Book The EU Sugar Regime and Forthcoming WTO Obligations

Download or read book The EU Sugar Regime and Forthcoming WTO Obligations written by Ellen Huan-Niemi and published by . This book was released on 2003 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: The structure of the European Union (EU) sugar regime has been under tremendous pressure internally and externally for major reforms. The EU sugar regime has avoided major reforms during the review in year 2001, but it may not be able to avoid major reforms by year 2006 after its midterm review in year 2003. The coming new WTO round in agriculture will pressure the EU sugar regime for further reforms because the EU is sensitive to further tariff reductions and may encounter problems in its border protection for sugar. The EU may resolve its problem in exporting sugar with export subsidy by cutting its production quotas and limiting sugar production after EU enlargement by imposing strict production quotas, along with growth in the EU sugar consumption.

Book The WTO Law of Subsidies

Download or read book The WTO Law of Subsidies written by Marc Benitah and published by Kluwer Law International B.V.. This book was released on 2019-05-23 with total page 728 pages. Available in PDF, EPUB and Kindle. Book excerpt: Subsidies are arguably the dominant theme in International Economic Law. A prolific case law has been elaborated by WTO Panels and Appellate Body in response to the multitude of complaints lodged in the past two decades (Softwood Lumber, Airbus, Boeing, etc.) Unfortunately, it is possible to be overwhelmed by the complexity of this case law. This book provides a comprehensive approach in response to this complexity. First, it avoids unnecessary legal jargon, making it accessible to a large public. Second, it adopts a comprehensive and progressive approach where legal subtleties are not avoided but presented at the right moment and the right place. The reader is therefore not overwhelmed from the outset by a multitude of details. The first Part of the book adopts the perspective of a WTO Member seeking to counter an alleged subsidy granted by another Member. To this end, this first Part scans and analyzes in detail all WTO Agreements, containing cumulative disciplines and remedies relating to subsidies. Therefore, it is not only the SCM Agreement that is scanned and analyzed but also the Agreement on Agriculture (AoA), GATT 1994, and even the 1980 Agreement on Trade in Civil Aircraft (ATCA). The second Part of the book adopts the perspective of a WTO Member accused of granting subsidies violating subsidies disciplines. To this end, an original classification is offered of the various strategies that can be used by this Member. For this purpose, a distinction is made between the “threshold strategy” where the existence of a challengeable subsidy is recused from the outset, the “denying violation of disciplines strategy,”the “exemption or exception strategy,” the “procedural and evidentiary strategy,” and finally the “implementing strategy.” The last Part of this book, which could turn out to be the most useful for the community of agents concerned by subsidies, offers an original examination of pending legal issues. To this end, a relevant distinction is established between pending legal issues partially answered by present case law and pending legal issues not still answered by present case law. This case law and the norms disciplining subsidies in WTO Agreements are of utmost importance first for International Trade Ministries, Parliaments, and International Institutions (OECD, CNUCED, FAO, etc.). However, Non-Governmental Organizations (World Wide Fund, etc.) are also directly concerned by this topic regarding, for example, fisheries subsidies and their impact on overexploitation of marine resources. The private sector (fishing fleets, fishermen, extractive industries, etc.) is also affected by this topic particularly regarding future investments.Law firms involved in subsidies cases are naturally at the forefront of the community of agents concerned by this topic.

Book Supplying Compliance with Trade Rules

Download or read book Supplying Compliance with Trade Rules written by Alasdair R. Young and published by Oxford University Press. This book was released on 2021-09-28 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: Trade agreements have become politicized in part because of public concerns that trade rules constrain regulatory decisions. How much international obligations constrain state behaviour, however, is contested in the International Relations literature. This book seeks to explain whether, why, and how jurisdictions comply with inconvenient international obligations. It does so through detailed process tracing of European Union (EU) policies found incompatible with World Trade Organization (WTO) rules: its ban on hormone-treated beef, its banana trade regime, its moratorium on the approval of genetically modified crops, its sugar export subsidies, and its anti-dumping duties on bed linen from India. It uses the adverse rulings as the 'treatment' in a 'natural experiment', contrasting the policy-relevant politics before and after each ruling. The case studies are supplemented by a qualitative comparative analysis of all EU policies found to contravene WTO rules that had to be changed by the end of 2019. The book contributes to debates on the impact of international institutions, on the effectiveness of the WTO, and on the nature of the EU as an international actor. It argues that the preferences of policy makers (the 'supply' of policy change) matter more than demands from societal actors in determining whether compliance occurs. It also argues that while policy change in response to adverse WTO rulings is the norm (good news for trade), WTO members do resist obligations that would compromise cherished policy objectives (good news for legitimacy). This volume contends that the EU's compliance performance is like that of most WTO members; it is not a unique international actor.

Book excerpt: This book critically analyses the World Trade Organization’s approach to "special and differential treatment" (SDT) to argue that it is founded on seeking exemptions from WTO obligations, instead of creating an enabling environment for developing countries to integrate fully into the multilateral trading system. Through six key sections: United States Proposal on Special and Differential Treatment Responses to United States Proposal The Evolution of Differential Treatment Failure of the Current Approach to Differential Treatment Complications Created by China’s Emergence in the Global Economy An Alternative Approach to Differential Treatment this book explores how, by adopting a new evidence-based, case-by-case approach to SDT, the development of the poorest countries can best be advanced, while at the same time ensuring that advanced developing countries carry their weight in the organization. It will be of interest to scholars and students of international trade law and political science, as well as trade practitioners such as lawyers, diplomats, and analysts.

Book Trade Agreements Multifunctionality and EU Agriculture

Download or read book Trade Agreements Multifunctionality and EU Agriculture written by Eleni Kaditi and published by CEPS. This book was released on 2006 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume is the result of research and exchange activities within the European Network of Agricultural and Rural Policy Research Institutes (ENARPRI). It synthesizes various analyses related to EU agricultural policies, trade agreements, and the issue of multifunctionality. The book focuses on the impact of regional, bilateral, and multilateral trade agreements that the EU has concluded or is in the process of negotiating, as well as on the interaction between EU policies and trade agreements, in the context of multifunctionality and sustainable development. Most of the trade agreements examined are extremely complex and impact not only efficiency and growth, but also income and welfare distribution within the EU. Special attention is given to the effects of possible WTO negotiation outcomes on the EU and third countries, as well as on the impact of the EuroMed trade proposals and agreements on trade flows and economic development of the EU's trading partners in the Mediterranean.
