Book excerpt: The purpose of this doctoral thesis is to enable the reader to appreciate the Council of Europe's contribution to defining standards related to the principles of judicial independence and impartiality, and to creating and strengthening law-based court systems within Europe. Furthermore, procedures and tools are presented which Council of Europe bodies apply to propagate and implement judicial systems based on the rule of law. A case study on the Republic of Albania illustrates the success of the Organisation seated in Strasbourg in introducing and consolidating an independent judiciary where impartial judges hold office. The results of this case study give answers to the role of the Organisation and the important presence of Strasbourg bodies in former communist countries in Europe. In conclusion, this study highlights deficits undermining the authority, efficiency and visibility of the Council of Europe and calls for their reform.

Its standard-setting texts have helped its members meet the challenges of changing societies and now apply all over Europe given the organisation¿s unprecedented geographical enlargement since 1989. In this connection, the Council of Europe has played a key role in the accession of the new member states to the European Union. The first section of the book deals with the "constitutional" law of the Council of Europe, or its internal statutes in the broad sense. It covers the 1949 Statute, which, along with related texts, lays down the Council¿s aims and determines its membership and operating methods. The second section concerns the role played by the Council of Europe - which has always been very active in standard-setting - in the harmonisation of European states¿ domestic law. The third section situates Council of Europe law in the European context. For instance, it studies the extent to which Council of Europe conventions have been incorporated in domestic law and how Council of Europe law and European Union law co-exist.

Book excerpt: The implementation of the recommendations of the 3rd Summit of Heads of State and Government of the Council of Europe (Warsaw, May 2005) resulted in the launch in 2006 of a number of European campaigns, in particular "Building a Europe for and with children"; the "Campaign to combat trafficking in human beings"; "All different, All equal"; "Stop domestic violence against women"; and the 'Dosta!" awareness-raising campaign to end prejudice against the Roma. Kosovo was a major political concern for the Council of Europe. Through its Venice Commission, it provided expert input for the preparation of the future status of the region and continued to provide expert advice on the implementation of European standards in such fields as the protection of human rights, minority rights, decentralisation, cultural heritage protection and constitutional law. The Republic of Montenegro applied for membership of the Council of Europe following the 21 May referendum, which paved the way for its independence. Serbia, on the other hand, succeeded the former State Union of Serbia and Montenegro as a member state of the Organisation. The Council of Europe was the first organisation to look into the allegations of secret detentions and unlawful transfers of suspected terrorists in the member states. The Parliamentary Assembly and the Secretary General each carried out investigations which revealed that Council of Europe member states have not set up effective legal safeguards against such practices, which violate the European Convention on Human Rights.

These new rules aim to promote the role of judges, improve both their efficiency and independence and clarify their duties and responsibilities. They take account of the new ideas and practices that have emerged in member states' judicial systems since 1994.This recommendation places emphasis on the independence of every individual judge and of the judiciary as a whole. The notion of "internal independence", which aims at protecting judicial decisions from undue internal influences, is one of the important new elements of the recommendation. Judicial "efficiency" is defined in a clear and simple manner. Additional measures on the selection and training of judges, their responsibility, and judicial ethics seek to strengthen the role of individual judges and the judiciary in general.Overall, the recommendation represents a significant step forward in strengthening the protection of human rights and fundamental freedoms, as the manner in which judges exercise their judicial functions is crucial to the protection of these rights and freedoms.
