Book excerpt: The rapid expansion of environmental programs over the past few years has required a new look at the role local government can play in environmental enforcement. A review of the authority of local governments in Minnesota in the environmental area indicates that the legal basis for undertaking a larger enforcement role in most environmental programs already exists. Further, local governments have extensive experience in enforcing several environmental laws. Given the combination of legal authority and experience, it is appropriate to consider an expanded local government role in enforcement. It is, however, important to look at the size and capabilities of local governments and to look at the nature of the environmental law sought to be enforced when considering an expanded role for local government. The article suggests a set of factors that should be considered in thinking about the expansion of the role of local governments in environmental enforcement.
