Book excerpt: The Department of Defense recently announced it has filed formal charges against two of the detainees held at the U.S. Naval Station at Guantanamo Bay, Cuba in connection with the war against terrorism. The two will likely be tried soon by military commission convened pursuant to President Bush's Military Order (M.O.) of November 13, 2001 pertaining to the detention, treatment, and trial of certain non- citizens in the current war against terrorism. The M.O. has been the focus of intense debate both at home and abroad. Critics argued that the tribunals could violate the rights of the accused under the Constitution as well as international law, thereby undercutting the legitimacy of any verdicts rendered by the tribunals. The Administration has responded by publishing a series of military orders and instructions clarifying some of the details. The procedural aspects of the trials are to be controlled by Military Commission Order No. 1 (M.C.O. No. 1"). The Department of Defense has also released two more orders and nine "Military Commission Instructions," which set forth the elements of some crimes that may be tried, establish guidelines for civilian attorneys, and provide other administrative guidance. These rules have been praised as a significant improvement over what might have been permitted under the M.O., but some argue that the enhancements do not go far enough.

Book excerpt: Today, the Secretary of Defense is submitting to Congress a comprehensive Manual for the full and fair prosecution of alien unlawful enemy combatants by military commissions, in accordance with the Military Commissions Act of 2006. The Manual is made up of four separate sections: The Preamble, The Rules for Military Commissions, the Military Commission Rules of Evidence, and the Crimes and Elements. The Rules for Military Commissions set forth the procedural rules for Military Commissions. The Military Commission Rules of Evidence provide evidentiary rules to govern the admissibility of evidence at trial. The Crimes and Elements section lays out the crimes punishable by Military Commission and the elements of those crimes. This Manual is the product of a tremendous interagency effort. Principally military judge advocates and attorneys from the Departments of Defense and Justice, using the Manual for Courts-Martial as a guide, undertook the initial drafting. Drafts were then coordinated with other relevant agencies to ensure that specific rules and procedures reflect careful consideration of our nation's intelligence activities, as called for in the MCA. The overriding considerations reflected in the Manual for Military Commissions are fairness and fidelity to the Military Commissions Act of 2006. It is intended to ensure that alien unlawful enemy combatants who are suspected of war crimes and certain other offenses are prosecuted before regularly constituted courts affording all the judicial guarantees which are recognized as indispensable by civilized people. This Manual will have an historic impact for our military and our country.

The D.C. Circuit Court of Appeals reversed that decision, Rumsfeld v. Hamdan, but the Supreme Court granted review and reversed the decision of the Court of Appeals. Military commissions will not be able to go forward until the Department of Defense revises its rules to conform with the Supreme Court's Hamdan opinion or Congress approves legislation conferring authority to promulgate rules that depart from the strictures of the Uniform Code of Military Justice (UCMJ) and U.S. international obligations. The M.O. has been the focus of intense debate both at home and abroad. Critics argued that the tribunals could violate the rights of the accused under the Constitution as well as international law, thereby undercutting the legitimacy of any verdicts rendered by the tribunals. The second chart, which compares procedural safeguards incorporated in the regulations with established procedures in courts-martial, follows the same order and format used in CRS Report RL31262, Selected Procedural Safeguards in Federal, Military, and International Courts, in order to facilitate comparison with safeguards provided in federal court and international criminal tribunals.

Book excerpt: In response to the horrific terrorist attacks of September 11th, the President as Commander-in-Chief issued an order directing the trial of al Qaeda members and other terrorists before military commissions. The order provoked a hornets' nest of reactions from the press, the legal community, and the public. Based on the rhetoric of many pundits and press, it was immediately apparent that little of substance is known about military commissions, which were last used following World War II. This paper traces the historical role and origins of these tribunals, their legal authority, and the advantages they offer over alternative means to try the September 11th terrorists. It concludes that military commissions are more than just appropriate forums for trying these perpetrators; they are, in fact, singularly suited for this purpose. Our nation is at war. Under the law, the al Qaeda terrorists are unlawful combatants who perpetrated monumental war crimes. The use of military commissions to successfully try such war crimes has been consistent throughout the history of war-fighting. There is constitutional authority and jurisdiction for their use, authority that the Supreme Court has upheld. Given the implementing procedures recently announced by the Department of Defense, military commissions will comport with due process and the rule of law, while ensuring the needs of national defense are well protected.
