Book excerpt: The Magna Carta, Latin for "Great Charter" (literally "Great Paper"), also known as 'Magna Carta Libertatum, is an English 1215 charter which limited the power of English Monarchs, specifically King John, from absolute rule. The Magna Carta was the result of disagreements between the Pope and King John and his barons over the rights of the king: Magna Carta required the king to accept that the will of the king could be bound by law. The Code of Hammurabi was a Mesopotamian legal code that laid a foundation for later Hebraic and European law. The Magna Carta is widely considered to be the first step in a long historical process leading to the rule of constitutional law and is one of the most famous documents in the world. Originally issued by King John of England (r.1199-1216) as a practical solution to the political crisis he faced in 1215, Magna Carta established for the first time the principle that everybody, including the king, was subject to the law. Although nearly a third of the text was deleted or substantially rewritten within ten years, and almost all the clauses have been repealed in modern times, Magna Carta remains a cornerstone of the British constitution. Most of the 63 clauses granted by King John dealt with specific grievances relating to his rule. However, buried within them were a number of fundamental values that both challenged the autocracy of the king and proved highly adaptable in future centuries. Most famously, the 39th clause gave all 'free men' the right to justice and a fair trial. Some of Magna Carta's core principles are echoed in the United States Bill of Rights (1791) and in many other constitutional documents around the world, as well as in the Universal Declaration of Human Rights (1948) and the European Convention on Human Rights (1950). On 11 July 1302, below the town walls of Courtrai, the most splendid army of knights in Christendom, the flower of the French nobility, was utterly defeated by Flemish rebels, common workers and peasants. The French knights, products of a lifetime's training, were ably led; but so too were the Courtrai townspeople, in addition to being well-armed, and their victory, despite their lack of military skills (and golden spurs), put an end to the enduring myth of the invincibility of the knight. A French explanation of the terrible defeat was immediately given, intended to save the honour and pride of the French nobility; in Flanders the victory was glorified as a just reward for the bravery of the townsmen and the competence of their commanders. Unfortunately there were no impartial witnesses. Any account of the battle must therefore pay careful attention to the personalities of the chroniclers, their nationality, and their political and social leanings, as well as their personal sympathies. Verbruggen's study is prefaced by discussion of the problems of reconstruction and extensive consideration of the sources, showing the difficultiesfaced by medieval military historians in attempts to interpret them. He then offers his own account of the events of that dramatic day, a case study in the reconstruction of events in one of the greatest battles of the middle ages.J.F. Book excerpt: To predict likely policy developments around the world over the next thirty years, Bruce Bueno de Mesquita uses game theoretic models as described in Predicting Politics. The tools used in this book have found wide application in business and in the development of significant American foreign policy initiatives over the years. The author uses data from 1948 to show the ability of models to predict the end of the Cold War. He then turns to data from 1980 for about one hundred countries and simulates future states of the world, especially with regard to further democratization. In the process he shows strong evidence that the burst of democratization that occurred at the end of the 1980s and the beginning of the 1990s was predictable based on replicable data known in 1980. While delving into rather gloomy predictions about likely developments in Russia and China's domestic affairs, he offers a novel explanation for the failure of Russia to attract more investment and to achieve the higher growth rates commonly associated with democratic government. Although Russia is certainly more democratic in an absolute sense today than it was in 1980, it has fallen farther behind the rest of the world in terms of democratization and so lacks the comparative advantages of property rights, rule of law, and transparent governance that are essential for attracting investment. Bueno de Mesquita shows how policy situations and game theoretical analyses can explain the past, illuminate the present and forecast future events. At the same time he provides the tools necessary for others to create their own rigorous estimates of future foreign policies.
