Book excerpt: The existence of a structured enforcement system is an inherent feature of national legal orders and one of the core elements of State sovereignty. The very limited power to issue sanctions has often been deemed a gap in the EC legal order. Over the years, the situation has progressively changed. The Union’s institutional setting is growing in complexity and a variety of agencies has been or is expected to be endowed with law enforcement responsibilities. In addition, the so-called competence creep has led the EU to play an increasingly prominent role in several areas of EU law enforcement, including the issuing of sanctions. This book examines these developments, focusing on both the general features of the EU legal order and the analysis of key-substantive areas, such as banking and monetary union, environmental law, and data protection. The work thus presents a general framework for understanding EU sanctioning based on structural features and general legal principles. Part I develops an analytical framework, tracking the most significant evolutive patterns of EU sanctioning powers. Part II adopts a more practical approach focusing on specific issues and policy areas. The book bridges a gap in existing literature and sheds new light on the relationship between the exercise of jus puniendi and the evolution of EU integration.

Book The Role of the EU in the Promotion of Human Rights and International Labour Standards in Its External Trade Relations

Download or read book The Role of the EU in the Promotion of Human Rights and International Labour Standards in Its External Trade Relations written by Samantha Velluti and published by Springer Nature. This book was released on 2020-10-12 with total page 359 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book represents a significant and timely contribution to the copious literature of the EU as a global actor providing new insights and fresh perspectives into the promotion of human rights and international labour standards in the EU’s external trade relations, building on and stimulating further – the already well-engaged – scientific dialogue on this area of research. In particular, it provides the basis for developing a new analytical structure for better understanding the role of the EU in promoting human rights and international labour standards in global trade and, in particular, for assessing the extent to which and how normative considerations have influenced the adoption of EU legal instruments and policy decisions. This book will appeal to research scholars, post-graduate students, practitioners and human rights activists.

Book Community Structures and Processes on Lives of Refugee Children

Download or read book Community Structures and Processes on Lives of Refugee Children written by Sofia Leitão and published by Vernon Press. This book was released on 2023-09-12 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Communities around the world face challenges in how to assist the influx of refugees and immigrants, who arrive with only the clothes on their backs. They may have health problems and have experienced violence and trauma before they arrived in their new communities. They require healthcare, housing, education, jobs, financial & material support, and childcare, to name a few. Some arrive with families, but often, children and youth arrive unaccompanied and are in need of special care. Even well-intentioned and resource-rich communities may find themselves taxed as they struggle to help everyone in need. This book is framed by a human rights approach and highlights how social structures and institutional processes impact the lives of refugee and asylum-seeking children. Social institutions around the world tend to experience a similar type of challenge in serving this population. These challenges are examined in this book as recommendations for actions provided. The authored contributions present different perspectives on processes, interactions, policies, practices, and laws embedded in a variety of institutions and community social interactions. It is a reference for researchers, practitioners, and students in its presentation of academic and practitioner approaches to challenges faced by refugee children in different geographic and social contexts. Topics in this book include work on the character of transnational migrant families and communities, uses of new information and communication technologies, international frameworks of humanitarian assistance, social inclusion best practices in the integration of migrant children and unaccompanied minors, and models to provide multidisciplinary services on prevention, integration and rehabilitation integration strategies. Concepts of ACEs (Adverse Childhood Experiences) and HOPEs (Healthy Outcomes from Positive Experiences) are explored, along with lifelong learning as a catalyst for the sustained promotion of safe communities in the context of migration; and individual refugee needs and their family’s future wellbeing towards service to refugees that work for the individual.

Download or read book Solidarity and Rule of Law written by Teresa Russo and published by Springer Nature. This book was released on 2023-07-12 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers an authentic and original perspective on the principles of solidarity and rule of law that are variously interconnected and increasingly invoked in international relations and affairs, especially in the context of the European Union, where they are among the founding values common to all Member States. The innovative approach the authors adopt consists in the joint reading of these two principles within the broader framework of EU security, thus offering a new interpretation and fertile ground for further research. Divided into four parts, the authors consider EU security to be linked to the implementation of both these principles, particularly with regard to EU stabilization and enlargement to the Western Balkans, cross-border security, migration and asylum management, criminal justice and human rights, and police and judicial cooperation The contributions of eminent scholars, international experts, and practitioners are the book’s greatest strength. In addition, it offers a valuable new perspective on the study of contemporary issues affecting the Western Balkans, but also all Member States and the Union itself. Therefore, the book is an essential resource for students and scholars of EU law, but also for lawyers and professionals involved in criminal proceedings or working in the field of human rights.

