Book excerpt: Directive 79/7/EEC aims at implementing the principle of equal treatment between men and women in social security matters, by requiring that equal treatment is ensured in selected social security and social assistance schemes. This study forms part of the REFIT programme and assesses the Directive's effectiveness, efficiency, coherence, relevance, sustainability and EU added value. Based on its results, it provides policy recommendations with a view to a possible modernisation of the Directive. The study recognises the relevance and European added value of the Directive, its principle being fully integrated in national legislations. Moreover, the Directive has represented, and still represents, an important reference in European case law for tackling cases of gender discrimination. However, improvements might be necessary in order to ensure full effectiveness, efficiency and coherence of the relevant legislation. The first recommendation relates to a revision of the Directive's scope, starting with its exclusions and derogations. A second recommendation suggests the codification of key CJEU case law in the text of a revised Directive. The study also suggests to improve the coherence of EU legislation through aligning key concepts of the relevant legislation and to improve the enforcement of the Directive's principle at national level by increasing the involvement of national equality bodies.

Book excerpt: The Charter of Fundamental Rights of the European Union enshrines the key political, social and economic rights of EU citizens and residents in EU law. In its present form it was approved in 2000 by the European Parliament, the Council of Ministers and the European Commission. However its legal status remained uncertain until the entry into force of the Treaty of Lisbon in December 2009. The Charter obliges the EU to act and legislate consistently with the Charter, and enables the EU's courts to strike down EU legislation which contravenes it. The Charter applies to EU Member States when they are implementing EU law but does not extend the competences of the EU beyond the competences given to it in the treaties. This Commentary on the Charter, the first in English, written by experts from several EU Member States, provides an authoritative but succinct statement of how the Charter impacts upon EU, domestic and international law. Following the conventional article-by-article approach, each commentator offers an expert view of how each article is either already being interpreted in the courts, or is likely to be interpreted. Each commentary is referenced to the case law and is augmented with extensive references to further reading. Six cross-cutting introductory chapters explain the Charter's institutional anchorage, its relationship to the Fundamental Rights Agency, its interaction with other parts of international human rights law, the enforcement mechanisms, extraterritorial scope, and the all-important 'Explanations'.

For example, one in three women has experienced physical and/or sexual violence since the age of 15; one in five women has experienced stalking; every second woman has been confronted with one or more forms of sexual harassment. What emerges is a picture of extensive abuse that affects many women's lives but is systematically underreported to the authorities. The scale of violence against women is therefore not reflected by official data. This FRA survey is the first of its kind on violence against women across the 28 Member States of the European Union (EU). It is based on interviews with 42,000 women across the EU, who were asked about their experiences of physical, sexual and psychological violence, including incidents of intimate partner violence ('domestic violence'). The survey also included questions on stalking, sexual harassment, and the role played by new technologies in women's experiences of abuse. In addition, it asked about their experiences of violence in childhood. Based on the detailed findings, FRA suggests courses of action in different areas that are touched by violence against women and go beyond the narrow confines of criminal law, ranging from employment and health to the medium of new technologies."--Editor.

The survey was focussed on the national legal and institutional framework on equal rights and equal treatment for women and men. Independent experts and non-governmental organisations prepared the country studies on Bulgaria, Czech Republic, Estonia, Hungary, Lithuania, Poland, Romania and Slovakia. The country reports are introduced by a summary report that provides an overall assessment of progress in meeting the relevant criteria and of the impact of the accession process in this area. The study concludes with succinct recommendations to the EU and to the governments of the candidate states.
