Book excerpt: The Government utilizes the contract process to purchase a wide variety of goods and services. These include existing commercial products and services, the design, development, and manufacture of goods and related services necessary to meet specific Government needs. Additionally, the government provides financial assistance through grants and cooperative agreements to support research and development by private and public entities, and conducts and collaborates in research and development activites with private sponsors at Government facilities. Through this large expenditure of funds, there is substantial contact with intellectual property. This material principally deals with the relationship between intellectual property concepts of patent, trade secrets, and copyrights and the Government's procurement and financial assistance processes. The subject of trademarks is not covered.

Available in PDF, EPUB and Kindle. Book excerpt: New legal approaches, such as the European Union's 1996 Directive on the Legal Protection of Databases, and other legal initiatives now being considered in the United States at the federal and state level, are threatening to compromise public access to scientific and technical data available through computerized databases. Lawmakers are struggling to strike an appropriate balance between the rights of database rights holders, who are concerned about possible commercial misappropriation of their products, and public-interest users of the data such as researchers, educators, and libraries. A Question of Balance examines this balancing act. The committee concludes that because database rights holders already enjoy significant legal, technical, and market-based protections, the need for statutory protection has not been sufficiently substantiated. Nevertheless, although the committee opposes the creation of any strong new protective measures, it recognizes that some additional limits against wholesale misappropriation of databases may be necessary. In particular, a new, properly scoped and focused U.S. statute might provide a reasonable alternative to the European Union's highly protectionistic database directive. Such legislation could then serve as a legal model for an international treaty in this area. The book recommends a number of guiding principles for such possible legislation, as well as related policy actions for the administration.

Book Intellectual Property and Technical Data Rights

Download or read book Intellectual Property and Technical Data Rights written by Randy Murray and published by . This book was released on 2012 with total page 50 pages. Available in PDF, EPUB and Kindle. Book excerpt: Intellectual Property (IP) and Technical Data Rights are one of the most complicated issues in acquisition management. This issue creates significant problems for both Government and Industry. One of the greatest challenges facing Program Managers today is a renewed emphasis on competition in contracting due to shrinking budgets. Congress and the Under Secretary of Defense for Acquisition, Technology and Logistics (USD AT&L) continue to establish legislation and policy that requires greater contractor competition or multiple sources to fulfill government requirements. Intellectual Property is the life-blood of a contractor's business, and the right to protect that IP is critical to their maintaining a competitive edge. On the other hand, the availability of technical data and the right to use that data is extremely important for the Government to adequately support an acquisition strategy. This paper will explore current laws and DOD policy with regard to Intellectual Property and technical data and computer software rights and make recommendations on appropriately balancing the Government's necessary acquisition of technical data to support procurement and sustainment of weapons systems with contractors' Intellectual Property rights, to support DoD weapons acquisition programs.

Book Defense Acquisition DoD Should Clarify Requirements for Assessing and Documenting Technical Data Needs

Download or read book Defense Acquisition DoD Should Clarify Requirements for Assessing and Documenting Technical Data Needs written by Jack E. Edwards and published by DIANE Publishing. This book was released on 2011-09 with total page 41 pages. Available in PDF, EPUB and Kindle. Book excerpt: Some DoD weapon systems remain in the inventory for decades. Therefore, decisions that program officials make during the acquisition process to acquire or not acquire rights to technical data (TD) can have far-reaching implications for DoD's ability to sustain and competitively procure parts and services for those systems. DoD needs access to TD to control costs, maintain flexibility in acquisition and sustainment, and maintain and operate systems. This report reviews the extent to which: (1) DoD has updated its acquisition and procurement policies; (2) selected acquisition programs adhered to requirements to document TD needs; and (3) DoD took actions to improve TD decisions by program managers. Book Rights to Data Developed Under Government Software Contracts An Historical Analysis and Expert Opinion

Download or read book Rights to Data Developed Under Government Software Contracts An Historical Analysis and Expert Opinion written by Deborah A. Fairchild and published by . This book was released on 1988 with total page 115 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of this study was to establish the historical and legal framework for current Department of Defense policies with regard to data rights to computer software developed under Government contracts. The study also assessed the effectiveness of those policies. The study found that although the legal system was slowly progressing toward copyright protection of computer software, Government policies remained essentially unchanged until the 1980's. Early in the decade, many events including the spare parts controversies, and passage of the Competition in Contracting and Defense Procurement Reform Acts instigated a flurry of policies, the latest of which were promulgated in April and June of 1988. Keywords: Law, Proprietary rights. (jes).
