The book is an invaluable reference work for all those working in the field of international nuclear law & the regulation of the use of nuclear energy as well as for teachers & students of law.

Download or read book The Law of the Seabed written by Catherine Banet and published by BRILL. This book was released on 2020-01-29 with total page 637 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law of the Seabed reviews the most pressing legal questions raised by the use and protection of natural resources on and underneath the world’s seabeds. While barely accessible, the seabed plays a major role in the Earth’s ecological balance. It is both a medium and a resource, and is central to the blue economy. New uses and new knowledge about seabed ecosystems, and the risks of disputes due to competing interests, urge reflection on which regulatory approaches to pursue. The regulation of ocean activities is essentially sector-based, and the book puts in parallel the international and national regimes for seabed mining, oil and gas, energy generation, bottom fisheries, marine genetic resources, carbon sequestration and maritime security operations, both within and beyond the national jurisdiction. The book contains seven parts respectively addressing the definition of the seabed from a multidisciplinary perspective, the principles of jurisdiction delimitation under the United Nations Convention on the Law of the Sea (UNCLOS), the regimes for use of non-living, living and marine biodiversity resources, the role of state and non-state actors, the laying and removal of installations, the principles for sustainable and equitable use (common heritage of mankind, precaution, benefit sharing), and management tools to ensure coexistence between activities as well as the protection of the marine environment.

Download or read book Global Ocean Politics written by Edward L. Miles and published by Martinus Nijhoff Publishers. This book was released on 1998 with total page 578 pages. Available in PDF, EPUB and Kindle. Book excerpt: The stakes were high when, from 1973 to 1982, delegates at the Third United Nations Convention on the Law of the Sea (UNCLOS III) shaped the U.N. Convention on Law of the Sea of 1982 & ultimately influenced a large-scale transformation of the world ocean regime & the formulation of global diplomacy in the eighties. Global Ocean Politics offers a comprehensive description & analysis of the decision-making process at UNCLOS III & shows how that process determined the 1982 Convention. As such, the work complements a large number of substantive legal commentaries on the Convention by providing a detailed description & analysis of the shaping of its various components, including the major & minor trade-offs; the impacts of different negotiating strategies; & the effects of interpersonal, interdelegation, & intercoalition interactions. The work also gives the reader a broader perspective, examining the lessons UNCLOS III teaches us about the capacity of the international system to manage & regulate the use of a global common.

Book Risk and the Regulation of Uncertainty in International Law

Download or read book Risk and the Regulation of Uncertainty in International Law written by Monika Ambrus and published by Oxford University Press. This book was released on 2017-10-27 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: Increasingly, international legal arrangements imagine future worlds or create space for experts to articulate how the future can be conceptualized and managed. With the increased specialization of international law, a series of functional regimes and sub-regimes has emerged, each with their own imageries, vocabularies, expert-knowledge, and rules to translate our hopes and fears for the future into action in the present. At issue in the development of these regimes are not just competing predictions of the future based on what we know about what has happened in the past and what we know is happening in the present. Rather, these regimes seek to deal with futures about which we know very little or nothing at all; futures that are inherently uncertain and even potentially catastrophic; futures for which we need to find ways to identify, conceptualise, manage, and regulate risks the existence of which we can possibly only speculate about. This book explores how the future is imagined, articulated, and managed across the various fields of international law, including the use of force, maritime security, international economic and environmental law, and human rights. It investigates how the future is construed in these various areas; how the costs of risk, risk regulation, risk assessment, and risk management are distributed in international law; the effect of uncertain futures on the subjects of international law; and the way in which international law operates when faced with catastrophic or existential risk.
