Book excerpt: Excerpt from The Charitable Trusts Acts, 1853 to 1894: Analytically Arranged Of this Condition of the Charitable Trusts Acts proof is furnished by the numerous cross references appended to the recent collective edition of the Charitable Trusts Acts, as well as by similar references appended to those Acts, as comprised in the 3rd edition of Tudor's Law of Charitable Trusts, pp. 466 - 566. The following pages are the result of an attempt to dispense with the laborious and somewhat hazardous process of cross reference by bringing together, as closely as may be, the several provisions of the Acts, which deal with the same heads of jurisdiction. The analysis of the Acts, upon which this arrangement of their provisions is based. Is to be found in Table A. In Appendix 12 to the Report of the Select Committee of the House of Commons, which was appointed in 1894 to inquire whether it is desirable to take measures to bring the action of the Charity Commission more directly under the control of Parliament, and to give it more effectual means of dealing with the business which will come before it. The entire text of the several Charitable Trusts Acts, 1853-1894, is reproduced verbatim in the following pages. In a few cases, and conspicuously in those of sections 2, 4, 6, and 8 of the Charitable Trusts Act, 1860. It has been found convenient, in order to avoid confusion and repetition, to break up sections which deal with more than one of the several heads of analysis. In these cases, whenever the section thus divided is not to be found complete in any other place in the text, it is printed in full in Appendix, N o. 1, for purposes of reference. No attempt to consolidate has been made, and each section is treated independently. Some difficulty has consequently been experienced in determining the order in which sections falling under the same head shall be arranged, so as to present the state of the law as clearly as may be. In order to meet this difficulty chronological sequence has been disregarded in several cases. In a few cases, pp. 8, 15, '22, 31, 63, and 66, it has been found necessary to completeness to introduce sections of Acts other than the Charitable Trusts Acts.
