Book New Developments in EU and International Copyright Law

Download or read book New Developments in EU and International Copyright Law written by Irini A. Stamatoudi and published by Kluwer Law International B.V.. This book was released on 2016-02-23 with total page 522 pages. Available in PDF, EPUB and Kindle. Book excerpt: More than a source of income and a means of protection for creators, rightholders, and the creative and entertainment industries, copyright is also a vehicle for technological advances and economic development. In the European Union, industries with intensive emphasis on intellectual property rights (mainly copyright) generate more than a quarter of employment and more than a third of economic activity. Yet copyright continues to be plagued by problematic attempts to balance the interests of rightholders, the public, consumers, intermediaries, collecting societies, different national legal traditions, and other forces, European and global. This book draws a comprehensive picture of current, pending, and proposed copyright developments – legislation, ‘communications,’ white papers, and court decisions – at the levels of the European Union and the World Intellectual Property Organization. Twenty-two well-known and prestigious experts on intellectual property law from seventeen jurisdictions worldwide contribute essays on particular trends in copyright, including discussions of the following and more: - making content available in an EU digital single market; - collective management and multi-territorial licensing; - exceptions for libraries and archives, education and research; - traditional knowledge and cultural expressions; - unjustified geoblocking; - illegal content on the Internet; - text and data mining; - copyright enforcement online; and - role of the European Court of Justice. Policy recommendations are also set forth, as well as a detailed conceptual framework for a potential EU Copyright Code. As a detailed and thoughtful overview of current trends in copyright internationally, this book has no peers. It is sure to be welcomed by practitioners, policymakers, academics, researchers, and business leaders for whom intellectual property rights, and especially copyright, are of the first importance.

Book The European Union Digital Single Market

Download or read book The European Union Digital Single Market written by Łukasz Dawid Dąbrowski and published by Routledge. This book was released on 2022-03-21 with total page 175 pages. Available in PDF, EPUB and Kindle. Book excerpt: According to the European Commission, two recent policies: the Digital Service Act and the Digital Market Act will allow for the regulation of a significant part of the EU Digital Single Market (DSM), to an extent similar to the creation of the traditional internal market in the early 1990s. The provisions are intended to improve conditions in the EU DSM to ensure that the market is as free and fair as it is safe for users of the digital economy. This interdisciplinary book analyses the impact of digital technologies on specific markets and, more broadly, the society and the economy. It identifies and assesses the different features, challenges, trends and dimensions of the EU DSM, from a legal and economic viewpoint, and also from a Polish perspective. Poland is presented as one of the EU countries participating in the creation of the EU DSM and is analysed alongside the average, as well as the best and the worst performing EU member states and compared with other non-EU members. The book addresses several broad areas in which the implications of digitalisation are particularly visible, and which are important to the average person: giant online platforms, freedom of speech, e-commerce, digital levy, energy infrastructure, and the labour market. The authors have presented opportunities and threats related to the functioning of the digital market. These opportunities and threats are typical of highly developed countries while reflecting the specific features of the EU DSM. The starting point of the considerations are the diverse experiences of the EU member states. The book adds a voice to the public debate on the role of the digital economy in the contemporary world and will be a useful guide for students and researchers in economics, law, and international relations. Chapters 1 and 2 of this book are available for free in PDF format as Open Access from the individual product page at ww.routledge.com . They have been made available under a Creative Commons Attribution-Non Commercial-No Derivatives 4.0 license.

Book excerpt: So how can we in Europe gain the most from the internet? How can we ensure that member states of the European Union grow and prosper in what are still the early stages of the age of the internet? The European Commission announced the Digital Agenda for Europe just over a year ago in conjunction with the Europe 2020 Strategy. [...] The Digital Agenda names seven of the "most significant obstacles" impeding the creation of a single digital market and standing in the way of innovation and growth. [...] Key themes discussed at the round table included: The consumer's interest in IPRs and standards; The industry's perspective on IPRs and standards (proprietary and open); The institutional perspective on IPRs; The collaboration between IP bodies and standard setting organizations (SSOs); Promoting competition and innovation in a new world of standards; and The implication of standards on the. [...] Panel 2: The Economic and Political Impacts of the Arab Spring and the Japan Earthquake This panel debated the issue of the global economy; it discussed the situation and plans for recovery of Japan after the earthquake; the Arab Spring and its consequences in the area and in the rest of the world; and also the enlargement of the European Union. [...] Fukuyama argued that the end of the Cold War and the onset of Western liberal democracy implied the end of humanity's sociocultural evolution and the ultimate form of human government.

Available in PDF, EPUB and Kindle. Book excerpt: This volume brings together papers that offer methodologies, conceptual analyses, highlight issues, propose solutions, and discuss practices regarding privacy and data protection. It is one of the results of the eight annual International Conference on Computers, Privacy, and Data Protection, CPDP 2015, held in Brussels in January 2015. The book explores core concepts, rights and values in (upcoming) data protection regulation and their (in)adequacy in view of developments such as Big and Open Data, including the right to be forgotten, metadata, and anonymity. It discusses privacy promoting methods and tools such as a formal systems modeling methodology, privacy by design in various forms (robotics, anonymous payment), the opportunities and burdens of privacy self management, the differentiating role privacy can play in innovation. The book also discusses EU policies with respect to Big and Open Data and provides advice to policy makers regarding these topics. Also attention is being paid to regulation and its effects, for instance in case of the so-called ‘EU-cookie law’ and groundbreaking cases, such as Europe v. Facebook. This interdisciplinary book was written during what may turn out to be the final stages of the process of the fundamental revision of the current EU data protection law by the Data Protection Package proposed by the European Commission. Book excerpt: In this book, Steffen Lange and Tilman Santarius investigate how digitalization influences environmental and social sustainability. The information revolution is currently changing the daily lives of billions of people worldwide. At the same time, the current economic model and consumerist lifestyle needs to be radically transformed if society is to overcome the challenges humanity is facing on a finite planet. Can the much-discussed disruption potential of digitalization be harnessed for this purpose? Smart Green World? provides guiding principles for a sustainable digital society and develops numerous hands-on proposals for how digitalization can be shaped to become a driving force for social transformation. For instance, the authors explain why more digitalization is needed to realize the transition towards 100% renewable energy and show how this can be achieved without sacrificing privacy. They analyze how the information revolution can transform consumption patterns, mobility habits and industry structures – instead of fostering the consumption of unneeded stuff due to personalized commercials and the acceleration of life. The authors reveal how Artificial Intelligence and the Industrial Internet of Things pose novel environmental challenges and contribute to a polarization of income; but they also demonstrate how the internet can be restored to its status as a commons, with users taking priority and society at large reaping the benefits of technological change in a most democratic way. Providing a comprehensive and practical assessment of both social and environmental opportunities and challenges of digitalization, Smart Green World? Making Digitalization Work for Sustainability will be of great interest to all those studying the complex interrelationship of the twenty-first-century megatrends of digitalization and decarbonization.
