Book excerpt: This book explores the struggle to define self-government in the critical years following the Declaration of Independence, when Americans throughout the country looked to the Keystone State of Pennsylvania for guidance on political mobilization and the best ways to create a stable arrangement that could balance liberty with order. In 1776 radicals mobilized the people to overthrow the Colonial Assembly and adopt a new constitution, one that asserted average citizens’ rights to exercise their sovereignty directly not only through elections but also through town meeting, petitions, speeches, parades, and even political violence. Although highly democratic, this system proved unwieldy and chaotic. David Houpt finds that over the course of the 1780s, a relatively small group of middling and elite Pennsylvanians learned to harness these various forms of "popular" mobilization to establish themselves as the legitimate spokesmen of the entire citizenry. In examining this process, he provides a granular account of how the meaning of democracy changed, solidifying around party politics and elections, and how a small group of white men succeeded in setting the framework for what self-government means in the United States to this day.

More importantly The Sovereign Psyche is the motivating consciousness, intellect, and willpower that is necessary to materialize what the book defines as "Self-Authentic Freedom" as opposed to "Chattel Freedom." Chattel freedom is when the value of a people is predicated upon the extent to which they serve the interests and institutions of others. As such, this work asserts that there is no such thing as intellectual or institutional equality, and that Black/African people have been unknowingly thrusted into an intellectual and institutional war, where second-place finishers either experience varying degrees of chattel freedom or they could end-up dead. Regardless of the issue, genuine solutions entail what we as Black/African people intellectually and institutionally do for ourselves. If "Black Lives Matter" we must channel the end-uses of our intellect and the resources of our institutions to not only prove and enforce it, but also leverage powers to penalize and/or repudiate violators. Although this work centers upon Black/African people, the sovereign functions and frameworks herein are universal in application, being that todays world rotates upon systems of sovereignty and power, not beliefs in democracy or equality. In this context, the sovereign concepts and criteria presented are far more rational than radical. The central question is, to what extent will Black/African people harness the willpower and employ the intellect of The Sovereign Psyche to actualize our own systems and institutions of self-authentic freedom, government, and development, without apology or permission? This work offers the ideological apparatus to make this possible, just as others are doing all around the globe.

Combining historical comparison, constitutional theory, and political analysis, this volume links together theory and comparative analysis in order to orient actors engaged in constitution making processes all over the world. The book examines two core phenomena: the development of a new, democratic paradigm of constitution making, and the resulting change in the normative discussions of constitutions, their creation, and the source of their legitimacy. After setting out a theoretical framework for understanding these developments, Andrew Arato examines recent constitutional politics in South Africa, Hungary, Turkey, and Latin America and discusses the political stakes in constitution-making. It critiques the foundational legal paradigm that influences and shapes the substance of the sovereign debt regime. In doing this, the author employs legal theory to show the inadequacies of the regime in terms of its failure to embrace the dynamism of sovereign debt which he characterises as a debt with a complex mix of public-private elements, hybridity of norms and multiplicity of interests beyond the two-sided creditor-debtor matrix. By locating socio-economic rights in all critical phases of the regime, the author shows that the recurring circles of debt crises are linked to the continuing influence of the private law paradigm. The book offers a fresh perspective to re-imagine sovereign debt using insights from transnational legal theorists and advocates prioritising socio-economic rights considerations in debt contracting, restructuring and adjudication through a more concrete recognition of creditors’ responsibilities.
