At the same time, we are becoming increasingly aware of the ethical implications of new and emerging technologies. Whether it is the use of remote weapons like drones as part of counter-terrorism strategies, the application of surveillance technologies to monitor and respond to terrorist activities, or counterintelligence agencies use of machine learning to detect suspicious behavior and hacking computers to gain access to encrypted data, technologies play a significant role in modern counter-terrorism. However, each of these technologies carries with them a range of ethical issues and challenges. How we use these technologies and the policies that govern them have broader impact beyond just the identification and response to terrorist activities. As we are seeing with China, the need to respond to domestic terrorism is one of the justifications for their rollout of the “social credit system.” Counter-terrorism technologies can easily succumb to mission creep, where a technology’s exceptional application becomes normalized and rolled out to society more generally. This collection is not just timely but an important contribution to understand the ethics of counter-terrorism and technology and has far wider implications for societies and nations around the world.

Book excerpt: In this book Uwe Steinhoff describes and explains the basic tenets of just war theory and gives a precise, succinct and highly critical account of its present status and of the most important and controversial current debates surrounding it. Rejecting certain in effect medieval assumptions of traditional just war theory and advancing a liberal outlook, Steinhoff argues that every single individual is a legitimate authority and has under certain circumstances the right to declare war on others or the state. He also argues that the just cause cannot be established independently of the other criteria of jus ad bellum (the justification of entering a war), except for right intention, which he interprets more leniently than the tradition does. Turning to jus in bello (which governs the conduct of a war) he criticises the Doctrine of Double Effect and concludes that insofar as wars kill innocents, and be it as "collateral damage", they cannot be just but at best justified as the lesser evil. Steinhoff gives particular attention to the question why soldiers, allegedly, are legitimate targets and civilians not. Discussing four approaches to the explanation of the difference he argues that the four principles underlying them all need to be taken into account and outlines how their weighing can proceed if applied to concrete cases. The resulting approach does not square the distinction between legitimate and illegitimate targets with the distinction between soldiers and civilians, which has extremely important consequences for the conduct of war. Finally, Steinhoff analyses the concept of terrorism and argues that some forms of "terrorism" are actually no terrorism at all and that even terrorism proper can under certain circumstances be justified. At the same time, war's fragile moral potential is acknowledged and its causes sought. The argument is conducted from a traditional just war standpoint which balances rules or principles against the moral capacities and dispositions of belligerents and the particular circumstances in which they act. In this enlarged second edition, a new introduction addresses the common criticism that traditional just war theory is incoherent, outmoded, and in need of radical revision. Many of the problems attributed to the tradition by 'revisionists' are seen to derive from a distortion and oversimplification of the historical tradition. A fuller and more accurate understanding of that tradition can mitigate, or even resolve, these problems. It can also help to fill the gaps left in the ethical agenda of war by analytic ethics. Part I compares the conception of just war with realism, militarism and pacifism. Part II examines the principles of just recourse and just conduct with the aid of real life examples. Book excerpt: During the Cold War - an era in which the term ‘asymmetric warfare’ was not well known - the issue of the laws and ethics of war seemed simple enough to most soldiers, being concerned mainly with leadership, management, and morale. Post-Cold War reality revealed a very different set of challenges, including a significantly wider moral dimension, particularly when forces, initially under UN leadership and later under the NATO flag, were deployed in different parts of the turbulent Balkans. Military observers, by now with legal advisers close by, watched events in the Balkans, East Timor and then in central and West Africa with professional interest, and some were involved there. A few years later, soldiers were subsequently caught as much by surprise by the events of 9/11, a graphic example of asymmetric warfare, as most of the rest of the world. The initial, post 9/11 response in Afghanistan and Iraq brought the notion of the fragile or collapsed state, and the blurring of the roles of military forces, international organisations, non-governmental organisations, non-state actors, and indigenous administrators and their uniformed organisations, and with them the moral dilemmas, to much wider notice. More recent conflicts have indeed shown the need for commanders and soldiers in all types of conflict to have a much better understanding of the complex moral and legal environments, and opened new debates about the principle of ‘winning hearts and minds’ in counter-insurgency and peace support operations. Moreover, technological superiority by the West has also produced mixed benefits in the field of military operations, and posed additional dilemmas, many of them moral. The trend towards defining human rights and ‘fundamental freedoms’ poses further questions for the soldier today. This collection of essays, written by a wide variety of practising experts and scholars, touches on all these issues. It links the medieval traditions of jus in bello, codified by Saint Thomas Aquinas in the Christian Church nearly eight centuries ago, to examination of modern challenges and moral dilemmas relating to the ethics and laws of conflict and crises of all types in the twenty-first century, and in a global context among people of many different faiths and beliefs, and none.
