Book The Courts and the People Friend or Foe

Download or read book The Courts and the People Friend or Foe written by DJ Galligan and published by Bloomsbury Publishing. This book was released on 2021-10-07 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are the courts our friend or our foe? This book has three parts: Part I considers the case for judicial independence Part II looks at the question 'Is judicial independence under threat?' Part III reflects on whether judicial independence be defended and protected. Prompted by the constitutional crisis following the referendum of 2016, the Foundation for Law Justice and Society convened the second Putney Debates. Now convened on an annual basis, they provide a forum each year for the discussion of matters of constitutional importance. The original Putney Debates were held in St Mary's Church, Putney in 1647. The Civil War had been won, the King was held prisoner, the New Model Army was in control. In late October of that year, the weekly meeting of the High Council of the New Model Army, under the chairmanship of Oliver Cromwell, together with several civilians, turned into a debate about the constitution. This is perhaps the only occasion in modern history that a constitutional convention has been held on the English constitution.

Book Constitutionally Conforming Interpretation Comparative Perspectives

Download or read book Constitutionally Conforming Interpretation Comparative Perspectives written by Matthias Klatt and published by Bloomsbury Publishing. This book was released on 2023-11-02 with total page 463 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first part of a 2-volume set that presents an in-depth investigation into the canon of constitutionally conforming interpretation. These volumes address the fundamental issues the canon raises in the national, supranational and international contexts. In volume 1, experts from 19 jurisdictions, including Brazil, Canada, India, the UK, and the USA, present reports which give concise overviews of the approaches and debates on constitutionally conforming interpretation. These reports cover the structural background, the conditions of application, as well as issues of competence. Further aspects discussed are its perceived normativity and popularity in everyday legal practice. Together with volume 2, which explores the canon's use and theoretical impact beyond the national context in a comparative and critical manner, this book fills an important gap in legal scholarship and sets the stage for cross-national discourse.

Book The Greek Discovery of Politics

Download or read book The Greek Discovery of Politics written by Christian Meier and published by Harvard University Press. This book was released on 1990 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: Why the Greeks? How did it happen that these people--out of all Mediterranean societies--developed democratic systems of government? The outstanding German historian of the ancient world, Christian Meier, reconstructs the process of political thinking in Greek culture that led to democracy. He demonstrates that the civic identity of the Athenians was a direct precondition for the practical reality of this form of government. Meier shows how the structure of Greek communal life gave individuals a civic role and discusses a crucial reform that institutionalized the idea of equality before the law. In Greek drama--specifically Aeschylus' Oresteia--he finds reflections of the ascendancy of civil law and of a politicizing of life in the city-state. He examines the role of the leader as well as citizen participation in Athenian democracy and describes an ancient equivalent of the idea of social progress. He also contrasts the fifth-century Greek political world with today's world, drawing revealing comparisons. The Greek Discovery of Politics is important reading for ancient historians, classicists, political scientists, and anyone interested in the history of political thought or in the culture of ancient Greece.

Available in PDF, EPUB and Kindle. Book excerpt: In the first comprehensive accounting of the U.S. Supreme CourtÕs race-related jurisprudence, a distinguished historian and renowned civil rights lawyer scrutinize a legacy too often blighted by racial injustice. The Supreme Court is usually seen as protector of our liberties: it ended segregation, was a guarantor of fair trials, and safeguarded free speech and the vote. But this narrative derives mostly from a short period, from the 1930s to the early 1970s. Before then, the Court spent a century largely ignoring or suppressing basic rights, while the fifty years since 1970 have witnessed a mostly accelerating retreat from racial justice. From the Cherokee Trail of Tears to Brown v. Board of Education to the dismantling of the Voting Rights Act, historian Orville Vernon Burton and civil rights lawyer Armand Derfner shine a powerful light on the CourtÕs race recordÑa legacy at times uplifting, but more often distressing and sometimes disgraceful. For nearly a century, the Court ensured that the nineteenth-century Reconstruction amendments would not truly free and enfranchise African Americans. And the twenty-first century has seen a steady erosion of commitments to enforcing hard-won rights. Justice Deferred is the first book that comprehensively charts the CourtÕs race jurisprudence. Addressing nearly two hundred cases involving AmericaÕs racial minorities, the authors probe the parties involved, the justicesÕ reasoning, and the impact of individual rulings. We learn of heroes such as Thurgood Marshall; villains, including Roger Taney; and enigmas like Oliver Wendell Holmes and Hugo Black. Much of the fragility of civil rights in America is due to the Supreme Court, but as this sweeping history also reminds us, the justices still have the power to make good on the countryÕs promise of equal rights for all.

Book Constitutional Origin and Norm Creation in Colombia

Download or read book Constitutional Origin and Norm Creation in Colombia written by Jan Boesten and published by Taylor & Francis. This book was released on 2022-04-27 with total page 275 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explains the growing empowerment of the Colombian Constitutional Court in the early years of the 21st century and develops the concept of the deliberative judge. Taking the case of the Colombian Constitutional Court and drawing on neoinstitutional theory to explain the relationship between political crisis and institutional reforms, the book challenges the notion of rational choice institutionalism that agents act strategically. It indicates the limits of path dependence and argues instead that discursive institutionalism is the most appropriate method for analyzing processes of institutional learning. Combining theoretical and empirical research, it builds the argument that judicial independence promotes the case for deliberative democracy over rational choice or strategic action approaches. Finally, the book suggests that by introducing communicative and cognitive variables in our understanding of key actors and processes, we are more capable of bridging institutional origin and legacy. The work will be a valuable resource for academics, researchers, and policy-makers in Constitutional Law, Constitutional Politics, and Constitutional History.

Book Repression and Repressive Violence

Download or read book Repression and Repressive Violence written by Marjo Hoefnagels and published by Routledge. This book was released on 2021-09-30 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: These papers are the proceedings of the 3rd international working conference on violence and non-violent action in industrialized societies, held in Brussels, on November 3rd-5th, 1976. Political violence is generally understood to be violence used by people who seek to change the existing power structure through rebellion, revolution, coup d’état, etc. It is much less studied from its opposite angle, as violence used by people who seek to consolidate their powerful positions. Such "violence from above’ however, was the subject of an international conference on "Repression and Repressive Violence’, which was organized by the Polemological Centre of the Free University of Brussels (v u b ). The conference provided a unique opportunity for bringing together a number of scholars who had been working on the subject of repressive violence separately, each within his/her scientific discipline
