entrepreneurship in a general and systematic fashion, developing hypotheses from rational-choice-based theories and testing these hypotheses using quantitative methods. Wawro argues that members engage in legislative entrepreneurship in order to get ahead within the House. He finds that the more legislative entrepreneurship that members engage in, the more likely it is that they will advance to prestigious positions. This book is of interest to students of Congress, legislative behavior and institutions, elections, and campaign finance.
