Download or read book Constitutional Secularism in an Age of Religious Revival written by Susanna Mancini and published by Oxford University Press. This book was released on 2014 with total page 386 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The revival of religion in many parts of the world and the migration of religious cultures as part of the process of globalization have posed a serious challenge to traditional constitutional secularism. This challenge comes in the form of a political and institutional struggle against secular constitutionalism, and a two pronged assault on the very legitimacy and viability of the concept. On the one hand, constitutional secularism has been attacked as inherently hostile rather than neutral toward religion; and, on the other hand, constitutional secularism has been criticized as inevitably favouring one religion (or set of religions) over others"--

Book India as a Secular State

Download or read book India as a Secular State written by Donald Eugene Smith and published by Princeton University Press. This book was released on 2015-12-08 with total page 539 pages. Available in PDF, EPUB and Kindle. Book excerpt: Throughout India's history, religion has been the most powerful single factor in the development of her civilization. Today, despite her religious tradition, India is emerging as a secular state. In this book, Donald E. Smith explores the origin of the concept of secularization as it is found both in Indian culture and in the example of the western nations. He emphasizes the important role of secularization in India’s total democratic experiment and points out that the degree of its realization will undoubtedly affect the eventual character of democracy in India. In addition, the success or failure of the secular state in India cannot fail to influence the attitudes of her neighbors. Professor Smith considers the many aspects and implications of India’s attempt to secularize her government. Originally published in 1963. Download or read book Indian Secularism written by Shabnum Tejani and published by Indiana University Press. This book was released on 2021-01-05 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many of the central issues in modern Indian politics have long been understood in terms of an opposition between ideologies of secularism and communalism. Observers have argued that recent Hindu nationalism is the symptom of a crisis of Indian secularism and have blamed this on a resurgence of religion or communalism. Shabnum Tejani unpacks prevailing assumptions about the meaning of secularism in contemporary politics, focusing on India but with many points of comparison elsewhere in the world. She questions the simple dichotomy between secularism and communalism that has been used in scholarly study and political discourse. Tracing the social, political, and intellectual genealogies of the concepts of secularism and communalism from the late nineteenth century until the ratification of the Indian constitution in 1950, she shows how secularism came to be bound up with ideas about nationalism and national identity.

Download or read book The Wheel of Law written by Gary Jeffrey Jacobsohn and published by Princeton University Press. This book was released on 2009-01-10 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: How can religious liberty be guaranteed in societies where religion pervades everyday life? In The Wheel of Law, Gary Jacobsohn addresses this dilemma by examining the constitutional development of secularism in India within an unprecedented cross-national framework that includes Israel and the United States. He argues that a country's particular constitutional theory and practice must be understood within its social and political context. The experience of India, where religious life is in profound tension with secular democratic commitment, offers a valuable perspective not only on questions of jurisprudence and political theory arising in countries where religion permeates the fabric of society, but also on the broader task of ensuring religious liberty in constitutional polities. India's social structure is so entwined with religion, Jacobsohn emphasizes, that meaningful social reform presupposes state intervention in the spiritual domain. Hence India's "ameliorative" model of secular constitutionalism, designed to ameliorate the disabling effects of the caste system and other religiously based practices. Jacobsohn contrasts this with the "visionary" secularism of Israel, where the state identifies itself with a particular religion, and with America's "assimilative" secularism. Constitutional globalization is as much a reality as economic globalization, Jacobsohn concludes, and within this phenomenon the place of religion in liberal democracy is among the most vexing challenges confronting us today. A richly textured account of the Indian experience with secularism, developed in a broad comparative framework, this book is for all those seeking ways to respond to this challenge.

Download or read book Articles of Faith written by Ronojoy Sen and published by Oxford University Press. This book was released on 2018-10-16 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: Examining the constitutional and legal foundations of the place of religion in India, Articles of Faith studies the relationship between religion and state. It closely analyses the decisions of the Supreme Court from the 1950s on Articles 25–30 of the Indian Constitution, as well as other relevant laws and constitutional provisions. The book discusses the Supreme Court’s interpretation of the constitutional right to freedom of religion and its influence on the discourse of secularism and nationalism. While examining the role of the Court in defining and demarcating religion as well as religious freedom, practices, and organizations, this volume also highlights important issues such as interpretative traditions and legal doctrines developed by the judiciary over the years. This new edition has an expanded and revised introduction, which looks at the new literature on secularism and religious jurisprudence, both in India and other secular democracies. It also includes an afterword, which examines recent landmark judgments on religion by the Supreme Court of India, such as the one on triple talaq.

Book Secularism How India Reshaped the Idea

Download or read book Secularism How India Reshaped the Idea written by Nalini Rajan and published by Speaking Tiger Books. This book was released on 2024-01-20 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Secularism emerged in 17th-century Europe as an essential element of what became the modern state. The separation of church and state that it entailed paved the way for the democratic republics we take for granted today. Tolerance, as understood in the West, was sought to be introduced as state policy by the British in India too. But our nationalist leaders understood their country better than to adopt the concept without local adjustments. Political philosopher Nalini Rajan examines the tension between religious freedom and state intervention in India, a tension that comes with the idea of 'principled' state intervention in matters of religion, as mandated by the Constitution. Demands for reservations and separate electorates by minorities in the early twentieth century had essentially ruled out absolute state neutrality in this respect. But it is only by analysing the fascinating debates on secularism in the Constituent Assembly (1946-49) that we see how and why the specific provisions on minority rights-Articles 25 to 30-came to be adopted. These provisions implicitly envisioned a key role for the judiciary. A full section of this book is thus devoted to understanding the role that the courts have played in establishing, and just as importantly, defining Indian secularism-through such judgements as in the Shirur Mutt case of 1954, the Durgah Committee case of 1961, the Satsangi case of 1966, the Stanislaus case of 1977, the Shah Bano case of 1985, the so-called 'Hindutva' cases of 1996, the Vaishno Devi case of 1997, and the Puttaswamy case of 2017. This exhaustive monograph should be read by all those interested in understanding how a distinctive secularism shaped modern India, and how the latter shaped our secularism.