Book The European Constitution in the Making

Download or read book The European Constitution in the Making written by Roberto Miccù and published by . This book was released on 2004 with total page 192 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the European Convention, parliamentarians and government representatives from the Member States have elaborated the Draft Constitution establishing a Constitution for Europe. This process requires academic guidance and analysis. The European Constitutional Law Network provides an important forum of associated constitutional and European lawyers from different old and new Member States (www.ecln.net). The structure of the future constitution and the general lines of argument underlying the deliberations of the Convention are the focus of the individual contributions to this volume which were presented on the occasion of the second ECLN conference in summer 2002 in Rome. Against the background of their national constitutional and legal orders, the contributors demonstrate their expectations for the European constitution in the making. Thereby, the deliberations provide a pan-European basis for the debate on the future Constitution for Europe.

Book Diversity as Strategic Opportunity

Download or read book Diversity as Strategic Opportunity written by Anna Simonati and published by IAP. This book was released on 2024-03-01 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: The principle of equality has always been considered as one of the fundamental values of modern societies; it compels administration to provide equal treatment to all subjects it enters in touch with, which is normally expressed as a general prohibition of discrimination. However, in recent times, the idea, according to which equality is not based only on protection against discrimination but also on promotion of diversity as a source of richness for society, is widely shared. This book gives a multidisciplinary overview of some of the possible methods and tools which are nowadays experimented by administration, in order to properly face the practical problems connected to diversity. ENDORSEMENTS: "In this volume, Professor Anna Simonati has gathered a wide range of contributions which reflect on the nature of diversity, and its value in society today. Power structures are sticky. This volume reminds us that concepts as old as equality and equity, do not always manifest in ways that create diversity in these structures. The case studies within demonstrate that diversity will lead to empowerment - in other words, shifting the inherent power structures and opening opportunities for all. It is important for democracies to rebalance power structures, and deliberate administrative policies and practices aimed at diversity - as exemplified here - can make real differences for people. Critically, the volume also addresses diversity in education. Preparing the next generation for a world where diversity is a given, rather than a struggle is a worthy goal. This volume provides pathways for policy makers and those who deliver policy with a view to achieving this goal." — Adam Masters, The Australian National University "The book makes a substantive contribution to our understanding and appreciation of how diversity can and ought to be seen not only as something to be protected by means of non-discrimination rules and mechanisms, but also and indeed primarily as a major source of development and improvement for public administration and the public services. Diversity is indeed a strategic opportunity, and this collective work developed under the leadership of Professor Anna Simonati shows us why and how to make the most of such strategic opportunities for public organizations worldwide." — Edoardo Ongaro, The Open University "This Book is really precious because in its comparative approach, takes into account the legal provisions of many national Jurisdictions and the experience of many public Administrations all over the World. The Values of Diversity and Inclusion thus are considered non-only as general principles of Law, but in their action vis a vis the duty of Administrations to provide equal treatment to all subjects they enter in touch with. The aim of the Volume, as Anna Simonati explains, is not aimed at offering final and definite answers, nor a systemic study of the subject, but to address the various possible causes of discrimination and most importantly the possible remedies against it with a Case oriented Analysis. This collective work therefore it is extremely valuable to underline how the Public Policies and the Administrative Law tools can be fundamental -in many different ways- for the never ending struggle towards Equality and Justice." — Aristide Police, LUISS University

Ampio spazio è inoltre dedicato alle tematiche concernenti le nuove tecnologie e la loro rilevanza dal punto di vista antitrust, nonché ai rapporti tra tutela del consumatore e diritto antitrust.

Book World Development Report 2019

Download or read book World Development Report 2019 written by World Bank and published by World Bank Publications. This book was released on 2018-10-31 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: Work is constantly reshaped by technological progress. New ways of production are adopted, markets expand, and societies evolve. But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.
