  • ISBN : 1317022173
  • Pages : 399 pages

Download or read book The Organizational Contract written by Stefan Grundmann and published by Routledge. This book was released on 2016-02-17 with total page 399 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book introduces and develops the paradigm of the organisational contract in European contract law. Suggesting that a more radical distinction should be made between contracts which regulate single or spot exchanges and contracts that organize complex economic activities without creating a new legal entity, the book argues that this distinction goes beyond that between spot and relational contracts because it focuses on the organizational dimension of contracting and its governance features. Divided into six parts, the volume brings together a group of internationally renowned experts to examine the structure of long-term contractual cooperation; networks of contracts; knowledge exchange in long-term contractual cooperation; remedies and specific governance rules in long-term relationships; and the move towards legislation. The book will be of value to academics and researchers in the areas of private law, economic theory and sociology of law, and organizational theory. It will also be a useful resource for practitioners working in international contract law and international business transaction law.

Book Living the Middle Life Secular Priests and Their Communities in Thirteenth century Genoa

Download or read book Living the Middle Life Secular Priests and Their Communities in Thirteenth century Genoa written by John Benjamin Yousey-Hindes and published by Stanford University. This book was released on 2010 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: Secular priests occupied a central place within thirteenth-century European society, carrying out important duties within the institutional Church, as well as participating in the lay and religious communities around them. This dissertation uses secular sources--the private registers of public notaries--to show that priests in the port city of Genoa entered into economic, spiritual, and social transactions with a wide range of people. In doing so, they built complex and durable relationships that provided ample opportunities for the exchange of ideas and values with the women, men, and other clerics with whom they shared their lives. If a major trend in scholarship on the Middle Ages over the past seventy years has been to emphasize the religiosity of lay people's everyday world, then this dissertation looks the other direction, to explore the so-called secularity of religious institutions and their priests. Ultimately, the notarial registers prove that Genoa's priests were not mere facilitators of lay religiosity or agents of ecclesiastical power; rather they played a multivalent role in the intermediary space between "lay" and "religious" communities. Chapter One provides an overview of Genoa's ecclesiastical structure and demonstrates how private notarial registers can provide useful perspectives on secular priests' lives. Chapter Two investigates how priests' participation in the real estate and credit markets helped weave them into the fabric of Genoese neighborhoods. Chapter Three uses the notarial registers to show priests carrying out their core professional duties: tending to the health of souls in their communities. Chapter Four demonstrates priests' important intermediary position by examining their service as executors, agents, arbiters, and judges. Chapter Five explores how secular priests embodied the Genoese Church overseas in Genoa's network of trading settlements around the Mediterranean and Black Seas. Finally, the Conclusion considers the broader contours of priests' social networks, identifying trends that cut across the heuristic boundaries that structure earlier chapters. It also summarizes the value of the private registers as sources for ecclesiastical and clerical history.

Book Contextual Subjects

  • Author : Robert Leckey
  • Publisher : University of Toronto Press

Download or read book Contextual Subjects written by Robert Leckey and published by University of Toronto Press. This book was released on 2008-01-01 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: Law and legal discourse both presuppose and produce legal subjects. Views on the nature of the legal subject will constantly shift, therefore, with changes in the law. Contextual Subjects argues that a new view of the legal subject has indeed emerged and that it is now embedded in the social context and relationships. This claim is developed through a contrast of Canadian family law and administrative law as it was in the mid-twentieth century and as it is today. Robert Leckey argues that it is not only the subject that is contextual. Legal discourse and adjudication have also become more contextual, making family law and administrative law themselves contextual subjects. Leckey bolsters this argument through the use of relational theory, a rich strand of feminist political theory that advocates a contextual method and seeks to promote constructive relationships that enable relational autonomy. Developments in family law and administrative law, therefore, exemplify the contextualism called for by relational theorists. Leckey points to the importance of contextualization, but he is not uncritical of relational theory, insisting that it should articulate more forcefully its normative vision of good relationships and offer clear recommendations in contested areas. Contextual Subjects is the most thorough and sustained application of relational theory to legal examples to appear to date. It is unique in Canadian legal scholarship for the way it pairs family law and administrative law, and within legal scholarship in English for its integration of common law and civil law.

Book A History of Law in Canada Volume Two

Download or read book A History of Law in Canada Volume Two written by Jim Phillips and published by University of Toronto Press. This book was released on 2022-11-01 with total page 604 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the second of three volumes in an important collection that recounts the sweeping history of law in Canada. The period covered in this volume witnessed both continuity and change in the relationships among law, society, Indigenous peoples, and white settlers. The authors explore how law was as important to the building of a new urban industrial nation as it had been to the establishment of colonies of agricultural settlement and resource exploitation. The book addresses the most important developments in the seventeenth, eighteenth, and nineteenth centuries, including legal pluralism and the co-existence of European and Indigenous law. It pays particular attention to the Métis and the Red River Resistance, the Indian Act, and the origins and expansion of residential schools in Canada. The book is divided into four parts: the law and legal institutions; Indigenous peoples and Dominion law; capital, labour, and criminal justice; and those less favoured by the law. A History of Law in Canada examines law as a dynamic process, shaped by and affecting other histories over the long term.
