Book excerpt: Since the beginnings of the oil industry, production activity has been governed by the 'law of capture,' dictating that one owns the oil recovered from one's property even if it has migrated from under neighboring land. This 'finders keepers' principle has been excoriated by foreign critics as a 'law of the jungle' and identified by American commentators as the root cause of the enormous waste of oil and gas resulting from U.S. production methods in the first half of the 20th century. Yet while in almost every other country the law of capture is today of marginal significance, it continues in.

Book Finders Keepers

Download or read book Finders Keepers written by Seamus Heaney and published by Farrar, Straus and Giroux. This book was released on 2014-02-04 with total page 468 pages. Available in PDF, EPUB and Kindle. Book excerpt: Whether autobiographical, topical, or specifically literary, these writings circle the central preoccupying questions of Seamus Heaney's career: "How should a poet properly live and write? What is his relationship to be to his own voice, his own place, his literary heritage and the contemporary world?" Along with a selection from the poet's three previous collections of prose (Preoccupations, The Government of the Tongue, and The Redress of Poetry), the present volume includes Heaney's finest lectures and a rich variety of pieces not previously collected in volume form, ranging from short newspaper articles to radio commentaries. In its soundings of a wide range of poets -- Irish and British, American and Eastern European, predecessors and contemporaries -- Finders Keepers is, as its title indicates, "an announcement of both excitement and possession."

Book Discovery Capitalism and Distributive Justice

Download or read book Discovery Capitalism and Distributive Justice written by Israel M. Kirzner and published by Collected Works of Israel M. K. This book was released on 2016 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Discovery, Capitalism, and Distributive Justice makes Kirzner's case for the idea that entrepreneurial profit is both essential for an economy and profoundly just. Asserting that the problem with standard criticism of capitalist income distribution is a failure to see capitalism as a "discovery procedure," Kirzner argues that production and subsequent profit are neither automatic nor guaranteed. This important contribution to the larger debate of the capitalist system clarifies core economic issues, so that the positive science of economics can enlighten our understanding of justice in capitalist distribution. Successful production always results from the discovery of an opportunity to obtain new gains from trade, i.e., the discovery of entrepreneurial profit. Kirzner shows that profit is the just and fair possession of its discoverer. This is what he calls the "finders-keepers" rule: "The finders-keepers rule asserts that an unowned object becomes the justly owned property of the first person who, discovering its availability and its potential value, takes possession of it." Richard Ebeling reviewed the work in 1989, saying, "the heart of Professor Kirzner's argument is that every discovery of a new opportunity is the appropriation of that which had not existed before a human mind had seen the potential in that object." Kirzner's monograph is complemented here by three important articles on the subject of economic justice, a critique of Kirzner's theory, and a reply from Kirzner to that critique. Kirzner's finders-keepers rule of entrepreneurial profit and market distribution stands as one of the foremost defenses of the distribution of income and profit in the free-enterprise system. Israel M. Kirzner is a leading economist in the Austrian School and Professor Emeritus of Economics at New York University. Peter J. Boettke is University Professor of Economics and Philosophy at George Mason University and the BB&T Professor for the Study of Capitalism at the Mercatus Center. His publications include Living Economics, The Handbook of Contemporary Austrian Economics, and The Elgar Companion to Austrian Economics. He has been the editor of The Review of Austrian Economics since 1998. Frédéric Sautet is Associate Professor at The Catholic University of America, School of Business and Economics. He is a specialist in Austrian market process theory and teaches entrepreneurship studies. He has taught at George Mason University of Paris Dauphine. He is the author of An Entrepreneurial Theory of the Firm and has published widely on entrepreneurship.

Only by joining forces with Kaidee can Devin complete the mission to bring Trip back alive. And only by breaking every rule can these two renegades redeem the promise of a passion they were never permitted to explore. At risk? A political empire, a personal fortune, and both their hearts and lives. From the Paperback edition.

Book Property and the Law of Finders

Download or read book Property and the Law of Finders written by Robin Hickey and published by Bloomsbury Publishing. This book was released on 2010-01-20 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are finders keepers? This most simple of questions has long evaded a satisfactory legal answer. Generally it seems to have been accepted that a finder acquires a property right in the object of her find and can protect it from subsequent interference, but even this turns out to be the baldest statement of principle, resting on obscure and confused authority. This first full-length treatment of finders sets them in their legal-historical context, and discovers a fascinating area of law lying at the crossroads of crime, obligations, and property. That on the same facts a finder might be thief, bailee, and/or property right holder has clouded our conceptual analysis, and prevented us from stating simply our rules about finding. Nonetheless, when the applicable doctrines and policies of our property law (particularly the central concept of possession) are explored and understood in the light of countervailing rules of crime and tort, we can argue confidently that, despite centuries of doubt and confusion, English law has succeeded in producing a body of law that is theoretically and practically coherent. Property and the Law of Finders makes this argument, and will appeal to anyone specifically interested in the law of personal property, and also to those with broader concerns about the evolution of common law concepts and their ability to yield workable, practical solutions.
