Once you understand the link between a referral to “In-School-Suspension (ISSwarehousing students) or a referral for Out-of-School Suspension (OSS—push out of students) you will realize that in most cases suspension can lead directly to the prison industrial complex for our young women and men. Stopping this from happening to your student may depend on how well you are prepared to advocate for your child. We must not allow suspension to push out our children because ostensibly it may be ensuring them a life sentence of unemployment, crime, or even death. We say it starts at home with the parents, so if we can better understand our student’s rights and the rights we have as parents we can better prepare ourselves to advocate for our student and to hold the school district accountable for the Education of Our Children!

This text focuses on procedural aspects of the expulsion and suspension of students. It is devoted to the elementary and secondary public-school settings involving regular-education students. It describes how the constitutional basis for due process for students can be traced to the 14th Amendment, which states that a person cannot be deprived of life, liberty, or property without due process. The "Goss" decision established that a student's education is a property interest. The text looks at requirements for giving notice of long-term suspensions and expulsions, the timeliness of hearings, the persons who should receive notice, and location of the student pending the hearing. It outlines what should happen in the formal hearing, issues surrounding self-incrimination and the right to remain silent, the Miranda warning for students, double jeopardy, the public hearing, and the right to counsel. The book also provides information on access to evidence, sufficiency of evidence, voluntary confessions, imposing penalties, witnesses, and recording the hearing. Short-term suspensions are treated separately, and special concerns such as inschool suspensions, school-bus suspensions, timeliness of suspensions, and suspensions from extracurricular activities are addressed. Book excerpt: The purpose of the current study was to determine educational leaders' perceptions of effective strategies for keeping long-term suspended students engaged in learning. As school districts struggle with best practices to reduce dropouts and increase graduation rates, they look to ensure that suspended students remain focused on education. A Q-Sort methodology was employed that allowed 40 participants, each a principal of a school district, to sort cards that contained a list of effective strategies. The study involved an investigation of the best practices to keep students engaged while serving a long-term suspension, practices that were developed from the literature as well as from practicing school educators. A set of working strategies was generated for further examination. Educators "sorted" these strategies for quantitative analysis, and a selection was interviewed for qualitative analysis. Finally, data was collected and analyzed from educators regarding their perceptions and experiences of the effective strategies. Findings revealed four emergent factors from the participants' understanding of the most effective strategies for keeping long-term suspended students engaged. Participants valued the importance of a strategy that places students in a separate physical site while serving their suspension, as well as programs that individually support each student to meet their unique needs (Factor One). Additionally, the principals in the study believed that placing an emphasis on building positive adult and peer relationships is an effective strategy to keep long-term suspended students engaged in school, including utilizing outside agencies, social workers, and counselors as needed (Factor Two). Strategies that allow the long-term suspended student to keep pace with their coursework were also believed by the participants to be effective (Factor Three) in allowing for on-time graduation. Finally, principals felt strongly about not giving up their efforts to redirect long-term suspended students' behavior and address individual needs, and were supportive of strategies that remove the long-term suspended student from their base school while maintaining consistent communication with the student, school, and family (Factor Four). Implications and recommendations for practice, policy, and research that emerged from the study are discussed.

Book excerpt: Exclusionary discipline policies in K-12 public schools have faced severe scrutiny over the past two decades due to the injurious effects on students' lives. Elevated drop-out rates, anti-social behavior, alienation from peers and school staff, along with lagging behind academically is a sampling of the devastating outcomes students face who are suspended or expelled from school. In March of 2020, during the onset of COVID-19, school systems had a rare opportunity when faced with having to provide remote instruction to the masses of school age students. This mixed methods study relied on principal interviews and teacher survey data to explore perceptions of the intended and unintended consequences of existing policies governing suspension and expulsion in one urban district in Southwestern Ohio. Perceptions of participants were assessed regarding the potential utility of remote learning to mitigate learning loss among students suspended out of school or expelled. Findings from the study were mixed. Differences exist between perceived intended and actual consequences of both out of school suspension and expulsion among educators in this study. Teachers and principals differed with respect to their support for utilizing remote learning to reduce learning loss of students excluded from school due to disciplinary reasons. Extrapolation of results beyond participants in this study is limited due to study design and the low response rate. Additional research on the actual impacts of suspension and expulsion is needed to inform the debate.
