Book excerpt: This study provides an impact analysis of federal regulations on foreign student enrollment at three distinct U.S. higher education institutions. The two major pieces of legislation affecting international study in the U.S. are the Immigration & Naturalization Act of 1952 and the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRAIRA). The INA is enveloped in IIRAIRA due to the latter amending the former. Thus, they are companion pieces of legislation that overlap and reinforce one another. Because of the public outcry following the events of September 11, both laws were amended by the Enhanced Border Security and Visa Entry Reform Act of 2002 and the USA Patriot Act of 2001. However, while the above acts are related to IIRAIRA, they do not significantly change the legislation. Thus, the major focus of this study is on IIRAIRA. In addition to providing an analysis of the impact of the policy regulations on foreign student enrollments, specific areas of impact will include the impact of the Student and Exchange Visitor Information System.

Book excerpt: Top immigration issues before the 107th Congress include the reorganization of the Immigration and Naturalization Service (INS), a part of the Department of Justice (DOJ); admissions policy; and the eligibility of noncitizens for public assistance. Also pending are measures to enable unauthorized aliens to become legal permanent residents (LPRs) and to reform temporary guest worker programs. On July 26, 2002, the House passed a bill to create a new homeland security department (H.R. 5005). Under the bill, INSâ€TMs enforcement functions would be transferred to the new department, while INSâ€TMs service functions would remain in DOJ in a new bureau. In September and early October, the Senate considered, but did not vote on, H.R. 5005. Amendments proposed in the Senate would create a directorate of immigration affairs within the new department with responsibility for immigration service and enforcement functions. The Administration has proposed transferring all of INS to a new homeland security department under a border and transportation security division. Admissions policy, particularly responsibility for issuing visas, is a key issue in discussions about establishing a homeland security department. The State Department currently has authority over visa issuances. Under H.R. 5005, as passed by the House, and the Lieberman substitute amendment to H.R. 5005, the homeland security department and the State Department would each have some responsibilities for visa issuances. Congress is addressing noncitizen eligibility for public assistance in the context of bills to reauthorize federal public benefit programs. The “farm billâ€ŗ (P.L. 107-171) expands eligibility for food stamps for certain classes of LPRs. H.R. 4737 would reauthorize Temporary Assistance for Needy Families. The House-passed version would not change the eligibility rules for noncitizens. The substitute version of H.R. 4737 reported by the Senate Finance Committee, however, would give states the option to use TANF funds to assist all LPRs. The reauthorization of the Medicaid program is the subject of separate legislation. The 107th Congress also has considered legislation (H.R. 1885) to enable certain unauthorized aliens in the United States to adjust to LPR status. This legislation would extend a provision of the Immigration and Nationality Act â€" §245(i) â€" that currently covers illegal aliens whose sponsors filed petitions or applications on their behalf by April 30, 2001. H.R. 1885 has been passed in different forms by the House and Senate. Other pending bills would establish mechanisms to allow particular groups of unauthorized aliens â€" such as agricultural workers and students â€" to become LPRs. Temporary guest worker programs are also the subject of pending bills. Among these bills are measures that would make significant changes to the H-2A program for foreign agricultural workers and the H-1C program for foreign nurses. Congress has enacted various pieces of immigration-related legislation to date. In addition to the farm bill mentioned above, the most significant of these measures address immigration-related counterterrorism and security issues. Both the USA PATRIOT Act (P.L. 107-56) and the Enhanced Border Security and Visa Entry Reform Act (P.L. 107-173) contain provisions on border security, admissions policy, and foreign students.

Book excerpt: Since the September 11, 2001 terrorist attacks, considerable concern has been raised because the 19 terrorists were aliens who apparently entered the United States with temporary visas despite provisions in immigration laws that bar the admission of terrorists. Foreign nationals not already legally residing in the United States who wish to come to the United States generally must obtain a visa to be admitted, with certain exceptions noted in law. The report of the 9/11 Commission maintained that border security was not considered a national security matter prior to September 11, and as a result the State Department's consular officers were not treated as full partners in counterterrorism efforts. The 9/11 Commission has made several recommendations that underscore the urgency of implementing legislative provisions on visa policy and immigration control that Congress enacted several years ago. Bills implementing the 9/11 Commission recommendations (S. 2845, H.R. 10, S. 2774/H.R. 5040, and H.R. 5024) had various provisions that would affect visa issuances. As enacted, the Intelligence Reform and Terrorism Prevention Act of 2004 (P.L. 108-458) further broadens the security and terrorism grounds of inadmissibility to exclude aliens who have participated in the commission of acts of torture or extrajudicial killings abroad or who are members of political, social, or other groups that endorse or espouse terrorist activity. It also includes provions to deploy technologies (e.g., biometrics) to detect potential terrorist indicators on travel documents; establish an Office of Visa and Passport Security; and train consular officers in the detection of terrorist travel patterns. The conferees retained the provision on visa revocation as a ground of inadmissibility but permit limited judicial review of removal if visa revocation is the sole basis of the removal. The 107th Congress expanded the definition of terrorism and the designation of terrorist organizations used to determine the inadmissibility in the USA Patriot Act (P.L. 107-56). Another law, the Enhanced Border Security and Visa Entry Reform Act (P.L. 107-173), mandated data sharing so that consular officers have access to relevant electronic information, required the development of an interoperable electronic data system to be used to share information relevant to alien admissibility, and required that all visas issued by October 2004 have biometric identifiers. The Homeland Security Act (P.L. 107-296) transferred to the new Department of Homeland Security the authority to issue regulations regarding visa issuances and assigns staff to consular posts abroad. The Department of State's Bureau of Consular Affairs remains the agency responsible for issuing visas. Meanwhile, nonimmigrant (i.e., temporary) visas issued abroad dipped to 4.9 million in FY2003 after peaking at 7.6 million in FY2001. Preliminary FY2004 data indicated 5.0 million nonimmigrant visas were issued. This slowdown in visa issuances has sparked concern among the business community, some of whom argue they are adversely affected by the new visa policies. Others are expressing scepticism about the cost, time, and complexity of developing interoperable databases, a feature many others see as essential to enhanced border security.
